DECLARATION
of 17 December 2020
laying down details of the content of the documentation for the issue of a common permit for construction of transport infrastructure
The Ministry of Transport provides pursuant to Section 2j (3) of Act No. 416 / 2009 Coll., on speeding up the construction of transport, water and energy infrastructure and electronic communications infrastructure (Line Act), as amended by Act No. 403 / 2020 Coll.:
Subject matter
This decree sets out the details of the content of the documentation for the issue of a joint authorisation, attached to the application for a joint authorisation, which places and authorises the construction of the transport infrastructure under the liner law, processed to a limited extent.
(1) Details of the content of the dossier, processed to a limited extent, for the issue of a joint authorisation
(a) the railway works are set out in Annex 1 to this Decree;
(b) the construction of the infrastructure is set out in Annex 2 to this Decree.
(2) The individual parts of the documentation shall correspond to the type and importance of the construction, technical design, purpose of use, environmental impact and duration of the construction. Items of individual parts not included in the construction shall not be entered.
Efficacy
This Decision shall enter into force on 1 January 2021.

Details of the content of the documentation for the issue of a common runway construction permit (to a limited extent)
The documentation shall include parts of:

A.1 Identifying information
A.1.1 Construction data
(a) the name of the building;
(b) place of construction - county, district, track section, local destination according to current Railway Declaration, cadastral territory, parcustoms land numbers, for buildings address, descriptive numbers,
(c) subject matter of documentation - new construction or modification of completed construction, permanent or temporary construction, purpose of use of the construction,
d) integration of construction according to § 1 of Act No. 416 / 2009 Coll., on speeding up construction of transport, water and energy infrastructure and electronic communications infrastructure (Line Act), as amended,
(e) in the case of a set of buildings, a description of the construction of the main building and a breakdown of the construction according to the type and the substantive competence of the building offices to the adjacent buildings,
(f) broader relationships - the importance of the route throughout the network, the relationship on the European network, the prescribed parameters.
A.1.2. Data on the builder:
(a) the name, surname and place of permanent or similar residence (natural person); or
(b) the name, surname, identification number of the person, if assigned, registered office of the entrepreneur (natural person undertaking if the intention is related to his business); or
(c) the company or name, the identification number of the person, if assigned, address of the registered office (legal person).
A.1.3. Data on the documentation processor
(a) the name, surname, business name, identity number of the person, if assigned, business address (natural person undertaking) or business name, person identification number, registered address (legal person);
(b) the name and surname of the main designer, including the number under which he is entered in the register of authorized or registered persons maintained by the Czech Chamber of Architects or by the Czech Chamber of Authorised Engineers and Technicians active in the construction, with a marked field or specialization of its authorization1)
(c) the names and surnames of the designers of the individual parts of the documentation, including the number under which they are entered in the register of authorised or registered persons maintained by the Czech Chamber of Architects or by the Czech Chamber of Authorised Engineers and Techniques in the Construction, with the specified field or specialization of their authorization1),
(d) the names and surnames of the designers of the documentation attached to the document part authorised under the specific rules.
A.2. Breakdown of buildings and technical and technological equipment
(a) the technological part - safety equipment, communication equipment, heavy current technology, other technological equipment;
b) construction part - engineering buildings, ground construction buildings and technical equipment of ground construction buildings, traction and energy equipment,
(c) temporary structures and installations which are part of the relevant buildings of the construction and technological part.

