Legal measures of the Bureau of the National Assembly
of 22 November 1955
on the pay ratios of judges, prosecutors and legal candidates (salary regulations).
The Bureau of the National Assembly of the Czechoslovak Republic has decided on the following legal measure under Article 66 of the Constitution:
Legal candidates.
(1) The Minister of Justice, the Prosecutor-General, is appointed by the legal practitioner for the branch of the Ministry of Justice.
(2) The employment relationship of legal candidates is governed by the provisions of Act No. 66 / 1950 Coll., on the employment and pay ratios of civil servants; the salary ratios of the legal candidates shall be adjusted by the government.
(3) The Minister of Justice shall determine which individual acts reserved by law to the judge or notary of the State may be carried out by the legal practitioner with legal effect.
(4) The provisions of paragraphs 1 and 3 shall also apply to military legal candidates; the appropriate measures under these paragraphs shall be taken by the Minister of Justice, in agreement with the Minister of National Defence, in the case of the Prosecutor General.
(5) The provisions of Act No. 88 / 1952 Coll., on the material security of members of the armed forces, and the provisions of its implementing provisions, shall apply to the salary ratios of military legal candidates.
(1) The purpose of waiting practice is to train legal candidates on an ideological and professional basis for their future activities. The waiting experience is two years; end with the final assessment of the political, professional and practical knowledge of the legal candidate.
(2) The education of legal candidates for courts and state notaries during waiting practice is organised and managed by the Ministry of Justice. The Attorney General organises and manages the upbringing of legal candidates in prosecutors.
(3) The provisions of paragraph 1 shall apply mutatis mutandis to the education of law practitioners organised and managed by the Ministry of Justice.
Transitional and final provisions.
On the date of the entry into force of this legal measure, all provisions on matters governed by this legal measure shall cease to apply. In particular, they shall cease to apply:
(a) § 2, 3 and 4 (1) No 3 of Act No. 67 / 1950 Coll., on the employment and pay ratios of judges, prosecutors and legal practitioners (judicial law);
(b) Government Regulation No 71 / 1950 Coll., establishing a salary scheme for judges, prosecutors and legal candidates, subject to the provisions of Paragraph 4 (2) of this legal measure;
(c) Act No. 33 / 1953 Coll., on Legal Practices and Expert Exam in Justice and Prosecution.
This legal measure shall take effect on 1 November 1955; they shall be implemented by the Prime Minister and the Minister of Justice in agreement with the participating members of the Government.
