DECLARATION
of 9 November 2004
amending Decree No. 177 / 1995 of the Ministry of Transport Coll., which publishes the construction and technical rules of the runways, as amended
The Ministry of Transport provides for the implementation of Sections 3 (1), 5 (3), 6 (1), 7 (2) and 20 (4) of the Act in accordance with § 66 (1) and (4) of the Act.
Decree No. 177 / 1995 Coll., which issues the construction and technical rules of the runways, as amended by Decree No. 243 / 1996 Coll., Decree No. 346 / 2000 Coll. and Decree No. 413 / 2001 Coll., is amended as follows:
1. in Paragraph 1 (a):
"(a) by the railway bottom of the ground body, the structure and equipment of the railway bottom and the publicly accessible transport areas in the circumference of the track, ';
2. in Paragraph 1 (e):
"(e) the platform safety belt part of the platform area at the boarding edge separated from the other platform surface by a contrasting colour guide line with the warning belt function and tactile-susceptible e.g. by a blind stick and a stopover,"
3. in Article 2 (2) (a), the words "the recommended technical standards listed in Annex 5" shall be replaced by the words "the technical standards listed in Annex 5 under headings 157, 159, 166 and 176."
4. footnote 1 shall read:
"1) Decree No. 30 / 2001 Coll., implementing the rules on road traffic and the adaptation and management of road traffic, as amended by Decree No. 153 / 2003 Coll. and Decree No. 176 / 2004 Coll. '.
5. In Paragraph 4, the last sentence of paragraph 3 is deleted.
6. in Paragraph 4, the following paragraphs 5 and 6 are inserted after paragraph 4:
"(5) The crossings used only during a certain period of the year in the manner specified in the contract between the railway operator and the infrastructure owner may be secured by a lockable barrier in addition to the marking.
(6) At the crossing point of the track with a pedestrian road secured by a light crossing safety device, the light signalling is supplemented by a remotely controlled audible signal for the blind. The implementation of the barrier March must ensure the independent and safe movement of persons with reduced mobility and orientation (2). ';
Paragraph 5 shall become paragraph 7.
7. In Paragraph 4 (7), the words "recommended 'are deleted and the words" under heading 165' are added after the words "Annex 5 '.
8. in Article 5 (2) (b), the words "and evaluation" shall be inserted after the word "implementation."
9. In Article 5, at the end of paragraph 2, the dot is replaced by a comma and the following point (d) is added:
"(d) demonstration of transitionality."
10. in § 6 (a) (2):
"2. verification of the geometric position of the track by a measuring vehicle for the geometrical parameters of the track or by a test run of a traction vehicle in both directions at a speed not exceeding the track speed or by a test run for measuring safely relevant values in terms of vehicle relations and the track road equipped with a traction vehicle or unit in both directions of running at a test speed, increased by 10 per cent, provided that the cant deficiency in curves does not exceed the limit values specified in the technical standard set out in Annex 5, item 160 by more than 10 per cent, and no further limitation is necessary with respect to the operation of the signalling equipment; when driving, the functional interaction between the movement of the train and the safety device shall be verified, ';
11. in Article 6, at the end of (c), the comma shall be replaced by a dot and the sentence "Technical safety test shall be carried out as part of or immediately after the technical examination."
12. in Article 6 (d), the word "force" shall be replaced by the word "heavy current" and, at the end of point (d), the comma shall be replaced by a dot and the sentence "Technical safety test shall be carried out within or immediately after the technical examination and test," shall be added.
13. in Article 6 (e), the third sentence is deleted; in the fourth sentence, the word "recommended" is deleted and after the words "Annex No 5" the words "under entry 149" are added.
14. in Article 6, at the end of point (e), the dot is replaced by a comma and the following point (f) is added:
"(f) in the case of tunnels, by showing the spatial passageway through a detailed photographic focus and by carrying out an inspection (main inspections).";
15. in Article 7 (2) (b):
"(b) its duration according to the nature of the construction,"
16. in Article 9, at the end of point (i), the dot is replaced by a comma and the following point (j) is added:
"(j) land within the track perimeter, excluding land within the depot and rolling stock workshops, access communication for passengers and for the transport of goods, including publicly accessible transport areas."
17. in Article 11 (1), the words' contains the recommended technical standard set out in Annex 5 'are replaced by' contain the technical standards set out in Annex 5 under headings 142, 155, 157 and 175 ';