B Technical summary report
B.1 Description of construction territory
(a) the characteristics of the territory and the building plot, the built-up territory and the unbuilt territory, the conformity of the proposed construction with the nature of the territory, the use and construction capacity of the territory, the details of the conformity of the construction with the planning documentation, the objectives and tasks of the spatial planning, including information on the land planning documents issued;
(b) information on decisions to authorise exemptions from the general land use requirements;
(c) whether and in what parts of the dossier the conditions of binding opinions of the authorities concerned are taken into account;
(d) geological, geomorphological and hydrogeological characteristics, including mineral and groundwater sources;
(e) listing and conclusions of the surveys and measurements carried out - geological survey, hydrogeological survey, engineering geological survey, corrosion survey, construction technical survey, construction historical survey, etc.,
(f) protection of the territory under other legislation;
(g) the location in relation to the flood area, subdolled area, etc.,
h) influence of the construction on surrounding buildings and land, protection of the surroundings, influence of the construction on drains in the territory, influence of the construction on the stability of slopes,
(i) requirements for rendering, demolition, wood felling;
(j) the requirements for the maximum temporary and permanent seizures of the agricultural land fund or parcels intended for the performance of the forest function;
(k) territorial technical conditions - in particular the possibility of connecting the construction to existing technical equipment of the territory, transplants of civil engineering networks, the possibility of barrier-free access to the proposed construction,
(l) the list of land according to the land register on which the construction is located,
(m) a list of the land according to the cadastral of the property where the protection or security zone is established;
(n) the physical and temporal linkages of the construction, which are conditional, caused, related investments.
B.2 General description of the construction
B.2.1. Basic characteristics of the construction and its use
(a) a new construction or modification of the completed construction; for the change of construction, data on their current condition, conclusions of construction technical or historical survey and results of static assessment of supporting structures, data on the track or object concerned - track category, track section, station, etc.,
(b) the purpose of the use of the construction;
(c) permanent or temporary construction;
(d) an overall description of the transport concept of the construction solution, including the basic parameters of the construction with regard to the location of the construction and the purpose of the construction (track, station and framework transport technology), the proposed construction capacity including the basic technical parameters of the construction (proposed line speeds, location markings and stops, basic traffic data and proposed operational and transport technologies and equipment);
(e) information on decisions taken to allow an exemption from technical requirements for construction and technical requirements ensuring the barrier-free use of the construction or consent to a derogation from the applicable regulations and standards, or consent to the use of non-approved and non-installed equipment,
(f) whether and in what parts of the dossier the conditions of binding opinions of the authorities concerned are taken into account;
(g) protection of construction under other legislation;
(h) the basic balance of construction - the needs and consumption of media and materials, the management of rainwater, the total quantity produced and the types of waste and emissions, etc.,
(i) basic construction assumptions - time data on implementation of the construction, breakdown into stages;
(j) essential requirements for early use of buildings and test operation of buildings, their duration in relation to completion and use of the construction;
(k) the indicative cost of the construction.
B.2.2 Total urban and architectural solutions
B.2.3 General technical and technological solutions
(a) a description of the overall concept of the construction technical and technological solution by groups of objects or individual objects;
(b) the total balance of claims of all types of energy and hot commercial water;
(c) the total quantity produced and the types of waste and emissions, the method of handling the recovered material;
(d) requirements for the capacity of public networks of communication lines and electronic communication equipment of the public communications network.
B.2.4 Handicap use of the building
Principles for dealing with accessibility and use of construction by persons with reduced mobility or orientation, including information on conditions for the performance of the work of disabled persons.
B.2.5 Safety when using the construction
(a) a description of compliance with the essential requirements of the relevant regulations and standards of protection against the effects of traction and power lines;
(b) addressing safeguards against the influence of stray currents based on the results of corrosion surveys;
(c) measures to prevent unwanted entry into, monitoring, and access to, a closed runway area;
(d) the security and supervision of road crossings.
B.2.6 Basic description of technological objects and technical equipment
(a) a description of the current situation;
(b) a description of the proposed solution;
(c) energy calculations.
B.2.7 Basic technical description of building objects

(a) a description of transport solutions including line and station transport technology of initial and target condition, indicative design of organisational and temporary temporary construction measures to ensure rail transport during construction time, requirements for replacement transport, essential transport parameters of construction achieved (dynamic progress of speed, permeability, line lines, system running times, etc.), connection of the territory to existing transport infrastructure with maintenance of barrier-free access;
(b) barrier-free measures for access and use by persons with reduced mobility or orientation;
(c) transport solutions in terms of automotive, cycling and pedestrian transport;
(d) to the right in peace.

Description and protection of environmental effects of the construction
(a) environmental impact - air, noise, water, waste, soil and rock environment;
(b) impact on nature and landscape - specially protected territories, significant landscape elements, territorial system of ecological stability, landscape character, natural parks, timber, memorable trees, plants and animals, conservation of ecological functions and ties in the landscape, etc., impact on Natura 2000 territory,
(c) a way of taking into account the conditions of a binding opinion on the environmental impact assessment, if any;
(d) a description of the conformity of the project with the notification of the project under the Environmental Impact Assessment Act, if the investigation procedure was completed with the conclusion that the project was not subject to further assessment under the Act;
(e) proposed protection and safety zones, scope of restrictions and conditions of protection under other legislation.
Where the dossier is the basis for a joint authorisation with an environmental impact assessment, the information on points (a), (b), (d) shall not be provided as it is part of the environmental impact documentation.
B.7 Protection of the population
(a) measures resulting from civil protection requirements;
(b) prevention of major accidents.
B.8 Principles of organisation of construction
(a) connection of construction sites to existing transport and technical infrastructure;
(b) access to the building during the construction period and, where appropriate, access routes;
(c) protection of the environment of the construction site and requirements for related rendering, demolition, wood felling;
(d) maximum temporary and permanent records for construction sites;
(e) requirements for barrier-free circumvention routes;
(f) the basic balance sheet of the land works, the requirements for land inputs or soil deponities;
(g) design of the construction process (timetable, timetable, phase, lockouts, etc.),
(h) requirements for the gradual entry into service of the construction (use), requirements for the process and method of preparation and implementation of the construction;
(i) design of tour routes for cars, public transport, cyclists and pedestrians, including passages of pedestrian construction sites in individual construction stages (DIO).

