laying down certain obligations of organisations to ensure safety of work for imported technical equipment
The Czech Labour Safety Authority pursuant to § 5 (1) (d) of Act No. 174 / 1968 Coll., on State Professional Safety Supervision, and the Czech Mining Office pursuant to § 57 (1) (d) of Act No. 41 / 1957 Coll., on the Use of Mineral Wealth (Upper Law), and under § 10 (a) of the Czech National Council Act No. 24 / 1972 Coll., on the organisation and extension of supervision of the State Mining Administration, provides in an agreement with the Czech Trade Union Council and with the relevant central bodies:
(1) The Decree applies to organisations which conclude economic agreements for the import of technical equipment (hereinafter referred to as "customers") with foreign trade organisations or with Czechoslovak legal persons authorised to operate abroad and are socialist organisations.
(2) Collectors are also organisations authorised to operate abroad when they import technical equipment for their own use.
(1) The imported technical installations under this Order are:
(a) dedicated pressure equipment (1) including watermarks and boiler safety valves and dedicated lifting equipment (2) imported separately or as part of an investment unit;
(b) machinery, machinery sets and technical equipment which process different substances, raw materials or semi-finished products by machining, editing, reforming, connecting, mixing, sorting, drying or subjecting them to other processes imported separately or as part of an investment unit;
(c) reserved electrical installations (3) and reserved gas installations (4) when imported as part of imported investment units;
("imported establishments').
(2) Machines, sets of machinery and technical equipment referred to in paragraph 1 (b) which are subject to supervision by the authorities of the State Mining Administration shall lay down a specific rule. 5)
(3) Equipment subject to approval by the public testing authorities shall not be considered as imported equipment. 6)
(1) Imported equipment in terms of safety of work and technical equipment is assessed by the Labour Safety Inspectorate (7) competent according to the seat of the customer or the Czech Labour Safety Authority, if the exercise of supervision is reserved (8) and, as regards imported equipment subject to special regulations (9) supervision by the authorities of the State Mining Administration, the Czech Mining Authority (hereinafter referred to as the "supervisory authority").
(2) The assessment shall cover the first cuts of imported equipment referred to in Article 2 (1) (a) and (b) and all imported equipment referred to in Article 2 (1) (c).
(3) An establishment which:
(a) not yet imported;
(b) it has been imported before but has undergone changes which substantially affect the safety of work and technical equipment.
(4) Where there is doubt as to whether this is a change which substantially affects the safety of work and technical equipment, the supervisory authority shall be responsible for assessing the matter.
(1) The collector must notify the supervisory authority in writing before concluding an economic import contract
(a) imported equipment intended to be the subject of an economic contract with the organisation of foreign trade, indicating its technical characteristics, essential characteristics, location and manner of use, the quantity in which it is to be imported, including the estimated date of import, as well as the organisation of foreign trade;
(b) the requirements for ensuring the safety of work and technical equipment laid down in general binding regulations and technical standards to be applied in the draft economic contract with the organisation of foreign trade;
(c) what appropriate alternative measures are proposed if imported equipment does not meet the requirements of safety of work and technical equipment.
(2) The collector shall, at the request of the supervisory authority, complete the information referred to in paragraph 1.
The supervisory authority shall, following the written notification referred to in Article 4, issue to the customer within 30 days at the latest a professional statement (opinion), including any replacement measures. Where an economic contract is the subject of an imported establishment which is exhibited in the Czechoslovak Socialist Republic, the supervisory authority shall issue a professional statement (opinion), including any replacement measures, within 5 days of the written notification of the supervisory authority.
This Decree shall take effect on 1 October 1983.