21. Paragraph 12 (1) reads:
"(1) The lines of the national, regional and railway tracks shall be classified in line load classes. The track load classes are defined by the maximum parameters of the model groove vehicle: axle load, axle mass per unit length and axle arrangement of the chassis. The values for determining line classes are contained in Annex 6. ';
22. In the fourth sentence of Article 13 (8), the words "and unwinding 'shall be inserted after the word" standing' and in the last sentence the word "recommended 'shall be deleted.
23. In Paragraph 13 (13), the word "recommended 'is deleted and the words" under heading 159 for design and under heading 160 for construction, acceptance, operation and maintenance' are added after the words "Annex 5 '.
24. in Paragraph 14 (2), (3) and (4), the last sentence shall be deleted;
25. in Paragraph 14 (5), the words "recommended" shall be deleted and the words "under heading 173" shall be added after the words "Annex 5";
26. In Article 15 (5), the words "contains the recommended technical standard set out in Annex 5 'are replaced by the words" contain the technical standards set out in Annex 5 under headings 107 to 136 and 141 to 158'.
27. The heading of Section 16 reads: "Arrangements of transport areas."
28. In Article 16 (1), the second sentence is replaced by the following: "The platforms and at least one access path to them must be accessible barrier-free and also applicable to persons with reduced mobility and orientation2). The new and reconstructed island and external platforms shall be provided with a safety-belt and a guide line with a warning belt function. ';
29. Footnote 2 reads:
"2) Decree No. 369 / 2001 Coll., laying down general technical requirements for the use of buildings by persons with reduced mobility."
30. In Article 16 (3), the words "and reconstructed 'are inserted after the words" established', in the last sentence, the words "recommended 'are deleted and the words" under heading 139' are added after the words "Annex No 5 '.
31. in Article 16 (4), the words "public transport areas for unloading and loading" shall be inserted after the words "railway station."
32. in Article 16 (5), the words' contains the recommended technical standard set out in Annex 5 'are replaced by' contain the technical standards set out in Annex 5 under headings 137, 139, 155, 156, 158 and 173 ';
33.Paragraph 17 (1) reads as follows:
"(1) The crossing must comply with the safe operation of railway transport by its implementation and must ensure the safety of road users, including persons with reduced mobility and orientation (2); In particular, according to the project documentation, the marking and safety of the level crossing, the visual conditions, drainage and railing must be ensured. On new and reconstructed crossings, where the track crosses the pedestrian road, the boundaries of dangerous space and the direction of crossing are marked for the blind and weak-sighted. The requirements for such adaptations shall include the technical standard set out in Annex 5 under heading 165. ';
34. In Article 17 (2), the word "space 'is replaced by" crossing roads'; in the last sentence, the word "recommended 'is deleted and the words" under heading 165' are added after the words "Annex No 5 '.
35. in the first sentence of Paragraph 17 (4): "The shape of the railway superstructure at the crossing shall be the same as in the adjacent track." and in the second sentence the word "crossing" shall be replaced by the words "crossing structure."
36. In Article 18 (3), the words "recommended 'are deleted and the words" under heading 108' are added after the words "Annex 5 '.
37. in Paragraph 18 (8), the word "force" is replaced by "heavy current."
38. In Paragraph 18 (9), the word "recommended 'is deleted and the words" under heading 159 for design and under heading 160 for construction, acceptance, operation and maintenance' are added after the words "Annex 5 '.
39. in Paragraph 18 (10), the last sentence shall be deleted;
40. Paragraph 20 (3) and (4) reads as follows:
"(3) Border signs (milestones) are placed at refraction points at the boundary of the perimeter of the land which forms the railway transport route. In direct sections of the perimeter of the land, the milestones may be within 200 m.
(4) The stations with odd figures of kilometer shall be situated in the track body on the left in the direction of the line station; the stations with even figures shall be located on the right. The stands can also be fixed as panes on supporting structures, for multi-track electrified lines usually both sides. '
41. in Paragraph 21 (4), the word "recommended" shall be deleted and the words "under entry 167" shall be added after the word "Annex 5."
42. Paragraph 22 (5), including footnote 2a, reads as follows:
"(5) The principles of the establishment and operation of electrical groove installations include the technical standards set out in Annex 5 under headings 1, 3 to 5, 15 to 39, 43, 45 to 73, 89, 90, 93 to 104 and other related harmonised or designated standards 2a).

