THE LAW
of 20 December 1990
on the Federal State Budget for 1991
The Federal Assembly of the Czech and Slovak Federal Republic decided on this law:
STATE BUDGET OF FEDERATION FOR 1991
(1) The total revenue of the Federation State Budget is fixed at 108 500 000 000 Kčs, the total expenditure of the Federation State Budget is fixed at 102 300 000 000 Kčs. The surplus of the Federation's state budget amounts to 6,200,000 thousand Kcs.
(2) The general statement of revenue and expenditure of the Federation State Budget is set out in Annex 1.
(3) The breakdown of the determined budgetary expenditure into each chapter of the Federation State Budget is set out in Annex 2.
(4) The total expenditure of the Federation State Budget includes:
(a) spending on government loans 2 639 400 000 Kns;
(b) the funds for the federal structural change programmes in the economy of 3 000 000 000 Kcs;
(c) the funds to cover the public's public compensation for food price adjustments of 27 000 000 000 Kcs;
(d) the means to compensate for energy prices of 6 100 000 000 CZK;
e) Budget Reserve of the Government of the Czech and Slovak Federal Republic 500 000 000 Kcs;
(f) the Federal Assembly's special-purpose reserve of 50 000 000 Kcs for the financial security of the establishment and operation of the General Inspector of the Armed Forces, the Parliamentary Institute and the reimbursement of a Member's contribution to the Council of Europe;
(g) the special-purpose reserve for unforeseen economic development of CZK 4,200,000 000;
h) the disposal fund of the President of the Czech and Slovak Federal Republic of the amount of 1000 thousand Kčs, the President of the Federal Assembly of 1000 thousand Kčs and the Prime Minister of the Czech and Slovak Federal Republic of 2680 thousand Kčs.
The Government of the Czech and Slovak Federal Republic or, under its authority, the Minister of Finance may adjust the indicators of the Federation's state budget as listed in Annex 2 to this Act only in accordance with the government's organisational, methodological and pricing measures or when releasing funds from the federal budget reserves. These measures must not impair the resulting balance of revenue and expenditure of the Federation State Budget.
AMENDMENT OF LAW No 156 / 1989 Coll., ON REVENUE TO THE STATE BUDGET, LAW No 157 / 1989 Coll., ON PENSION TAX, AS AMENDED BY LAW No 108 / 1990 Coll. And Act No. 172 / 1988 Coll., AGRICULTURAL TAXATION, as amended by Act No. 157 / 1989 Coll.
Act No. 156 / 1989 Coll., on contributions to the State Budget, is amended as follows:
1.
Rate of profit contribution
The rate of profit payment is 55% of the profit base and the liquidation surplus (Section 7). '
2. In Article 13, the words "and the regulatory levies referred to in Article 10 (1) (a) and (b) 'are deleted.
Act No. 157 / 1989 Coll., on Pension Tax, as amended by Act No. 108 / 1990 Coll., is amended as follows:
1. in Article 5 (1) (a), "65%" is replaced by "55%";
2. In the introductory sentence of Article 26 (2), the words "Article 2 (1) (e), (h) and (i) 'are replaced by the words" Article 2 (1) (h) and (i)'.
Act No. 172 / 1988 Coll., on Agricultural Tax, as amended by Act No. 157 / 1989 Coll., is amended as follows:
1.
'( a) agricultural cooperatives and joint ventures 10) with mainly agricultural production, the detailed definitions of which are laid down in the implementing act; ';
2. Note 10:
"10) Act No. 162 / 1990 Coll., on Agricultural Cooperatives. § 106zd of the Economic Code. '
3. In Section 14, "65% 'is replaced by" 55%';
ADJUSTMENT OF FINANCIAL MANAGEMENT
Banks and savings banks established as a state monetary institution1) proceed in their financial management mutatis mutandis according to Part One of the Government of the Czech and Slovak Federal Republic Decree No. 577 / 1990 Coll., on the financial management of state enterprises, with the abolition of the statutory fund, risk fund and development fund; the statutory fund shall be transferred to a joint venture.
The state organizations of the Czechoslovak State Railways (2) proceed in their financial management mutatis mutandis according to Part One of the Government of the Czech and Slovak Federal Republic No 577 / 1990 Coll., on the financial management of state enterprises, with the abolition of the Development Fund and the Risk Fund; continue to create a permanent fund.
Insurance companies, if they are not equity companies, 3) or an undertaking with foreign shareholding, 4) proceed in their financial management mutatis mutandis according to Part One of the Government of the Czech and Slovak Federal Republic No 577 / 1990 Coll., on the financial management of state enterprises, with the continued creation of a basic reserve fund, insurance reserve fund, damage guarantee fund and foreign exchange reserve fund.
(1) The Federal Ministry of Defence will issue a generally binding legislation governing the financing of civil defence preparations in the Czech and Slovak Federal Republic.
(2) The financing of economic mobilization preparations in the Czech and Slovak Federal Republic is provided by the Federal Ministry of Economy. The Federal Ministry of Economic Affairs will issue a generally binding legislation to regulate the financing of economic mobilization preparations in the Czech and Slovak Federal Republic.
The decree of the Government of the Czechoslovak Socialist Republic No. 112 / 1987 Coll., on the additional levy for losses caused by non-bone production is hereby repealed. This is without prejudice to the obligation to implement this levy for 1990.
EFFECTIVE
This Act shall take effect on 1 January 1991.
