GOVERNMENT REGULATION
of 12 December 2006
on air quality monitoring and evaluation
The Government orders pursuant to § 55 (1) of Act No. 86 / 2002 Coll., on Air Protection and on the amendment of certain other laws (Air Protection Act), as amended by Act No. 92 / 2004 Coll., Act No. 180 / 2005 Coll., Act No. 385 / 2005 Coll. and Act No. 212 / 2006 Coll., to implement § 6 (9) of the Act:
Subject matter
This Regulation (1) implements the relevant provisions of the European Union2) and regulates the way air quality is monitored and evaluated, the limits of imitation, the permissible frequency and tolerance limits, the target limits and the long-term objectives for selected pollutants.
Air quality monitoring
(1) Air quality monitoring is carried out for the pollutants listed in Annex 1 to this Regulation.
(2) Air quality monitoring is carried out
(a) measuring the level of air pollution at designated sites by continuous or one-off sampling in accordance with the required data quality objectives set out in Annex 2 to this Regulation ("stationary measurements");
(b) measuring the level of air pollution which, compared to stationary measurements, meets less stringent data quality requirements as set out in Annex 2 to this Regulation (hereinafter referred to as indicative measurements); or
(c) calculation of the level of air pollution ("modelling").
(3) Air quality monitoring is carried out
(a) stationary measurements in all conurbations, in zones where the level of air pollution reaches or exceeds the upper limit for the assessment of selected pollutants and where, in the case of tropospheric ozone, the level of air pollution exceeds the level of air pollution below which, on the basis of current scientific knowledge, direct harmful effects on human or animal health or the environment can be excluded (hereinafter referred to as the "long-term objective"),
(b) a combination of stationary measurements, indicative measurements and modelling in zones where the level of air pollution is below the upper limit for assessment;
(c) modelling in zones where the level of air pollution does not exceed the lower limit for assessment.
(4) The Ministry of the Environment (hereinafter referred to as "the Ministry") or the legal person established by it shall, at least every 5 years, evaluate all zones and conurbations in accordance with the procedure set out in Annex 3 to this Regulation, depending on whether the levels of air pollution by each pollutant in their territory exceed the upper or lower assessment limits.
(5) Stationary measurements carried out by the Ministry or a legal person established by it shall be supplemented by other stationary measurements carried out by authorised persons. The sampling points for stationary measurements shall be located in accordance with the principles set out in Annex 4 to this Regulation. The minimum sampling points for stationary measurements are set out in Annex 5 to this Regulation.
(6) Reference air quality monitoring methods are set out in Annex 6 to this Regulation.
Evaluation of air quality
(1) Air quality evaluation shall be carried out on the basis of the results of the monitoring of air quality for pollutants having a fixed level of air pollution or a level of air pollution determined for the purpose of eliminating, preventing or reducing harmful effects on human health and the environment in general, which shall be achieved, where available by the means available, at a specified time (hereinafter referred to as the target limit).
(2) The limit for the protection of human health is set for:
(a) sulphur dioxide;
(b) particles which pass through a size-selective input filter showing 50% separation efficiency of 10 μm aerodynamic diameter (PM10);
(c) nitrogen dioxide;
(d) lead,
(e) carbon monoxide;
(f) benzene,
(g) particles which pass through a size-selective input filter showing a 50% separation efficiency of 2,5 µm aerodynamic mean (PM2,5).
(3) The target limit for the protection of human health is set for:
(a) cadmium;
(b) arsenic;
(c) nickel,
(d) benzo (a) pyrene,
(e) tropospheric ozone.
(4) The limit for the protection of ecosystems and vegetation or the target limit for the protection of vegetation is set for:
(a) sulphur dioxide;
(b) oxides of nitrogen;
(c) tropospheric ozone.
(5) The long-term objective for protecting human health and for protecting vegetation is set for tropospheric ozone.
(6) The target limit on the urban background is set for PM2,5.
(7) The decrease in the rolling average annual concentration of PM2,5 is set out in Part E of Annex 1 to this Regulation.
(8) The limit of imitation, the tolerance limits, the target limit and the long-term objective are set out in Annex 1 to this Regulation.
Transitional provisions
(1) The evaluation of zones and conurbations referred to in Article 2 (4) for the period 2006 to 2010 shall be carried out in 2011.
(2) By 31 December 2009 at the latest, the imhis limits set out in Part A of Table 2 of Annex 1 to this Regulation shall be reached.
(3) By 31 December 2012 at the latest, the target limit for imisation set out in Part C of Table 1 of Annex 1 to this Regulation shall be reached.
(4) By 31 December 2009 at the latest, the target limit for imism set out in Part C of Table 2 of Annex 1 to this Regulation shall be reached. The first year in which the determined levels of air pollution by tropospheric ozone will be used to verify compliance with the target limits during the following three or five calendar years shall be 2010.
Repeal
The following shall be deleted:
1. Government Decree No. 350 / 2002 Coll., laying down the limits and conditions for the monitoring, assessment, evaluation and management of air quality.
2. Government Regulation No. 60 / 2004 Coll., amending Government Regulation No. 350 / 2002 Coll., laying down the limits and conditions of the monitoring, assessment, evaluation and management of air quality.
3. Government Regulation No. 429 / 2005 Coll., amending Government Regulation No. 350 / 2002 Coll., laying down the limits and conditions for the monitoring, assessment, evaluation and management of air quality, as amended by Government Regulation No. 60 / 2004 Coll.
Efficacy
This Regulation shall enter into force on 31 December 2006.

