on the verification of geometric plans and other results of geodetic work
The Czech Office of Geodetic and Cartographic in an Agreement with the Czech Mining Office and other participating central authorities provides pursuant to § 22 (a) of Act No. 46 / 1971 Coll., on Geodesy and Cartography:
§ 1
(1) Geometric plans and other results of geodetic works, (1) which are subject to coordination, (2) and supporting documents for the determination of contiguous areas (3) must be checked for compliance with the applicable rules with their formalities and accuracy.
(2) Verification may be carried out by authorities and organisations authorised to carry out geodetic and cartographic work (4) only by their personnel authorised to carry out verification under this Decree (hereinafter referred to as "authorisation"). The authorisation shall cover the results of geodetic work carried out for the needs of the institutions within the limits of their scope or for the needs of organisations within the scope of their activity and, where appropriate, for the needs of their superior central authority. This is without prejudice to the authorisation of mining meters under the upper regulation (5).
(3) The verification shall be carried out using the following clause: "The formalities and accuracy are in accordance with the rules," the signature of the certifying officer and the stamp of the authority or organisation.
§ 2
(1) The geometrical plan is a graphical representation of the property resulting from the real distribution of one or more properties, in particular the condition of the property before and after the change, with an indication of the existing and new parquet numbers and areas, as well as other details. after confirmation of compliance of the numbering of parcels with the real estate records, it is part of the instruments on legal relations with distributed real estate according to the property registration rules.
(2) Other results of geodetic work which are subject to coordination (Paragraph 1 (1)) are the establishment, renewal, transfer or abolition of geodetic points and the focus (display) of permanent changes in measurement subjects which are the content of state map works.
§ 3
(1) The Czech Office of Geodetic and Cartographic (hereinafter referred to as "the Office") issues authorities6)
(a) to verify the geometrical plans drawn up for the purposes of real estate records and to restore and establish ownership and use boundaries;
(b) to verify geodetic work which results in the establishment, renewal or transfer of geodetic points or the orientation (display) of permanent changes to the measurement subjects which are the content of state map works. 7)
(2) In agreement with the Czech Mining Authority, the Authority issues an authorisation for the verification of supporting documents drawn up in accordance with the rules on mining premises, their method of identification and their registration. 3)
(3) The authorisation may be issued for all or for each field of activity referred to in paragraphs 1 and 2.
§ 4
The authorisation provided for in Article 3 may be granted only to Czechoslovak public citizens with completed higher education in the geographical direction and at least five years' experience after the acquisition of higher education, who have demonstrated their qualifications (§ 5 (1)); to verify the geodetic work referred to in § 3 (1) (b) and (2), provided that they are carried out for the purpose of organisations subject to the upper law, 8) under the same conditions also to graduates of the Mining and Mining University University or to the Technical Mining. Exceptionally, permission may also be given to Czechoslovak state citizens with completed higher education in another technical direction with long-term geo-technical practice and Czechoslovak state citizens with completed higher education in the geographical direction with less than five years of geo-technical practice but with exceptional qualifications.
§ 5
(1) The qualification of staff to verify the results of geodetic work shall be examined by the Examination Committee set up by the Office.
(2) The President and the members of the Examination Committee are appointed and removed by the President of the Office from the staff of the Office, the Czech Mining Office, practitioners and universities after prior consultation with the competent authorities and organisations.
(3) A member of the Examination Board must have completed a higher education course in the geographical direction and at least 12 years of professional experience. One of the members of the commission is appointed a lawyer with practice in the legal relations of real estate records.
§ 6
(1) An application for an authorisation shall be submitted by the organisation to which the application is made in an employment relationship. The application shall be submitted to the Regional Geodetic and Cartographic Administration within the scope of which the organisation has its registered office (hereinafter referred to as the Regional Administration responsible for the organisation's registered office). The application shall specify:
- the name of the worker, the evidence of his education and the certificate of practice from which he has been in employment with the organisation,
- the field of activity for which authorisation is sought (Sections 3 (1) and (2)).
(2) If the worker has previously been authorised, at the time he was in employment with another organisation, or has successfully passed the test for responsible geodeses, proof of this shall be attached to the application.
(3) The Regional Administration responsible for the organisation's headquarters will examine the application and forward its opinion to the Authority.
§ 7
(1) The examination committee shall examine the applications submitted to the Office and examine the staff member's qualifications by examination.
(2) The test may be waived for workers who have verified the results of geodetic work on the basis of earlier authorisations or who have passed a similar qualification test. If it is an authorisation under Paragraph 3 (1) (b), the test may also be waived for workers who have successfully passed the test for responsible geodeses.
(3) The examination shall be carried out in accordance with the Rules of Procedure and the Rules of Procedure of the Panel issued by the Office. The test may be repeated twice, first after three months.
(4) According to the outcome of the examination of the qualification by the Examination Board, the Authority shall issue an authorisation and send it to the organisation that made the request through the Regional Administration responsible for the organisation's headquarters.
§ 8
(1) The authorisation shall cease to exist when the worker's employment is terminated with the organisation to which the authorisation is linked. The organisation shall notify these facts within 15 days of the regional administration responsible for the organisation's headquarters.
(2) If the authorised worker goes to another organisation, he shall be entitled to verify geodetic work for the organisation on the basis of and to the extent of the existing authorisation until the decision granting the new authorisation has been taken on request. If the organisation does not request authorisation for that worker within one month of his new employment, the worker shall lose the right to verify the results of geodetic work.
(3) If the authorities of geodesy and cartography find that the worker authorised, despite prior notice, does not comply with the regulations for geodetic work, the Authority may revoke the authorisation after prior consultation with the competent authority.
§ 9
If an organisation does not have a worker authorised, it shall ensure that the results of the work referred to in Article 1 (1) are verified by one of the organisations within the field of competence of its central authority having such a worker or by an organisation within the field of competence of the Office.
§ 10
Organisations whose personnel have been authorised or certified in accordance with previous rules shall submit them to the Authority by 30 November 1973 at the latest through the Regional Administration responsible for the organisation's headquarters. After examination, the Authority shall issue an authorisation under this Order. On 31 December 1973 all authorisations or certificates which have not been issued under this Order shall cease to be valid.
§ 11
The decree does not cover verification of the results of geodetic work in military buildings and premises administered by the Federal Ministry of Defence.
§ 12
(1) The decree of the Czech Geodetic and Cartographic Office No 2800 / 1969-S on the issue of authorisations for the verification of the results of geodetic works and for the verification of supporting documents for the determination of mining premises of 15 July 1969 registered in the amount of 30 / 1969 of the Collection of Laws is hereby repealed.
(2) This Decree shall take effect on 1 July 1973.