C.1 Situation drawing of broader relations
(a) measure 1: 5 000 to 1: 50 000;
(b) connection of the construction to transport and technical infrastructure;

C.2 Catastral situation drawing
(a) the scale by the cadastral map used;
(b) a sketch of the building plot, the required location of the building,

(a) measure 1: 1 000 or 1: 500, for the change of the building, which is a cultural monument, for the construction of the 1: 200 scale conservation or conservation zone;
(b) existing buildings, transport and technical infrastructure;
(c) land border, parcustoms numbers,
(d) the border of the territory concerned;
(e) existing altimeter and semi-copy,
f) marking of the individual proposed buildings of the construction and of the dismantled buildings and technical infrastructure,
(g) maximum height of buildings;
(h) proposed communication and reinforced areas, connection to the transport infrastructure;
(i) vegetation solutions;
(j) quoted distance from buildings and land borders;
(k) drawing up of new technical infrastructure, connecting the construction to the technical infrastructure;
(l) existing and proposed protection and security zones, conservation sites, conservation zones, etc.,
(m) basic geodetic data;
(n) an indication of the current and new boundary of the track circuit,
C.4 Special drawings
Situational drawings, on an appropriate scale, showing, on the one hand, the special requirements of buildings, technological equipment of technical networks, infrastructure or related engineering measures, including barrier-free measures ensuring accessibility and use by persons with reduced mobility or orientation, as well as the territorial (area) requirements for nature and landscape protection - specially protected areas, their conservation zones and nature conservation zones, Natura 2000, the territorial system of ecological stability, significant landscape elements, natural parks, etc.
C.5 Situation drawing of records
Drawing up of the maximum temporary and permanent seizures and material burdens resulting from the construction, with a distinction between land included in the agricultural land fund, land intended for the performance of forest and other land functions, drawn up on the basis of the cadastral map.
D Documentation of objects
Documentation shall be prepared for each object. The classification and marking of individual objects shall be carried out according to Part A. 2 The structure breakdown into objects and technical and technological equipment.
D.1 Technological Part
Each object is processed:
1. Technical report - design of the solution, description of the current state, proposed solution with justification and design of the type of equipment, main technical parameters including area and spatial requirements for its location and installation.
2. Drawing documentation - drawings and diagrams, design of solutions of individual objects, with drawing of current and proposed state, or intermediate states and their clear graphic resolution.
D.2 Construction part
Each object is processed:
1. Technical report - design of the solution, description of the current state, proposed solution, justification of modifications and description of the use of existing structures, design of technical solutions of individual objects, with data on the main technical parameters, including justification of the proposed solution, description of connection and coordination with other objects within the building, possibly within related or prospective buildings.
2. Drawing documentation - drawing of the current and proposed state or intermediate and their proper and transparent graphic resolution, as appropriate and the nature of the object. Drawings shall be drawn up in detail to determine the location of the construction in the territory. According to their nature, the situation and transverse cuts, possibly longitudinal cuts and ground features are evidenced. In the case of ground buildings, there is evidence of at least characteristic ground features, characteristic cuts including cuts documenting the link to the surrounding area, especially with regard to coordination links and depth of foundation, basic views.
E Document Part
The document part shall contain evidence of compliance with other legislation issued by the competent administrative authorities or by the relevant persons and documentation processed by persons authorised under other legislation.
1. Obligatory opinions, opinions, decisions, opinions of the authorities concerned
2. Documentation of the environmental effects of the project
Where the construction is subject to environmental impact assessment under the Environmental Impact Assessment Act and joint management will be linked to environmental impact assessment, the environmental impact documentation referred to in Section 10 (3) and Annex 4 of the Environmental Impact Assessment Act, including an assessment of the effects on the subject-matter and integrity of the European site or bird area, shall be attached, if this was set out in the conclusion of the detection procedure. In the event that the construction was the subject of a conclusion of the investigation procedure which provided that the project would not be further assessed, the complete notification of the proposed construction project, together with other documents collected during the investigation procedure, including the actual conclusion of the investigation procedure, shall be documented.
3. Evidence under other legislation
Where the documentation is processed for a set of constructions involving a product fulfilling the function of the construction, the document shall be accompanied by another legislation showing compliance of the characteristics of the product with the construction requirements of Section 156 of the Construction Act or the technical documentation of the manufacturer or importer, or any other document from which compliance with the construction requirements can be verified.
4. Opinions of owners of public transport and technical infrastructure
4.1 The views of the owners of the public transport and technical infrastructure on the possibility and method of connection, as indicated, for example, on the situation drawing,
4.2. Opinion of the owner or operator on the conditions for the establishment, execution of works and activities in the protection and safety zones concerned under other legislation,
4.3. Evidence of the approval of the railway operator for exemptions from applicable rules and standards,
4.4 Evidence of the approval of the railway operator using an unapproved and uninstalled equipment.
