Decree of the Ministry of Education, Youth and Sports of the Czech Socialist Republic on youth homes administered by regional national committees

DECLARATION
Ministry of Education, Youth and Sports of the Czech Socialist Republic
of 19 April 1989
on youth homes managed by regional national committees
The Ministry of Education, Youth and Sports of the Czech Socialist Republic provides in an agreement with the Ministry of Finance, Prices and Wages of the Czech Socialist Republic and the Ministry of Health and Social Affairs of the Czech Socialist Republic pursuant to § 45 (2) of the Czech National Council Act No. 76 / 1978 Coll., on educational establishments (full version No. 49 / 1984 Coll.), and § 14 (2) (a), § 23 (4) and § 30 (2) of the Czech National Council Act No. 77 / 1978 Coll., on State Administration in Education (complete version No. 48 / 1984 Coll.):
§ 1
Basic provisions
The Decree provides for the establishment, abolition and organisation of youth homes (hereinafter referred to as "home ') for pupils of daily studies in gymnastics, secondary vocational schools and secondary vocational schools managed by the Regional National Committees (hereinafter referred to as" secondary schools').
§ 2
Establishment and cancellation of a home
(1) Home as part of a secondary school is set up and abolished according to the needs of secondary school pupils by the Regional National Committee (hereinafter referred to as the "National Committee"), which establishes a secondary school with a home of one)
(2) Where a more efficient organisation of educational activities or any other serious reason so requires, the national committee shall, taking into account local conditions, establish a home as an out-of-school educational establishment, (2) in particular:
(a) if the buildings of the home are operationally separated from the secondary school;
(b) if the capacity of the home is more than 100 beds,
(c) if pupils from several secondary schools are housed in the home.
(3) The National Committee shall establish a home whenever the number of pupils for whom accommodation is to be provided is higher than 60, in secondary health schools higher than 35. The National Committee may establish a home for a smaller number of pupils.
(4) If the number of students under 30 is lower, in secondary schools under 25, and if these pupils can be provided with alternative accommodation, the national committee may cancel their home at the end of the school year in which the number of students is reduced, provided that the number of pupils in the following school year is not filled in accordance with paragraph 3.
(5) In cases where the home is closed for reconstruction or emergency conditions, the National Committee shall provide replacement accommodation for pupils in the capacity of the closed home. The difference between student fees and rent for replacement accommodation shall be paid by the national committee from its budget.
§ 3
Home equipment
(1) Houses are classified according to their interior equipment in two categories:
(a) Category I houses having:
- central heating
- hot water
- bathrooms or showers
- own kitchen and dining room in or near home building
- individual rooms with capacity up to 5 beds,
(b) other homes are included in Category II, the equipment of which may include a maximum of two elements listed in Category I.
(2) Where a home is located in several buildings, each building shall be classified in the appropriate category according to the quality of the equipment.
(3) The home must be equipped with an isolation room.
§ 4
Management of home work
(1) The home established as an extracurricular education establishment is managed by the head of the home, the home established as part of a secondary school is managed by the school director or by his authorised representative for non-teaching education. The Director of the Home, the Head of the School, or his authorised representative (hereinafter referred to as "the Director ') shall be responsible for the educational activities of the Home. It shall issue the internal rules of the home in which it lays down the rights and duties of pupils and the regime of the day of home. With internal rules and the consequences of its non-compliance (§ 9), pupils will be informed immediately after their entry into their homes.
(2) In homes set up as an out-of-school educational establishment with more than 300 pupils and in homes set up as part of a secondary school with more than 60 pupils, the National Committee sets up a leading educator, who is the Deputy Director for Home Work. In homes set up as an out-of-school educational establishment consisting of several buildings separated from each other, a leading educator is appointed from 200 students. The provision of a higher number of leading educators is only possible with respect to the mandatory wage limits in the annual implementation plans.
§ 5
Advisory body of home
(1) In order to address educational issues, the head of a home established as an out-of-school educational establishment shall be appointed as his advisory body. All pedagogical staff of home and secondary schools whose pupils are in their homes are members of the pedagogical board.
