Czech National Council
of 18 December 1990
on measures in the system of central government bodies of the Czech Republic
The Czech National Council decided on this law:
(1) The following central government bodies of the Czech Republic are hereby repealed:
(a) Ministry of Construction and Construction,
(b) Ministry of Engineering and Electrical Engineering.
(2) The existing scope resulting from the laws and other generally binding legislation is
(a) from the Ministry of Construction and Construction
1. on investment development to the Ministry of Economic Policy and Development,
2. on other matters to the Ministry of Industry,
(b) from the Ministry of Engineering and Electrical Engineering
1. in respect of mining, treatment and treatment of ores and magnesite to the Ministry of Economic Policy and Development;
2. on other matters to the Ministry of Industry,
(c) from the Ministry of Labour and Social Affairs
1. in social education matters to the Ministry of Education, Youth and Sports,
2. in matters of social welfare for disabled citizens at the Ministry of Health,
(d) from the Ministry of Health in medical production to the Ministry of Industry,
(e) from the Ministry of the Interior
1. in the case of raw materials collected at the Ministry of Industry,
2. in the case of citizens' private business at the Ministry of Trade and Tourism,
(f) from the Ministry of the Environment
1. in matters of geological research for the Ministry of Economic Policy and Development,
2. on forestry plans for the Ministry of Agriculture.
(3) Where generally binding legislation entrusts the federal central administration with jurisdiction in matters of:
(a) post office, energy, heating, gas, solid fuel extraction and treatment, oil and gas extraction and extraction, treatment and refining of radioactive raw materials, to the extent applicable to the Czech Republic, shall be exercised by the Ministry of Economic Policy and Development;
(b) metallurgy, state services for precious metals, collection of metal waste from legal persons and management of metal waste, is carried out by the Ministry of Industry to the extent applicable to the Czech Republic,
(c) motorways, maritime transport, river navigation and civil aviation are carried out by the Ministry of Economic Policy and Development to the extent applicable to the Czech Republic;
(d) foreign trade and tourism, to the extent applicable to the Czech Republic, is carried out by the Ministry of Trade and Tourism.
(4) The rights and obligations arising from employment and other relationships shall be transferred in the context of the transition referred to in paragraph 2:
(a) from the Ministry of Construction and Construction to the Ministry of Economic Policy and Development and the Ministry of Industry,
(b) from the Ministry of Engineering and Electrical Engineering to the Ministry of Economic Policy and Development and the Ministry of Industry;
(c) from the Ministry of Labour and Social Affairs to the Ministry of Education, Youth and Sports and the Ministry of Health,
(d) the Ministry of Health to the Ministry of Industry,
(e) from the Ministry of the Interior to the Ministry of Industry and the Ministry of Trade and Tourism,
(f) from the Ministry of the Environment to the Ministry of Economic Policy and Development and the Ministry of Agriculture.
(5) The transition of rights and obligations referred to in paragraph 4 shall be concluded by the Ministries for Economic Policy and Development, Industry, Health, Labour and Social Affairs, Education, Youth and Sports, Home Affairs, Trade and Tourism, the Environment and Agriculture of the relevant agreements, specifying among themselves these rights and obligations. The ministries shall conclude the de-limitation protocols on transfers of appropriations.
The Act of the Czech National Council No. 2 / 1969 Coll., on the establishment of ministries and other central authorities of the Czech National Administration of the Czech Socialist Republic, as amended by the Act of the Czech National Council No. 34 / 1970 Coll., the Act of the Czech National Council No. 60 / 1988 Coll., the Act of the Czech National Council No. 173 / 1989 Coll., the statutory measure of the Bureau of the Czech National Council No. 9 / 1990 Coll., the Act of the Czech National Council No. 126 / 1990 Coll., the Act of the Czech National Council No. 203 / 1990 Coll., and the statutory measure of the Bureau of the Czech National Council No. 305 / 1990 Coll., are amended and supplemented as follows:
1. In Section 1, points 4 and 12 are deleted.
Article 2 (1) reads as follows:
"(1) In the Czech Republic, these other central government bodies of the Czech Republic operate
1. Czech Statistical Office,
2. Czech Office of Geodetic and Cartographic,
3. Czech Mining Office,
4. Czech Labour Safety Authority,
5. Czech Science Commission. '.

(1) The Ministry of Economic Policy and Development is the central body of the government for the creation of economic, structural, scientific, technical, information and regional and standard of living policies, including housing policy.
