DECLARATION
of 21 December 2020
on the scope, form and manner of transmission of information to ensure the comparative instrument
Pursuant to Article 150 (5) of Act No. 127 / 2005 Coll., on Electronic Communications and on the amendment of certain related laws (Act on Electronic Communications), as amended by Act No. 310 / 2006 Coll., Act No. 110 / 2007 Coll., Act No. 261 / 2007 Coll., Act No. 304 / 2007 Coll., Act No. 247 / 2008 Coll., Act No. 153 / 2010 Coll., Act No. 468 / 2011 Coll., Act No. 214 / 2013 Coll., Act No. 258 / 2014 Coll., Act No. 252 / 2017 Coll., and Act No. 311 / 2019 Coll., Implementation § 66a paragraph 5 of the Act on Electronic Communications:
(1) The information to ensure the comparative instrument is transmitted by an entrepreneur providing a publicly available electronic communications service ("the compulsory entity") to the Czech Telecommunications Office ("the Office") on the following types of consumer services:
(a) mobile calls which are understood as voice communication services, text messages and data services in mobile telephone devices charged both by a lump sum and by the use of prepaid cards;
(b) mobile internet which means a mobile data service other than that referred to in (a), charged both on a flat-rate basis and using prepaid cards;
(c) calls at a fixed location, meaning a voice communication service provided through a public fixed telephone network using both geographical and non-geographical numbers;
(d) Internet in a fixed place, which means a data service provided through cable and wireless networks, including mobile networks, where the mobility of the service is restricted;
(e) television, which means television broadcasting services via cable and wireless networks provided for remuneration.
(2) The compulsory body shall also communicate to the Office information on the offer of which at least 1 of the services referred to in paragraph 1 is included in combination with another service, service or other performance (hereinafter referred to as the package).
(3) The detailed scope of the information transmitted pursuant to paragraphs 1 and 2 is set out in the Annex to this Order.
(1) The mandatory entity shall transmit to the Office the information referred to in Section 1 by completing the form available on the server operated by the Office or by uploading the CSV file in the template available on that server.
(2) Access data for access to the server shall be provided by the Authority after registration of the compulsory entity.
(3) The compulsory body shall transmit the information referred to in Article 1 no later than one month after its amendment.
Efficacy
This decree shall take effect on the 15th day following its publication.

6. Packages
Where a service is offered in a package, the mandatory entity shall provide such information to the individual service referred to in points 1 to 5 together with the address of the package offering website.
7. Geographic availability of individual services
7.1. A mandatory body for individual call services at a fixed location, the Internet at a fixed location and television shall indicate their availability at the level of:
(a) an address registered in the Register of Territorial Identification, Addresses and Real Estate; or
(b) the street; or
(c) the territory of the municipality or the city district in the case of the statutory cities and the capital of Prague.
7.2. A service which the compulsory body is able to activate no later than 30 days after the application for a service is made shall be deemed to be available under the preceding paragraph.
In the case referred to in point (b), the condition referred to in the first sentence shall be met for 75% of the street address points.
In the case referred to in point (c), the condition referred to in the first sentence shall be met for 75% of the address points of the territory of the municipality or of the city or district in the case of the statutory cities and the capital of Prague.