Acceptable levels of air pollution, permissible frequencies and air quality monitoring requirements
All permitted air pollution levels for gaseous pollutants are applicable to standard conditions - volume converted to 293,15 K and normal pressure 101,325 kPa. All permitted levels of air pollution are arithmetic averages.

2. Target imism limits of tropospheric ozone
Notes:
1) The maximum daily 8-hour average concentration shall be determined by assessing the eight-hour rolling averages calculated from hourly data and updated each hour. Each eight-hour average is attributed to the day on which it ends, i.e. the first calculation is made from hourly concentrations during the period of 17: 00 of the previous day and 01: 00 of that day. The last calculation for the day shall be made for the period from 16: 00 to 24: 00;
(2) The target limit shall not be exceeded in more than 25 days per calendar year, averaged over three calendar years;
(3) For the purposes of this Regulation, the sum of the difference between the hourly concentration greater than 80 μg.m-3 (= 40 ppb) and the 80 μg.m-3 in the period by using only hourly values measured daily between 08: 00 and 20: 00 CET, calculated from hourly values over the summer period (1 May - 31 July);
4) Average over five calendar years.

4. Target Imitation Limit in Urban Background Localities for PM2,5
Note: 1) The target limit for PM2,5 is set for 2015 and is expressed as an average of the annual average air pollution levels of PM2,5 for 2013, 2014 and 2015 in all urban background sites. The values shall be collected from the sampling points established under point 1.6 of Part A of Annex 5 to this Regulation.
Monitoring of air quality for pollutants not having permitted air pollution levels
1. Mercury
The level of air pollution of mercury shall be assessed in terms of annual arithmetic mean.
2. Deposition of selected pollutants
Indicative measurements of total deposition shall be made for arsenic, cadmium, mercury, nickel, benzo (a) pyrene, benzo (a) anthracene, benzo (b) fluoranthene, benzo (j) fluoranthene, benzo (k) fluoranthene, indeno (1,2,3-cd) pyrene and dibenz (a, h) anthracene.
3. Tropospheric ozone precursors
Stationary measurements of tropospheric ozone precursors shall include at least the measurement of nitrogen oxides (nitric oxide and nitrogen oxide) and of relevant volatile organic substances. List of volatile organic substances recommended for measurement

The minimum data collection and time coverage requirement shall not include data losses due to regular calibration or normal maintenance of instrumentation.
For modelling, uncertainty shall be defined as the maximum deviation of measured and calculated air pollution levels at the time considered for the assessed permissible air pollution level, taking into account the timeliness of events.

2. Determination of cases of exceeding upper and lower assessment limits
The excess over the upper and lower assessment limits shall be determined on the basis of the level of air pollution over the previous five years, provided sufficient data are available. The assessment limit shall be considered to be exceeded if it has been exceeded in at least three calendar years during those five years.
Where there is less data available for a pollutant than for a period of five years, the excess of the upper and lower assessment thresholds shall be determined on the basis of the combination of the results of short-term metering campaigns during the year and in places likely to be representative of the highest levels of air pollution and the results obtained from emission inventory and modelling data.

