GOVERNMENT REGULATION
of 16 December 2002
establishing a list of certain metallurgical products originating in Ukraine which can only be imported into the Czech Republic on the basis of an automatic licence and amending Government Regulation No. 272 / 2002 Coll., establishing a list of certain metallurgical products which can only be imported into the Czech Republic on the basis of an automatic licence and for which monitoring of their imports into the Czech Republic applies
The Government mandates the implementation of Act No. 62 / 2000 Coll., on certain arrangements for the export or import of products and on the licensing procedure and on the amendment of certain laws ("the Act '):
IMPORTS OF CERTAIN HUMAN PRODUCTS OF UKRAINE ORIGIN
(1) They may only be imported into the Czech Republic on the basis of a non-automatic licence for metallurgical products originating in Ukraine, (1) declared in the Customs Tariff (2) in the following subheadings:
| 7208 51 20 | – O tloušťce převyšující 15 mm, |
| 7208 51 91 | – 2 050 mm nebo více, |
| 7208 51 98 | – Menší než 2 050 mm, |
| 7208 52 20 | – O šířce 2 050 mm nebo více, |
| 7208 52 80 | – O šířce menší než 2 050 mm, |
| 7208 90 00 | – Ostatní, |
| 7225 40 12 | – Z nástrojové oceli, |
| 7225 40 40 | – O tloušťce převyšující 10 mm, |
| 7225 40 60 | – O tloušťce 4,75 mm nebo více, avšak nepřesahující 10 mm, |
| 7225 99 00 | – Ostatní. |
(2) For the products referred to in paragraph 1, the quantitative import restrictions for 2003 shall be fixed at a total of 80 000 tonnes and 80 000 tonnes for 2004.
(3) Non-automatic licences shall be granted in each calendar year until the quantities referred to in paragraph 2 are exhausted. Products referred to in paragraph 1 exported outside the customs territory of the Czech Republic shall not be included in the total annual quantitative limit.
(1) The application for a non-automatic licence must be supported by the original of the export licence and the original of the certificate of origin issued by the competent Ukrainian authority (hereinafter referred to as the Ukrainian authority).
(2) The application for a non-automatic licence shall contain, in addition to the particulars provided for in Section 68 of the Act, all the information contained in the export licence referred to in paragraph 1.
(3) The Ministry of Industry and Trade (hereinafter referred to as "the Ministry") will decide on the application for a non-automatic licence within 10 working days of its receipt. A non-automatic licence shall be granted for the calendar year in which the application was lodged, unless otherwise specified.
(4) Where non-automatic licences have not been issued pursuant to Paragraph 1 (3) for 2003 and the applicant applies for an non-automatic licence by 20 March 2004 at the latest and the application is supported by an export licence and an original certificate of origin issued by the Ukrainian Office after 30 September 2003 valid for 2003, the Ministry shall grant it a non-automatic licence retroactively for 2003 until 31 March 2004.
(5) The model of the application for a non-automatic licence is set out in Annex 1 to this Regulation, the model export licence issued by the Ukrainian Office is set out in Annex 2 to this Regulation and the model of the certificate of origin issued by the Ukrainian Office is set out in Annex 3 to this Regulation.
(1) The holder of the non-automatic licence shall, throughout the period of validity of the licence, notify the Ministry of all changes to the information contained in the application, in particular the change in the country of destination of the product in the case of its export outside the customs territory of the Czech Republic.
(2) The Ministry shall withdraw the non-automatic licence issued if the corresponding export licence issued by the Ukrainian Office has been revoked or revoked.
(3) When products are imported into the Czech Republic, the original of the non-automatic licence shall be presented to the customs office.
Amendment of Decree No. 272 / 2002 Coll.
In Government Decree No. 272 / 2002 Coll., establishing a list of certain metallurgical products which can be imported into the Czech Republic on the basis of an automatic licence only and for which the monitoring of their imports into the Czech Republic applies, Annex No 1 is amended by adding the following text to subheadings 7208 5130 to 7208 5299, 7208 9090, 7225 4020 and 7225 4050: "- excluding products originating in Ukraine '.
EFFECTIVE
(1) This Regulation shall enter into force on 1 January 2003.
(2) This Regulation shall expire on 31 December 2004 or on the date of the entry into force of the Treaty of Accession of the Czech Republic to the European Union if that date is earlier.