(2) At the meeting of the pedagogical council of the home, the Director shall invite, as appropriate and in the nature of the case, representatives of the home council of the Socialist Youth Association, representatives of social organisations in the home, in particular the Revolutionary Trade Union Movement and the association of parents and friends of the school, the adult physician, etc.
(3) If home is part of a secondary school, the tasks of the pedagogical council of the home are performed by the pedagogical council of the secondary school.
(4) The pedagogical council of the home is discussing the annual work plan of the home, assessing its performance, the results of the educational activities of the educators for each semester of the school year, discussing the granting of educational measures, discussing education issues, taking into account the specific needs of the home.
§ 6
Organisation of educational activities
(1) The primary organisational unit of the educational activity with pupils is the educational group in which pupils of the same sex are assigned by school, grade and age. Among the total number of students staying in a home, the number of pupils per education group under 30 may not fall on average, for secondary health schools under 25, with a lower or higher number of pupils if required by a more efficient education organisation. The basic organisational unit of educational activity in the education of foreign pupils is a group of 15 pupils.
(2) The Socialist Youth Association is involved in the organisation of the educational activity of the home.3)
§ 7
Placing and release of pupils
(1) Houses are intended for pupils who cannot commute to school on a daily basis; However, he does not have a legal right to be placed in a student's home. Pupils are located within the accommodation capacity in the following order:
(a) pupils coming from children's homes and educational institutions;
(b) pupils who do not have compulsory education completed;
(c) pupils of foreign nationality up to 18 years of age whose parents live permanently outside the territory of the Czechoslovak Socialist Republic, over 18 years of age only if their accommodation in other establishments cannot be ensured;
(d) pupils in need of accommodation for social reasons (e.g. orphans, semi-orphans, pupils in foster care, children from incomplete families) or for health reasons;
(e) other commuting pupils, depending on the distance between the place of permanent residence and the school, the time needed to commute and the difficulty of transport connections.
(2) Application to home is submitted by legal representatives of pupils 4) to the Director by 31 May. At a later date, only the legal representatives of those pupils who have been admitted to secondary school daily studies may submit applications to their home. The application includes a medical certificate of the student's medical fitness to be accommodated in the collective.
(3) Students of foreign nationality whose parents live permanently outside the territory of the Czechoslovak Socialist Republic submit their application to their home themselves.
(4) The Director places pupils in a home. It shall inform the student of the placement or placement in writing of the legal representative by 30 June at the latest. A legal representative of a pupil who has been admitted to secondary school shall be notified by the Director in writing within a week of receipt of the application. Placing at home is valid for the following year immediately.
(5) The Director shall release pupils from his home during the year for the following reasons:
(a) if the legal representative of the pupil applies in writing for a stay in the home; the termination date shall be determined by the Director;
(b) unless the legal representative of the student or the pupil pays a contribution to cover the costs of accommodation for a period of two months, except for serious reasons which may temporarily prevent the contribution (e.g. death of parents),
(c) if he ceases to be a secondary school student,
(d) if the pupil has been permitted to discontinue his studies,
(e) if the student has completed accommodation in a home for violations of the internal rules of home (§ 9).
(6) During the course of the school year, the Director shall determine, in accordance with the operating conditions, the cessation of the operation of the home, for the days in which it is not taught. The operation shall stop at least once a month. In homes where pupils of foreign nationality are staying, the Director does not stop the operation of the home.
§ 8
Student accommodation and catering
(1) Home accommodation is provided to pupils for one school year, except for major holidays. Foreign nationals, orphans and pupils working on the main holidays shall be provided with professional experience by the National Committee of Accommodation and Catering, including on the main holidays in a home designated for that purpose, but not more than one month in a single home.
(2) The amount of the allowance to cover the cost of accommodation for the pupil, with the exception of the student of the secondary vocational training centre, is monthly:
v domovech I. kategorie 60,– Kčs,
v domovech II. kategorie 30,– Kčs.
The cost of accommodation for pupils in secondary vocational schools is governed by a special regulation. 5)
(3) The contribution to cover the costs of accommodation and catering for pupils in high schools and secondary vocational schools is shown by the legal representatives of pupils. The pupils of foreign nationality shall pay the cost allowance themselves. The organisation shall pay the national committee the real costs for accommodation and catering of the pupils of secondary vocational schools for which such care is provided. Days in which the student did not live in the home do not count. The allowance and actual costs shall be paid in advance each month within a time limit set by the Director.