1. Location of sampling points on a macroscale
1.1. Human Health Protection
1.1.1. Sampling sites aimed at protecting human health shall be located in such a way as to provide data on:
(a) areas within zones and conurbations where the highest concentrations are present, likely to be exposed directly or indirectly to the population for a significant period in relation to the averaged period of the imitation limit or target limit concerned;
(b) levels of air pollution in other zones and conurbations which are representative of the exposure of the population in general.
1.1.2. The sampling sites shall, as a general rule, be located in such a way as to prevent the measurement of very small micro-environments in their immediate vicinity. This means that the sampling point must be located in such a way that air samples are, as far as possible, representative of ambient air quality of at least 200 m2 in traffic-oriented locations and at least 250 m × 250 m in industrial sites.
1.1.3. As a rule, urban background sites are located in such a way that all sources located against the wind from the station operate at the level of air pollution in these locations. The level of air pollution should mainly not cause only one source, unless such a situation is typical of a wider urban area. The sampling point shall be so located that the air samples are representative of the ambient air quality of at least several km2.
1.1.4. Where background levels of air pollution are identified, the sampling point shall not be affected by the conurbations or industrial sites in its vicinity, such as places less than a few kilometres away.
1.1.5. Where an industrial contribution is to be assessed, at least one sampling point shall be installed in a hang of resources in the nearest residential area. If the background level of air pollution is not known, an additional sampling point shall be placed in the direction of the prevailing wind on the windward side of the source.
1.1.6. The sampling sites shall, as a general rule, be placed so as to be representative of similar sites not in their immediate vicinity.
1.1.7. Stationary measurements of tropospheric ozone precursors shall be carried out in particular in urban and suburban areas at any sampling point established in accordance with the requirements of this Regulation.
1.2. Protection of ecosystems and vegetation
Sampling sites for the protection of vegetation shall be located more than 20 km from the conurbations or more than 5 km from other built-up areas, industrial installations or roads. The sampling point shall be so located that the air samples are representative of the ambient air quality of at least 1 000 km2.
2. Location of sampling points on a microscale
2.1. Where possible, the following principles shall apply:
(a) the air flow around the inlet opening of the sampling probe shall not be restricted (shall be free in a sector of at least 270 °) and shall not be near any obstacle affecting the air flow (the sampling facility shall, as a general rule, be more than twice the height of the obstacle exceeding 0,5 m from the nearest building in the case of sampling points representing air pollution in the housing line);
(b) the inlet opening of the sampling probe is normally placed between 1,5 m (respiratory zone) and 4 m above the ground, a higher position (up to 8 m) may be required under certain circumstances, a higher location may also be appropriate if the station is representative of a large area,
(c) the inlet opening of the sampling probe shall not be located in the immediate vicinity of the sources in order to prevent the direct effect of emissions not mixed with ambient air;
(d) the outlet of the sampling device shall be located in such a way as to prevent the leakage of the collected air from entering the inlet of the sampling device;
(e) transport-oriented sampling facilities
- taking into account all pollutants, such sampling points should be at least 25 m from the edge of the large intersections and at least 4 m from the centre of the nearest lane,
- for the measurement of nitrogen dioxide and carbon monoxide, the inputs should be no further than 5 m from the road edge,
- the inputs should be located in such a way that the measurements are representative of the level of air pollution near the residential line, but no further than 10 m from the road.
2.2. Sampling points shall also be placed in such a way that the following factors are taken into account:
(a) disruptive sources;
(b) security, in particular public security and operational personnel;
(c) accessibility;
(d) availability of electricity and telephone connections;
(e) visibility of the site in its vicinity;
(f) the appropriateness of merging sampling points for different pollutants;
(g) zoning requirements.
3. Documentation and review of the selection of seats
The sampling point selection procedures shall be documented at the classification stage. Photographs of the area of the selected location in the main world pages and detailed maps shall be taken on a compulsory basis. The location of sampling points shall be reviewed regularly and new documentation shall be taken to demonstrate the continuous validity of the selection criteria.

2. Microscale placement
If possible, progress shall be made in accordance with point 2 of Part A and ensure that the input probe is located far from sources such as chimneys of blast furnaces and incinerators and more than 10 m from the nearest road, this distance increasing in proportion to the traffic intensity.
3. Documentation and review of location selection
Follow-up A point 3 shall apply with due review and interpretation of monitoring data in the context of meteorological and photochemical processes which affect levels of air pollution by tropospheric ozone at specific locations.
