DECLARATION
Ministry of Forestry and Water Management
of 26 April 1968
amending and supplementing Decree No. 17 / 1961 Coll.
The Ministry of Forestry and Water Management provides in agreement with the participating central authorities pursuant to § 55 (1) of Act No. 166 / 1960 Coll., on Forests and Forestry (Forest Act) and § 64 (1) (c) of Decree No. 100 / 1966 Coll., on the Planning Management of the National Economy, as amended by Government Regulations No. 83 / 1967 Coll. and No. 16 / 1968 Coll.:
Decree of the Ministry of Agriculture, Forestry and Water Management No 17 / 1961 Coll., which issues implementing regulations for the Forest Act, is amended as follows:
Article 13 (2) and (3) shall read as follows:
"(2) From 1 January 1968, annual contributions shall be charged as follows:
(a) single agricultural cooperatives and other socialist organisations, except state organisations, from one hectare of forest land managed by the Kčs 40, -
(b) private forest users with an area above 0,50 ha - from one hectare of forest land Kčs 80, -
(c) private forest users with a total area of between 0,10 ha and 0,50 ha of forest land Kčs 40, -
(d) private forest users with a total area up to 0,10 ha of forest land Kčs 25, -.
(3) For the purposes of the assessment of the contributions referred to in paragraph 2 (a), the area of forest land per hectare and per hectare per hectare per hectare per hectare per hectare and per paragraph 2 (b) shall be considered as a whole hectare; at a higher level, the area shall be rounded down to 0,50 ha and the area above 0,50 ha upwards. ';
2. Article 13 (4) and (5) shall be deleted;
3. The text of Article 22 shall become paragraph 1 and the following three paragraphs shall be added:
"(2) The authorities of the State Care of Forests will impose on the enterprises of the State Forests for violating certain principles of good forest management additional gross income payments to the State budget
(a) for exceeding the quantity of specified material regulation of intentional exploitation of tolls in the field or part (Section 27 of the Act), for non-compliance with the method and procedure for rebuilding the forest [Sections 27 and 37 (1) (a) of the Act], for assigning an additional bare mower to an unsecured culture [Section 37 (1) (b) of the Act], for reducing the linkage of the crop by less than 0,7 interventions over the whole area, without thereby pursuing the benefit of a secured crop-related claim corresponding to an unsecured objective [Section 37 (1) (c) of the Act] of 50 Kčs for each full metre of wood obtained by mining, provided that one of the above methods of extraction is extracted more than 50 plm;
(b) for failure to comply with the obligation to start afforestation and to achieve the provision of cultures at the prescribed time (Section 38 (2) of the Act) of 500 Kčs for each one tenth of a hectare of such holin (culture), where the non-compliance concerns more than 0,2 ha;
(c) for non-compliance with the obligations in the education of crops (Section 39 of the Act) of 300 Cds per hectare of such crops, where the non-compliance concerns the area of such crops exceeding 3 hectares;
(d) for non-compliance with forest protection obligations (paragraphs 43 to 48 of the Act), of a level set from 3000 CZK up to 50% of the amount of damage caused by the forestry sector or of the costs of preventive measures necessary to prevent damage. However, the additional levy may only be imposed if the damage caused or the cost of preventive measures exceeds 3000 CZK.
(3) The additional levy may be imposed only for those infringements of the principles of good forest management which have taken place following the effectiveness of this decree. The additional levy cannot be imposed if five years have elapsed since the infringement.
(4) The additional levy will be implemented *) within 30 days of its deposit. '
This decree shall take effect on the day of its publication.