43. In Article 23 (1) (b) (2) and (3):
"2. up to a speed of 100 km.h-1 the safety device shall not permit the movement of trains or the movement of a warning or the transfer of information on the authorisation of a driving to a leading railway vehicle if such a journey would be jeopardised by any other train, shift or shift between the transport stations the movement of which has been made possible during the operation of the signalling device or by the transfer of information on the authorisation of a driving to a leading railway vehicle; a train running permit may be issued for normal operation by a safety device only in the correct position of the switches and switches on and off, and any device made by the conclusion of the train running elements shall not allow the device to be operated without:

3. at a speed exceeding 100 km.h-1 the safety device shall not allow the movement of trains, the movement and the movement between the signalling and / or the transmission of information on the authorisation of the driving to the leading railway vehicle, if such a journey would be jeopardised by any other train, movement or movement between the transport stations whose journey was made possible during the operation of the signalling or transmission of information on the authorisation of the driving to the leading railway vehicle; a permit to drive a railway vehicle may be issued by a safety device for normal operation only in the correct position of the switches and crossings and on the freedom of the train or shift path. 44. in Article 23 (1) (d):
"(d) transmit to the leading railway vehicle information on orders prohibiting, authorising, or limiting the journey, if the route speed is more than 100 km.h-1 or regardless of the speed, if it is a line without variable signals or a line included in the European rail system,";
45. in the last sentence of Paragraph 23 (1), the words' contains the recommended technical standard set out in Annex 5 'are replaced by' contain the technical standards set out in Annex 5 under headings 1, 15 to 31, 33 to 38, 43, 47 to 57, 73 to 92, 95 to 98, 102 to 104 and 177 ';

50. In Paragraph 25 (2), the words "recommended 'are deleted and the words" under heading 160' are added after the words "Annex No 5 '.
51. In Paragraph 25, the following paragraphs 11 and 12 are inserted after paragraph 10:
"(11) In order to ensure the safe operation of the runway, the loading capacity of the building elements of bridges shall be higher than that of the rolling stock operated. The load on the building elements shall be determined by a static recalculation which shall take into account the state and degree of degradation of the material of the elements used. Compliance with these conditions shall be indicated in the vehicle transition assessment.
(12) The operational technical condition of railway crossings and crossings shall ensure the safe operation of the runway and the safe operation of the infrastructure; In particular, according to the project documentation, the marking and safety of the level crossing, the visual conditions, drainage and clearance of the crossing road shall be ensured. ';
Paragraphs 11 and 12 shall become paragraphs 13 and 14 and paragraphs 13 and 14 shall become paragraphs 16 and 17 respectively.
52. 53. 54. In Paragraph 25, the following paragraph 15 is inserted after paragraph 14:
"(15) The operational technical condition of buildings and networks of technical equipment shall ensure their design characteristics and parameters, shall not jeopardise the safety of the operation of the runway and railway transport, and shall, in regular operation, restrict the continuity of the railway transport. ';

74. In § 41 the title reads: "Technical parameters of electrical power current equipment."

82. In Paragraph 48 (5) (b), the words "first swastika or coupling bars" are replaced by the words "first conclusion."

86. In Paragraph 87 (13), the following sentence is added at the end of footnote 5a: "The methods and accuracy of geodetic works in the construction, assembly and control of geodetic parameters of the cableway are contained in the technical standards set out in Annex 5 under headings 119 to 121. A comparison of the test parameters shall be made with the data found in the previous geodetic control and the data found in the first geodetic control. For the first geodetic check, the data found are compared with the data according to the project. The technical report on geodetic control shall include:
(a) data on all parameters tested and their evaluation;
(b) determination of the capability or incompetence of the cableway for public operation based on the evaluation of the tested parameters;
(c) verification of the result of geodetic work5a).
