DECLARATION
of 4 November 2004
declaring the National Natural Monument of Hejná Water and laying down its close protection conditions and amending Decree No. 395 / 1992 Coll., implementing certain provisions of Act No. 114 / 1992 Coll., on the Conservation of Nature and Landscape, as amended
The Ministry of the Environment provides pursuant to § 79 (3) (b) with regard to § 35 (1) of Act No. 114 / 1992 Coll., on the Protection of Nature and Landscape, as amended by Act No. 218 / 2004 Coll., ("the Act '):
Subject matter
(1) The National Natural Monument of Hojná Water ("National Natural Monument") is announced.
(2) The object of protection is the preserved remnant of the original forest-forest forest, left behind by spontaneous development, which is an example of mountain mixed edible beets typical of the Novohradské hory region and the communities of assembly forest springs.
Definition of national natural heritage
(1) The national natural monument is situated in the cadastral area of Stará Huta near Upper Stropnice. The border of the national natural monument is determined by a closed geometric pattern with direct sides whose vertices are determined by coordinates given in the S-JTSK1 coordinate system). The list of coordinates of the individual vertices of the geometric pattern as they follow in the pattern is given in Annex 1 to this decree. An indicative graphical representation of the territory of the national natural monument is given in Annex 2 to this decree.
(2) The map materials in which the territory of the national natural heritage is drawn are stored in the central list of nature conservation (Section 42 of the Act).
Closer protection conditions for national natural heritage
Only with the prior consent of the competent authority of nature conservation [§ 44 (2) and § 79 (3) (g) of the Act] can the national natural monument
(a) make changes to the type or manner of land use (2);
(b) to adjust the road surface (3) using non-local natural material;
(c) to mark cycling routes and hiking trails,
(d) to drive vehicles into the territory of the national natural heritage; consent is not required for vehicles of public authorities, the police of the Czech Republic, rescue services, state defence and veterinary services, vehicles necessary for the care of forest land or crops and vehicles of owners or tenants of land located in the territory of the national natural monument; the approval is no longer required for cycling on motorcycling routes marked on the ground;
(e) to establish landfills of wood and other materials, including temporarily;
(f) carry out geological work4) linked to the earth's surface;
(g) to feed animals;
h) to establish hunting facilities;
(i) camp;
j) start fires.
Amendment to Decree No. 395 / 1992 Coll., implementing certain provisions of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation
In Decree No. 395 / 1992 Coll., implementing certain provisions of Act No. 114 / 1992 Coll., on Nature and Landscape Protection, as amended by Decree No. 105 / 1997 Coll., Decree No. 200 / 1999 Coll., Decree No. 85 / 2000 Coll., Decree No. 190 / 2000 Coll., Decree No. 116 / 2004 Coll. and Decree No. 381 / 2004 Coll., in Annex No. V, in the list of national natural monuments, the words "Healthy water CB Stará Huta Decision Owner in 1838 'are deleted.
Efficacy
This Decree shall take effect on 1 December 2004.
