GOVERNMENT REGULATION
of 12 December 2006
establishing the permissible level of public support in the cohesion regions of the Czech Republic
The Government orders pursuant to § 11 (3) of Act No. 72 / 2000 Coll., on Investment Incentives and on the amendment of certain laws (Investment Incentives Act), as amended by Act No. 19 / 2004 Coll., ("the Act ') to implement § 6 (3) of the Act:
(1) The permissible public aid intensity (5) for an investment action must not exceed the following values throughout the period of the public aid:
(a) in the region of cohesion Moravia-Silesia 25%;
(b) 25% in the cohesion region of Central Bohemia;
(c) in the region of cohesion, the Northwest 25%;
(d) in the region of cohesion Central Moravia 25%;
(e) in the cohesion region, the Northeast 25%;
(f) in the cohesion region, the Southeast 25%;
(g) in the cohesion region South West 25%;
h) in the cohesion region Prague 0%.
(2) Where an investment action is carried out by small or medium-sized entrepreneurs (1), the public aid intensity referred to in paragraph 1 shall be increased by 20% for small entrepreneurs and by 10% for medium-sized enterprises, with the exception of investment actions referred to in paragraphs 2 and 3.
The permissible public aid intensity for an investment event for which the value of the eligible costs, translated at the European Central Bank's rate at the date of the commitment decision, exceeds EUR 50 000 000, shall be EUR 50 000 000 for that part of the eligible costs which exceed EUR 50 000 000 and do not exceed EUR 100 000, 50% of the permissible public aid intensity in the various regions of the Czech Republic, determined in accordance with Article 1 (1).
(1) Where public aid is to be granted relating to the part of the eligible costs converted at the European Central Bank rate declared at the date of notification of the public aid to the European Commission ("the Commission ') in excess of EUR 100 000 000, the public aid may be granted, in its entirety, only after its prior approval by the Commission2.
(2) The permissible public aid intensity for an investment event for which the value of the eligible costs, translated at the European Central Bank rate declared at the date of notification of the public aid to the Commission, exceeds EUR 100 000 000 for that part of the eligible costs, which exceed EUR 100 000 000, is 34% of the eligible public aid rate in each of the regions of the cohesion of the Czech Republic determined in accordance with Article 1 (1).
The maximum public aid intensity for an investment operation in the field of data centres is 25% of the permissible public aid intensity established under Section 1.
All sub-investment operations initiated by one or more persons considered to be linked undertakings under a directly applicable European Union Regulation declaring certain categories of aid compatible with the internal market (6) shall be considered as one investment action over a period of 3 years in the territory of one region.
Transitional provisions
(1) The permissible level of public aid for investment incentives granted before the date of entry into force of this Regulation shall be assessed in accordance with existing legislation.
(2) The public aid intensities laid down in this Regulation shall apply to procedures which have been definitively completed before the date of entry into force of this Regulation, with the exception of Article 4.
Repeal
Government Decree No. 310 / 2004 Coll., establishing the permissible level of public support in the cohesion regions of the Czech Republic, is hereby repealed.
Efficacy
This Regulation shall enter into force on 1 January 2007.
