Budget Act 1956
of 10 February 1956
The National Assembly of the Czechoslovak Republic decided on the following Act:
§ 1.
State budget objectives.
The funds are set out by the state budget as the basic financial plan of the State, and their main source is the socialist production and building efforts of the working people; It serves for the economic fulfilment of all the tasks of the national plan for the development of the national economy, in particular to accelerate the development of production forces, particularly in the heavy industry, the substantial increase in agricultural production and the development of uniform agricultural cooperatives, the introduction of new techniques into production and the substantial increase in labour productivity, thereby increasing the material and cultural level of the working people and supporting efforts to maintain peace.
§ 2.
Determination of the amount of the State budget.
(1) The total revenue of the state budget is determined by the amount of CZK 90.304,165.000, the total expenditure by the amount of CZK 89.886,912.000, resulting in a surplus of CZK 417,253,000.
(2) The national budget includes the budgets of the national committees, the revenue and expenditure of which is CZK 16.681,246.000; in addition, the balance of the national committees' appropriations before 1957 amounts to CZK 441,800,000.
(3) In order to balance the budgets of the national committees, the Government sets out the percentage shares in State revenue.
§ 3.
Government budget management.
(1) Expenditure (both investment and non-investment) may be effected only up to the amounts laid down in the State budget.
(2) The Government may authorise the execution of the necessary expenditure, not covered by the State budget, provided that its reimbursement is secured by higher revenue or by the removal of other, less urgent expenditure.
§ 4.
Responsibility for the economy.
The Government and each member, the heads of the other central offices and the Board of National Committees, shall be responsible for ensuring that, in their area of competence, all the planned tasks are met economically, that the reserves arising in the emerging economy are identified and used, that the national budget revenue amounts are at least achieved and that the expenditure amounts are not exceeded, except in cases permitted under this law.
§ 5.
Timely use of appropriations.
(1) Budget appropriations may be used only by the end of 1956, only to cover expenditure due by the end of that year.
(2) Reimbursement of expenditure which, under the provisions of this Act, may be subject to a levy on the budget for 1956 must not be deferred to the next year's budget.
(3) Referring money to cover commitments arising after 31 December 1956 or to form any other reserve for savings on budget appropriations is not permitted.
§ 6.
Detection of budgetary implications for legal and other measures.
For draft laws, legal measures of the Bureau of the National Assembly, the laws of the Slovak National Council, government regulations, government resolutions, resolutions of the Assembly of Commissions, regulations of the Assembly of Commissions, regulations of ministers, mandates and all measures of the Central Authorities, as well as proposals of resolutions of the National Committees and their councils, the consequences of their economic and financial consequences must be considered with the greatest responsibility. The consequences of these measures for expenditure after State budget revenue or for population revenue and expenditure balance or for the credit plan should be quantified and the calculation added to the draft measure. In each of the proposed measures, it must be examined whether its nature permits the introduction of new revenue and, if so, such new revenue must always be proposed.
§ 7.
Burden of state budgets for years to come.
(1) Any measure which exceeds the approved State budget in time and which, by its consequences, is burdensome or could be burdensome by the state budgets in the coming years, such as the expansion of offices and public authorities, the establishment of new lease contracts, the issue of new periodical printed matter and long-term orders, should the prior approval of the authority referred to in paragraph 2 be required if such measures would result in new or higher expenditure for the Treasury.
(2) Such measures may be approved by the Central Authority or made in the field of its own competence if the expected cost does not exceed, on a case-by-case basis, the amount of CZK 50,000 and the sum of all cases of CZK 800,000 per year. In other cases, the approval of the Ministry of Finance is required and if the burden exceeds 50 million CZK in an individual case, the government's approval.
(3) The provisions of paragraph 2 are without prejudice to the provisions on the competence of the State Systemisation Commission.
§ 8.
Inadmissibility to set off claims against the State.
The debtor may not pay his obligation to the State by offsetting his claim on the State.
§ 9.
Interim management of state management in 1957.
The Government shall take appropriate measures for the State's management between 1 January 1957 and the publication of the Budget Act for 1957, unless the Budget Act for that year is declared before 1 January 1957.
Final provisions.
§ 10.
(1) The Government is hereby authorised to reflect in the State budget the modifications to the State Plan for the Development of the National Economy.
(2) The Minister of Finance shall issue more detailed guidelines for the management and control of the State budget, in particular as regards the use of budgetary appropriations, the reimbursement of expenditure on new tasks imposed on the national committees, the tying of budgetary appropriations to cover the tasks that have been lost and the procedure for the reimbursement of expenditure on tasks not fully secured by the budget. In so doing, the Minister of Finance may allow a derogation from the provisions of Paragraph 5 (1).
§ 11.
Paragraph 7 of Act No. 90 / 1952 Coll., on the Czechoslovak Academy of Agricultural Sciences, is deleted.
§ 12.
Efficiency.
This Law shall take effect on 1 January 1956; by the Minister for Finance and other members of the Government.
