Federal Ministry of Labour and Social Affairs
of 24 June 1987
laying down further details on the sickness insurance of cooperative peasants and jobseekers
The Federal Ministry of Labour and Social Affairs, in agreement with the Federal Ministry of Agriculture and Nutrition, with the Ministries of Labour and Social Affairs of the Republic and with the Central Council of the Unions, provides, pursuant to Section 144 of Act No. 103 / 1964 Coll., on the security of cooperative peasants in sickness and on the security of the mother and child, as amended by Act No. 116 / 1967 Coll., on certain other changes in the social security of cooperative peasants, Act No. 121 / 1975 Coll., on social security, and pursuant to Section 32 (4) of Act No. 88 / 1968 Coll., on the extension of maternity leave, on maternity benefits and on allowances for children from sickness insurance:
Decree of the State Social Security Office No. 104 / 1964 Coll., implementing the Act on the Protection of Cooperative Farmers in Diseases and on the Security of Mother and Child, as amended by Decree No. 142 / 1965 Coll., No. 117 / 1967 Coll., No. 92 / 1968 Coll., No. 180 / 1968 Coll., No. 76 / 1970 Coll., No. 128 / 1975 Coll., No. 54 / 1976 Coll., No. 164 / 1979 Coll., No. 80 / 1982 Coll., No. 153 / 1983 Coll., No. 74 / 1984 Coll., and No. 133 / 1984 Coll., are amended and added as follows:
1. Paragraph 1 (4) (c) reads as follows:
"(c) the period during which a man is granted financial assistance (Section 27a of the Act) or a contribution under the Maternity Act,"
Points (c) to (k) shall be renumbered as points (d) to (l).
2. in Article 1 (5), "(a), (b), (f) and (k) 'is replaced by" (a) to (c), (g) and (l)';
3. Article 2 (5) (b) reads as follows:
"(b) for reentry after leaving public office for at least one year, basic (replacement) military services, additional maternity leave, provision of cash assistance (§ 27a of the Act) or allowance under the Law on the maternity allowance to a man and the execution of a custodial sentence,"
4. In Article 3 (1), the words "the working days for which the cooperative has been granted monetary assistance (Section 27a of the Act) or the allowance under the Maternity Contributions Act," shall be inserted after the words "further maternity leave (Section 27 of the Act)."
5. In Paragraph 22 (2), the words "and, where applicable, the period during which a member of the cooperative was granted financial assistance (Section 27a of the Act) or the allowance provided for in the Maternity Contributions Act are added at the end. '.
The following Section 5a is inserted after Section 5 of Decree No. 182 / 1968 of the Ministry of Labour and Social Affairs, on maternity benefits and on child allowances for applicants for employment, as amended by Decree No. 132 / 1984 Coll.:
The previous provisions shall apply mutatis mutandis to the award, amount and provision of cash assistance to the jobseeker. ';
Efficacy
This Decree shall take effect on 1 July 1987.
