THE LAW
of 17 June 1965
regulating the penalties for wrongdoing and misdemeanour of persons committing disorderly conduct, violence and corruption
The National Assembly of the Czechoslovak Socialist Republic decided on this law:
Guilty pursuant to § 19 (a) and (c) and § 21 (b) of Act No. 38 / 1961 Coll., (pursuant to § 38 (a) and (c) and § 40 (b) of Act No. 60 / 1961 Coll.) and the offence pursuant to § 19 of Act No. 60 / 1961 Coll. person,
(a) which, in the last year prior to his commission, has been affected for any of the offences or offences referred to therein or, in the last three years, for any of the offences of a similar nature, has been convicted or released; and
(b) where an overall assessment of the way in which she has lived so far shows that it cannot be expected to be rectified by a local court or national committee;
discuss the district court.
(1) The district court shall impose a prison sentence of up to one year for the offence or offence (§ 1).
(2) The sentence is imposed and enforced in accordance with the provisions of the criminal law and the law on the execution of the prison sentence.
(1) The offence or offence (§ 1) shall be dealt with by the District Court on a proposal from the Prosecutor; the application must be accompanied by the particulars of the prosecution.
(2) Proposals for the hearing of an offence or offence pursuant to Article 1 shall be made to the prosecutor.
If the prosecutor finds no reason to prosecute a crime or offence before a district court, he shall refer the matter to the local court or national committee; This position of the prosecutor is bound by the local People's Court or the National Committee.
In cases dealt with under this law, the provisions of the Code of Criminal Procedure shall apply mutatis mutandis to proceedings before and in enforcement proceedings.
In proceedings before the District Court, the offence or offence of the nature referred to in Paragraph 1 may be dealt with, together with the criminal offence of the same defendant.
This Act shall take effect on 1 August 1965.