(2) Furthermore, the Ministry of Economic Policy and Development is the central body of the government for investment development, energy, heating, gas, oil and gas extraction, mining, treatment and refining of solid fuels, ores, radioactive raw materials and magnesite, for the creation of a single raw material policy, for the exploitation of mineral resources and for geological exploration.
(3) The Ministry of Economic Policy and Development is also the central body of the State Administration for Foreign Economic Policy Development, including Foreign Investment and Foreign Assistance to the extent that this competence is entrusted to the Czech Republic.
(4) Furthermore, the Ministry of Economic Policy and Development is the central body of the State Administration for Road and Urban Transport, Special Destination Railways, Infrastructure including Motorways, Road Economy, Maritime Transport, River Navigation and Civil Aviation.
(5) The Ministry of Economic Policy and Development is also the central body of the State Administration for Post.
(6) The Ministry of Economic Policy and Development is subordinate to the Czech Energy Inspection. '
4. In Section 4, the words "the State Final Account of the Republic, the Treasury of the Czech Republic, the Financial Market 'are inserted after the words" the budget of the Republic' and the words "foreign exchange matters' are inserted after the words" financial management '.
5. § 6 is deleted.
6. Paragraph 7 of paragraph 2 and the designation of paragraph 1 are deleted.
7. In Article 9 (1), the words "retraining of workers' are replaced by the words" retraining, collective bargaining '; the words "social education' are deleted; the words" with the exception of health care for disabled citizens' shall be inserted after the words "disabled citizens'; and in conclusion, the words" on disabled citizens' shall be deleted; and
8. Paragraph 9 repeals paragraph 2 and the designation of paragraph 1.
9. In Article 10 (1), the words "health care for disabled citizens' shall be inserted after the words" health care ', and the words "for medical production' shall be deleted.
10. In Paragraph 11 (1), the word "state 'shall be deleted from the word" notaries'.
11. the words "the Czech Republic" shall be inserted after the words "State symbols."
12. In Article 12 (3), the words "private entrepreneurship of citizens' and the words" for transport, including automotive repair, under the responsibility of national committees and the road economy 'are deleted.
13. in Paragraph 12 (4), the words "except for activities falling within the competence of the Federal Ministry of Interior" shall be deleted.
14. Paragraph 13 is renumbered as paragraph 1, the words "for metallurgy, engineering, electrical engineering and electronics' shall be inserted after the words" for metallurgy, electrical engineering and electronics', and the words "with the exception of stoneware, prefabricated products and building machinery 'shall be replaced by the words" building production, medical production, raw materials and metal waste'.
15. Article 13 shall be added to the following paragraph 2:
"(2) The Ministry of Industry shall organise and manage the State Service for Precious Metals."
16. Paragraph 14 is deleted.
Article 17 (1) reads as follows:
"(1) The Ministry of Trade and Tourism is the central body of the government for citizens' private business and for internal and foreign trade and tourism."
18. In Article 19 (2), the words "the area of geological research and exploration, for 'are replaced by the words" the area of geological research, for the protection of mineral wealth,';
19. In Section 23, the words "to prepare draft plans for the development of the Republic's economy," are deleted.
20. In the second sentence of Paragraph 25, the word "exclusive 'is deleted.
21. Paragraph 27 repeals the provisions of paragraph 1 and the designation of paragraph 2.
22.
(1) The activities of ministries are managed, controlled and unified by the Government of the Czech Republic.
(2) The tasks associated with professional, organisational and technical security of the activities of the Government of the Czech Republic and its institutions are carried out by the Office of the Government of the Czech Republic.
(3) The activities of the Office of the Government of the Czech Republic are managed by the Head of the Office of the Government of the Czech Republic, appointed and withdrawn by the Government of the Czech Republic. "
The Bureau of the Czech National Council is hereby authorised to publish in the Collection of Laws the full text of the Act of the Czech National Council No. 2 / 1969 Coll., on the establishment of ministries and other central bodies of the state administration of the Czech Socialist Republic, as follows from later regulations.
This Act shall take effect on 1 January 1991.