(4) Teachers staying in a home eat there all day. If the distance of home from the secondary school were to interfere with the continuous attendance of pupils between the morning and afternoon classes, the national committee of the midday meals for pupils will arrange elsewhere. In the home of secondary school students who do not live in the home, the principal of the secondary school responsible also provides pedagogical supervision in the dining room of the home in agreement with the head of the home. Pupils' meals are subject to special regulation.6)
(5) Accommodation and catering services provided in secondary economic activity are subject to special regulations. In homes which do not have secondary economic activity permitted, the National Committee may exceptionally provide short-term mass or individual accommodation or catering to foreign persons, in particular staff of the Department of Education, Youth and Sports. The prices for accommodation or meals shall be determined by the national committee.
§ 9
Pupils' obligations and educational measures
(1) The student is obliged
(a) respect the rules of conduct of secondary school pupils, 8)
(b) comply with the provisions of the home's internal rules and follow the instructions of the home's educational staff.
(2) The pupil may be awarded a commendation or other award for good behavior, good performance, bravery or exceptional merit in favour of the collective. The degree of praise shall be determined by the Director.
(3) If a pupil violates the internal rules of the home, one of the following educational measures shall be granted according to the seriousness of the offence:
(a) a warning given by the educator,
(b) restrictions on access;
(c) the reprimand expressed by the Director before the education group;
(d) a reprimand expressed by the Director, with which all pupils will be informed through group educators,
(e) a educational interview before a commission composed of the head of the home, a group tutor, a school representative and a representative of the home council of the SSM. The competent regional school inspector or representative of the Ministry of Education, Youth and Sports of the Czech Republic will also attend the educational interview with foreign nationals; the Director may also invite representatives of social organisations and state bodies to attend meetings,
(f) conditional termination of accommodation in a home with a trial period;
(g) termination of accommodation in the home.
(4) Accommodation in the home is completed by the director, on a proposal from the educator, after consultation with the pedagogical board and home board of the Socialist Youth Association. When the accommodation is suspended, the Director shall set a trial period of between one and five months. If a student to whom a trial period has been set has not committed any further wrongdoing against the home rules within that period, the Director shall refrain from leaving. The student to whom the accommodation has been completed may be left in the home by the Director for as long as is strictly necessary to ensure the replacement accommodation by the student, but not more than one month from the date specified for the termination of the accommodation in the home. The Director shall inform the National Committee of the termination of the student's accommodation in the home.
(5) The implementation of the educational measure referred to in point (g) of paragraph 2 to pupils carrying out compulsory schooling and pupils of foreign nationality, pupils from children's homes or educational institutions is only possible if their accommodation is ensured.
(6) Education measures shall be notified to the school, to the legal representative of the pupil in writing and recorded in the student's personal file.
§ 10
Home workers
(1) Educational and organisational work shall be carried out in the home, in addition to the Director, by the leading educator, educators and assistant educators. (9) The pay conditions of educational staff, the obligation of education and the qualification conditions for the performance of functions shall be laid down in specific rules. 10)
(2) Overnight service shall be performed by assistant educators. Their number shall be determined by the National Committee taking into account the deployment and number of buildings, the number of pupils, the principles of safety and economy. In the event that night duty cannot be provided by auxiliary educators, the educators shall exercise night time and supervision outside the prescribed working hours from 22.00 to 06.00, in return for remuneration under the Staff Regulations. 10)
(3) Technical, administrative and operational staff are responsible for the economic, administrative and operational tasks of the home. The rights and obligations of such staff shall be laid down in the Conditions of Employment. 9)
(4) The number of educational and other home workers is determined by the National Committee. In determining the number of staff, it shall take into account the specificities of operating conditions, in particular when home is operated on Saturdays and Sundays, when housed in multiple buildings or when secondary school pupils are housed in a home with exchange courses.
§ 11
Final provision

This Decree shall take effect on 1 September 1989.
