Federal Ministry of Transport
of 10 June 1974
on the operation of road taxis
The Federal Ministry of Transport, in agreement with the participating central authorities, provides, pursuant to § 8 (1) of Act No 57 / 1950 Coll., on the treatment of road transport business, and § 16 (1) (b) of Government Decree No. 54 / 1953 Coll., on road traffic, as amended by the legal measure of the Bureau of the National Assembly No. 13 / 1956 Coll.:
Basic provisions
(1) Road taxi services are services which are carried out in return for payment on the road by vehicles for the non-mass transport of persons, delivery vehicles and lorries of less useful weight and which can be used by each person under uniform conditions of transport; Road taxi service is personal and freight.
(2) Each road taxi vehicle shall be visibly marked with the name "Taxi 'indicating whether it is a passenger or freight taxi and indicating the operating time; the road taxi station so designated is intended for road taxi vehicles at the time of their operation. A special regulation applies to the reservation of a post on the road for road taxis. 1)
Vehicles
(1) Only vehicles equipped with
(a) designated sealed taximeter and computer-operated distances, the location of which allows the passenger (s) to easily check the reported data;
(b) an approved type-2 fire extinguisher) with a freezing load of at least 2 kg; the extinguisher shall be on the vehicle in an emergency condition against fire of solid, liquid and gaseous substances and shall be placed in a clearly visible and easily accessible place in the immediate vicinity of the driver;
(c) a roof lamp of white or yellow colour with a black inscription "Taxi" of a minimum size of 140 x 70 mm; for its illumination the provisions on the illumination of direction tables on vehicles for mass transport of persons apply; 3)
(d) the visible name and address of the road taxi operator either under the roof lamp or indelibly and indelibly on the right front door (right door of the driver's booth); the marking shall be at least 30 mm in letters;
(e) a table of the prices of the fare and, where applicable, of the carriage in a visible place within the vehicle.
(2) Only closed passenger vehicles of at least four seats may be used in the passenger taxi service, with at least three access doors to the driver's and passenger places and with a dedicated whole (undivided) luggage compartment of at least 0,350 m3.
(3) A freight taxi service may be operated by delivery and freight vehicles with a useful weight not exceeding 3 tonnes.
(4) Socialist organisations shall not operate a freight taxi service by vehicles owned by citizens.
Operators' obligations
(1) The road taxi operator is obliged to:
(a) ensure regular technical inspections of the vehicle at least once a month and keep a record thereof, showing when the inspection was carried out, who carried it out, what defects were detected and when and by whom they were removed;
(b) ensure that the performance of a passenger taxi service is recorded in a record of the operation and performance of the vehicle from which the sales achieved, the vehicle's performance and the hours worked by drivers for each calendar day or, where applicable, for the transport performance, if more than one calendar day; the binding template for the statement is set out in the Annex to this Decree;
(c) to ensure the continuous recording of the performance of the freight taxi service in a record of the operation and performance of the vehicle prescribed under the regulations on the mandatory maintenance of the operational record of the performance of the freight carriage (4), accompanied by data on the sales for each journey and on unpaid journeys; This obligation shall also apply to the performance of a freight taxi service operated by supply vehicles; the recording must be kept by the driver while driving;
(d) to equip the driver with a block of numbered, business-marked confirmation of the payment of the fare; The driver is obliged to issue the receipt to the passenger (carrier) upon request.
(2) Where a socialist organisation uses a vehicle that is owned by a citizen to operate a personal taxi service, it is obliged to conclude a written contract with the owner on the temporary use of the vehicle and to negotiate with the State Insurance Agency a contract on vehicle insurance in case of damage, destruction or theft (emergency insurance); insurance premiums shall be paid by the organisation, unless otherwise provided for in the legislation. 5)
Driver
The driver in the road taxi service may only be the person who:
(a) be in work or in a Member relationship with the road taxi operator;
(b) has an appropriate driving licence and is physically and mentally capable of driving motor vehicles as an occupational driver, 6)
(c) has not been convicted of a criminal offence or offence which implies that he is not a driver in a road taxi service;
(d) has at least five years' experience in driving two-track motor vehicles;
(e) knows the locality of the area in which the road taxi service is mainly carried out.
Exceptions
In justified cases, exemptions from Sections 2 (1) (a), 2 (3) and 4 (d) may be granted; the exemption is granted by the Ministry of Interior of the Czech Republic or by the Ministry of Interior of the SSR or by the authority entrusted to it by the Ministry of Interior of the Czech Republic or the Ministry of Interior of the SSR. The driver must carry a document of the exemption from Paragraph 2 (1) (a).
Final and repeal provisions
(1) In Decree No 32 / 1972 Coll., on the conditions of use of vehicles on the road, Section 68 is deleted and in Paragraph 81 (1) the words "taxis vehicles" are deleted; the exceptions to those provisions under Paragraph 85 (2) of the Decree in question remain unaffected if their period of validity has not expired.
(2) They are repealed.
(a) Part I of the Directives of the Ministry of Interior of the Czech Republic and of the Ministry of Transport of the Czech Republic No. MH 1 / 472 / 70 / Č and MD 12 862 / 70, for the operation of taxis in road non-mass passenger and freight transport, the issue of which was notified in the amount of 1 / 1971 Coll.,
(b) Part I of the Directives of the Ministry of Interior of the SSR and of the Federal Ministry of Transport, Nos MH 1946 / 1971 and FMD 46-475 / 71, for the operation of taxi services in road non-mass passenger and freight transport.
Efficacy
This Decree shall take effect on 1 July 1974.
