GOVERNMENT REGULATION
of 18 February 2019
amending Government Regulation No 74 / 2015 Coll., on the conditions for granting subsidies on animal welfare measures, as amended
The Government orders pursuant to § 2c (5) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 85 / 2004 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll., and pursuant to § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act No. 179 / 2014 Coll. as amended by Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll.:
Government Regulation No. 74 / 2015 Coll., on the conditions for granting subsidies for animal welfare measures, as amended by Government Regulation No. 113 / 2015 Coll., Government Regulation No. 62 / 2016 Coll., Government Regulation No. 17 / 2017 Coll., Government Regulation No. 49 / 2017 Coll. and Government Regulation No. 34 / 2018 Coll., are amended as follows:
1. in Paragraph 2 (2) (f), "1 June" is replaced by "1 March" and "31 May" is replaced by "the last day of February."
2. In Section 6 (1) of the Introductory Part of the Provisions and in Section 8 (1) of the Introductory Part of the Provisions, the words "the entire duration of the commitment 'are replaced by the words" the entire retention period'.
3. Paragraph 6 (2) reads as follows:
"(2) The retention period shall be the period for determining livestock unit 8) of the livestock subject to the subsidy, which shall last from 1 June of the relevant calendar year for which the subsidy is to be granted until the last day of February of the following calendar year. ';
4. In Article 6, the following paragraph 6 is inserted after paragraph 5:
"(6) A dry-cut cow shall be considered eligible as a dairy cow for the purposes of the sub-measure referred to in Article 2 (1) (c) and shall have unrestricted access to the range on that holding for a period of at least 30 days at all times in accordance with Article 11 (1) (a). '
Paragraph 6 shall become paragraph 7.
5. Paragraph 8 (2) reads as follows:
"(2) The report shall be returned by the applicant no later than the 20th day of the following month after the month for which the report is sent, except in February when the report is submitted no later than 10 March. ';
6. In Article 11 (4), "Article 6 (3), (4) or (5) 'is replaced by" Article 6 (3) to (6)';
7. In Article 11 (4), the words "until 30 November of the relevant calendar year for which the subsidy is to be granted 'are replaced by the words" until the last day of February of the following calendar year after the year for which the subsidy is to be granted'.
8. In Article 12 (1) (c), "commitment periods' is replaced by" retention periods';
9. In Paragraph 12 (3), the words "the entire commitment period 'are replaced by the words" the entire retention period'.
10. in Article 16 (1) (c), "EUR 63" is replaced by "EUR 42";
11. in Article 16 (1) (d), "EUR 107" is replaced by "EUR 147";
12. In Article 17 (9) of the Introductory Part of the provision, the words "for the said holding 'are inserted after the word" sub-measure'.
Transitional provisions
1. The procedure for applications for grants initiated in 2018 under Government Regulation No 74 / 2015 Coll., as effective before the date of entry into force of this Regulation, shall be completed pursuant to Government Regulation No 74 / 2015 Coll., as effective before the date of entry into force of this Regulation.
2. The subsidy for 2018 in the context of the sub-measure to ensure access to the dry cow range shall be granted by the State Agricultural and Intervention Fund for the total number of livestock units determined by reference to the number of eligible dairy cows pursuant to § 6 (3) to (6) of the Government Regulation No 74 / 2015 Coll., as effective from the date of entry into force of this Regulation, registered in the central register from 1 June to 30 November 2018 on the holding referred to in the application for a subsidy complying with the conditions laid down in Government Regulation No 74 / 2015 Coll., as effective before the date of entry into force of this Regulation, and having ceased pregnancy during the period from 1 July to 30 November 2018.
Efficacy
This Regulation shall enter into force on 1 March 2019.
