DECLARATION
Czech Geodetic and Cartographic Office
of 28 May 1973
on the implementation of geodetic and cartographic works and on cartographic works
The Czech Office of Geodetic and Cartographic provides in an agreement with the participating central authorities pursuant to § 22 (a) and (c) of Act No. 46 / 1971 Coll., on Geodesy and Cartography:
Authorisation to carry out and notify geodetic work
List of authorised organisations
(1) Regional Geodetic and Cartographic Administration1) (hereinafter referred to as "Regional Administrations") maintain a list of organisations authorised to carry out geodetic and cartographic work pursuant to Sections 4 and 7 of Act No. 46 / 1971 Coll., on Geodesia and Cartography (hereinafter referred to as "the Act") which have their head office in their respective jurisdiction.
(2) Organisations intending to carry out geodetic and cartographic work shall notify the Regional Administration, in accordance with Article 7 (2) of the Act, of the following:
(a) the name, registered office and address of the organisation, the designation of the superior body;
(b) the subject matter of the activity;
(c) the territorial scope of the activity;
(d) the type of geodetic and cartographic work;
(e) the names of the staff leading the geodetic and cartographic workplaces, indicating their professional qualifications and the names of the staff authorised to verify the geometrical plans and other results of the geodetic work, (2) and of the staff who passed the test for responsible geodeses;
(f) the total number of staff with vocational secondary and higher education.
(3) The Regional Administration shall examine the data referred to in paragraph 2 and, if it does not detect a defect, enter the organisation in the list referred to in paragraph 1 and communicate it within 30 days of the date of receipt of the notification under which it is entered or the reasons why it was not entered in the list.
Notification obligation
(1) Organisations are required to notify the Regional Administration within the scope of which the work will be carried out (hereinafter referred to as the "Regional Administration responsible for the place of implementation of the work"), the implementation of the work which will result in:
(a) establishment, renewal, transfer or cancellation of geodetic points, 3)
(b) the orientation (display) of permanent changes to the measurement subjects which are the content of state map works, with the exception of geometric plans.
(2) In order to ensure the timely coordination of geodetic and cartographic work, the regional authorities responsible for the place of implementation of the work shall notify the extent of the planned geodetic and cartographic work at the same time as they are included in the plan.
(3) The notification of the implementation of the individual work referred to in paragraph 1 shall be sent to the regional authority responsible for the place of implementation of the work no later than 15 days before the start of the work.
Forms of notification
(1) The notification provided for in Article 2 (1) shall be made by the organisations on the prescribed form (4) and shall indicate in particular:
(a) their name, registered office and address and the number under which they are entered in the list referred to in Article 1 (3);
(b) the name, registered office and address of the organisation for which the work will be carried out;
(c) the nature and purpose of the work;
(d) the county, district, municipality and cadastral territory in which the work will be carried out;
(e) total range of work in units (km2, ha, km),
(f) coordinate and height system, technical regulations and standards under which work will be carried out;
(g) the method of stabilising the point field;
(h) whether the work is linked to earlier mapping and to which,
(i) the planned start and end dates;
(j) the way in which the originals and printed matter are drawn up, who and how to make copies, the type of archived material;
(k) the design at which the results of the work are to be stored;
(l) the required geodetic data, supporting documents and elaborates to be used for the notified work and the name of the staff responsible for taking over it.
(2) The notification shall be accompanied by a sketch of the designated territory on an appropriate scale or on a copy of the State map indicating the area (s) of measurement.
Coordination of works
Use of documented results of works
(1) The Regional Administration responsible for the place of work shall communicate to the organisation within five days of receipt of the notification referred to in Article 3, which shall be subject to coordination of the work, and shall discuss how the work is to be carried out. It shall also discuss with it which resulting parts of the elaborate are to be submitted to it by the organisation in a copy or print for documentation, which parts are to be verified in accordance with Article 8 of the Act, or agree on which other places they will be stored and which marks, signals and other geodetic points equipment will be transferred to the management of organisations in the field of competence of the Czech Geodetic and Cartographic Office (hereinafter referred to as the Office). The Regional Administration responsible for the place of work shall draw the attention of the organisation to the possibility or need to use the work previously carried out or the work (s) carried out by another organisation (s).
(2) The Regional Administration responsible for the place of work determines which parts of the elaborate do not need to be surrendered or stored on the grounds that they cannot be used in part for the purpose of public map works.
(3) Organisations are required to make effective use of documented results of earlier work and to carry out new position and height measurements so that it can be taken over or used for state map works, their maintenance and property records.
(4) If the organisation finds that the geodetic data is not in line with the actual situation, it shall immediately notify the Regional Authority within the scope of which the work will be carried out, but not later than the transmission of the results of the work.
