Government Regulation
of 25 January 1949
on agricultural production under the contract.
The Government of the Czechoslovak Republic orders pursuant to § 41, paragraph 2 of the Act of 27 October 1948, No. 241 Coll., on the first five-year Economic Plan for the Development of the Czechoslovak Republic (Act on the Five-Year Plan):
In order to ensure the development of agriculture and the fulfilment of the agricultural production plan, as well as to increase the standard of living of the people, the State shall enter into annual contracts with individual farmers for the production of agricultural products, with the exception of forest products. The contracts shall be concluded by the local national committees or other bodies entrusted by the Ministry of Agriculture. These contracts form the basis for the buyout and delivery contracts provided for in Section 2 of the Act of 2 December 1948, No 278 Coll., on the Centre for the Management of Agricultural Products.
(1) The Ministry of Agriculture shall, in agreement with the Ministry of Nutrition, determine the production tasks for each region according to the single economic plan. The Regional National Committees shall set these tasks out for each district and the Regional National Committees shall set them out further for each municipality. The schedule shall be made in accordance with guidelines issued by the Ministry of Agriculture in agreement with the Ministry of Food.
(2) The local national committee shall, in cooperation with the extraordinary maintenance committee and the local association of the Union of Farmers, prepare a proposal on how the production tasks set out for the municipality are to be allocated to individual farmers. This proposal will be discussed by the local national committee with the participation of a representative of the district national committee and in cooperation with the extraordinary maintenance committee and the local association of the Single Union of Farmers. When preparing and discussing the proposal, the local national committee shall take into account, in accordance with the guidelines of the Ministry of Agriculture, issued in agreement with the Ministry of Food, the production conditions of individual farmers and the purchase plan. According to the schedule, contracts for the production of agricultural products will be concluded by the Ministry of Agriculture within the time limit set by it. The contracts are approved by the Regional National Committee for the cooperation of the Regional Nutrition Commission.
(3) If a farmer fails to conclude a contract, the local national committee shall immediately refer the matter to the district national committee for a decision with its proposal, stating the reasons for which the contract was not concluded. The District National Committee shall decide definitively on the matter in such a way that the agricultural production plan is secured. His decision replaces the contract.
The institutions involved in the schedule of production tasks provided for in this Regulation shall be responsible for their timely allocation and for the timely conclusion of contracts, shall oversee the performance of those tasks and shall be obliged to do their utmost to ensure that the tasks are carried out; in the framework of the Single Economic Plan, they shall also take care of measures for prepared fertilisers, mechanising agents, seeds and seed, suitable breeding animals, credits and other means.
(1) The Regional National Committees, following the case of the Regional National Committees, may, on the basis of the overall and local development of agricultural production in exceptional cases under the guidelines issued by the Ministry of Agriculture in agreement with the Ministry of Nutrition, re-adjust the production tasks of the districts, after municipalities and individual farms. The local national committees will then adjust the production tasks and change the contracts with individual farmers.
(2) If the farmer fails to fulfil the contractual tasks, the local national committee shall ensure that the relevant work is carried out to carry out these tasks on behalf of the farmer.
(1) For Czechoslovak state goods, a national enterprise, and for large feeders, the agricultural production tasks are determined by the Ministry of Agriculture in agreement with the Ministry of Nutrition directly, taking into account their higher production tasks.
(2) The production tasks of the goods in the military administration are determined directly by the Ministry of Agriculture in agreement with the Ministry of Food and National Defence.
Production tasks to be carried out in the 1948 / 1949 marketing year by farmers contracted before the application of this Regulation shall remain unaffected and shall be included in contracts concluded under this Regulation. The same applies to breeding and propagation tasks imposed on farmers (propagators).
When concluding contracts, only the form to be determined by the Ministry of Agriculture and published in the Official Journal may be used. The contract is to be concluded at the same time as possible on all agricultural products to be produced by the farmer.
In disputes arising from the performance of contracts under this Regulation, the District National Committee shall decide.
The authorities and public authorities shall, within the limits of their competence, cooperate in the implementation of this Regulation.
The provisions of the Government Decree of 13 January 1928, No. 8 Coll., on proceedings in matters falling within the competence of political authorities (administrative proceedings) apply mutatis mutandis to the proceedings of local national committees in Slovakia.
This Regulation shall enter into force on the day of its publication; they shall be carried out by the Minister for Agriculture in agreement with the participating members of the Government.
