DECLARATION

of 4 November 2004

declaring the National Nature Reserve Certová Wall - Luč and laying down its close protection conditions and amending Decree No. 395 / 1992 Coll., implementing certain provisions of Act No. 114 / 1992 Coll., on Nature and Landscape Protection, as amended

According to § 79 (3) (b) of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended by Act No. 218 / 2004 Coll., (hereinafter referred to as "the Act"), the Ministry of the Environment provides for the implementation of § 28 (1) of the Act:

ČÁST PRVNÍ

§ 1

Subject matter

(1) The National Nature Reserve Certova Wall - Luč (hereinafter referred to as the "National Nature Reserve") is hereby declared.

(2) The object of protection is the preserved remnant of the natural forest land left behind by spontaneous development, which is made up of relict acidophilic spruce and birch trees, relict lichen and moss communities of ungrounded rubble, fragments of nature close to the rubble and subslope of mixed forest and acidified silkworms. The object of protection is also rock formations and stone seas as representative examples of periglational landscaping, including part of the natural riverbed of the Vltava river.

§ 2

Definition of the national nature reserve

(1) The national nature reserve is situated in the South Bohemia region in the cadastral territories of Loučovice and Vysobní Brod. The national nature reserve boundaries are determined by closed geometric patterns with direct sides whose vertices are determined by the coordinates given in the current S-JTSK1 coordinate system). The list of coordinates of the vertices of geometric patterns, as they follow, is given in Annex 1 to this decree. An indicative graphical representation of the territory of the national nature reserve is given in Annex 2 to this decree.

(2) The map materials in which the national nature reserve is drawn are stored in the central list of nature conservation (Section 42 of the Act).

§ 3

Closer protection conditions for the national nature reserve

Only with the prior consent of the competent authority of nature conservation [§ 44 (2) and § 79 (3) (g) of the Act] can the national nature reserve

(a) make a change to the type or manner of land used2);

(b) to intervene in or directly adjacent to the watercourses;

(d) to establish landfills, including temporary landfills, of wood or other materials;

(e) carry out geological work4) linked to the earth's surface;

(f) establish hunting or fishing facilities.

Repeal

§ 4

They shall be deleted:

1. Decree of the Ministry of Education and National Instruction No. 8.865 / 35 on the establishment of the State Nature Reserve "Luč" of 8 February 1935.

2. Proceeds of the Ministry of Culture No. 4.875 / 56A / 6 on the establishment of the State Nature Reserve "Certova Wall" of 10 May 1956.

In Annex V to Decree No. 395 / 1992 Coll., implementing certain provisions of Act No. 114 / 1992 Coll., on Nature and Landscape Protection, as amended by Decree No. 105 / 1997 Coll., Decree No. 200 / 1999 Coll., Decree No. 85 / 2000 Coll., Decree No. 190 / 2000 Coll., Decree No. 116 / 2004 Coll. and Decree No. 381 / 2004 Coll., the words "Black Wall - Luke CK Loučovice, MK No. 4.875 / 56 (10 May 1956) and Decree No. 8.865 / 35 (8 February 1935) shall be deleted."

Efficacy

This Decree shall take effect on 1 December 2004.