(5) Organisations shall verify that no changes have occurred in the data issued before their use.
(6) Geodetic data, copies, extracts and operators may be used only by organisations to which they have been issued or lent for their own use.
Labour control
(1) The Office and the Regional Administration may, following prior notification, carry out checks on the work to be taken over or used for national map works and documentation, including during the implementation of the work. Organisations shall provide effective assistance to the control authorities and provide them with the necessary documents.
(2) The result of the check shall be recorded indicating the defects identified.
(3) The identified errors, irregularities, non-compliant results or other deficiencies will be eliminated by the organisation performing the work on its cargo.
(4) If, in carrying out geodetic and cartographic work, defects which have been brought to the attention of the work organisation are repeated, the Regional Administration shall request the Authority to discuss with the competent central authority the correction process, or to prohibit the execution of the work until the defects have been remedied.
Evaluation and documentation of works
(1) The evaluation of the quality and documentation of the results of geodetic work is ensured by the regional administration responsible for the place of implementation of the work.
(2) Organisations shall forward to the territorial authority the resulting parts of the elaborates of work subject to coordination verified by the authorised work5) within 30 days of the completion of the work, unless otherwise agreed.
(3) The resulting parts of the elaborate of geodetic works which, pursuant to Article 4 (1), will not be submitted to the Regional Authority shall not be shredded without the consent of the Regional Administration. If their data need to be used for national map works or for the work of other organisations, their use must be possible.
(4) The Regional Administration responsible for the place of work shall examine whether the resulting parts of the elaborates of geodetic work submitted to it pursuant to paragraph 2 are in conformity with the provisions in force. If incompleteness or obvious defects are detected, it will return the resulting parts of the elaborates to remove defects. Organisations shall be obliged to remove the detected defects for their cargo within 30 days of the date on which those parts of the elaborates are returned to them, unless otherwise agreed with them.
(5) Specific provisions apply to the surrender and further use of the results of geodetic work containing facts of state, economic or professional secrecy.
Issue and documentation of cartographic works
Consent of the Office under § 10 (1) and (3) of the Act
(1) Organisations shall seek approval under Article 10 (1) and (3) of the Act at the same time as the work is included in the plan; the Office shall decide on the applications received within 30 days.
(2) The request for consent shall state:
(a) the type and name of the work;
(b) the purpose of the work (copy),
(c) the year of issue in question (copy),
(d) scale,
(e) the extent of the territory displayed;
(f) the type of map base (name, scale, year of issue) to be used;
(g) the amount of the printing load;
(h) the method of printing the work,
(i) the name of the organisation which makes them polygraphically.
Cartographic Works Editorial Plan
(1) The Office ensures the establishment of a master, annual and forward-looking map editing plan for economic construction.
(2) The Authority approves the concept of an annual and forward-looking programme of cartographic works intended for civil enlargement.
Documentation of cartographic works
Organisations issuing cartographic works shall deliver to the Office, free of charge, for documentary purposes, three copies of each cartographic work, at the latest at the same time as the shipment of the printing load, or within 30 days of the completion of the work, if the printing has not been carried out.
(1) Paragraph 7-9 of this Order does not apply
(a) the results of geodetic, cartographic and reproductive works serving as ground-based land-use planning, land-processing, forest-management, geological and geological research, project and mining documentation;
(b) simple plans and map supplements for literary works and their graphic annexes, which are not a complete separate map by their execution and merely supplement or explain the text of the literary work.
(2) In cases of doubt to which cartographic works are covered by the provisions of § 7-9, the Office shall decide.
Provisions common, transitional and final
Entry into real estate
(1) The official documents provided for in Article 15 (2) of the Act issue:
(a) the Office for its staff;
(b) regional administration for its personnel and for the staff of organisations which have their head office in its territory, at the request of such organisations.
(2) In agreement with the Authority, other central government bodies may also issue the licences referred to in paragraph 1 for their personnel and for the staff of organisations managed by those authorities.
(3) Official passes issued in accordance with paragraphs 1 and 2 shall not apply to the entry into the premises and objects used by the armed forces, to the places where the facilities used for defence and security of the State are located, and to the designated railway areas.
Organisations which, at the date of entry into force of the Act, have been authorised under the existing regulations to carry out geodetic work shall submit to the Regional Authority within whose jurisdiction they have their registered office, a document proving their entitlement and adding the information required to be included in the list of authorised organisations referred to in Article 1 within 30 days of the date of entry into force of this Decree.
This decree does not apply to geodetic and cartographic work carried out in the field of the Federal Ministry of National Defence for State Defence and to mining work carried out under the upper rules.
This Decree shall take effect on 1 July 1973.
