DECLARATION
of 14 December 2006
amending Decree No. 415 / 2003 Coll., laying down the conditions for ensuring safety and health at work and safety of operations in vertical transport and walking
The Czech Mining Authority provides pursuant to § 5 (3), § 6 (6) (a) and § 8 (4) of Act No. 61 / 1988 Coll., on Mining Activities, Explosives and State Mining Administration, as amended by Act No. 542 / 1991 Coll. and Act No. 124 / 2000 Coll.:
Decree No. 415 / 2003 Coll., laying down the conditions for ensuring safety and health at work and safety of operations in vertical transport and walking, is amended as follows:
1. In Article 1, the sentence "This Order was notified in accordance with Directive 98 / 34 / EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and of rules on information society services, as amended by Directive 98 / 48 / EC, shall be added at the end of paragraph 1. ';
2. In Section 2 (s), the words "and intentionally made change in the safety circuit 'are replaced by the words" replacement of the original braking device by a braking device of another type or a change in the safety circuit which results in an increase in current or voltage loss at the contact points'.
3. The following Section 2a is inserted after Section 2, including the title and footnote 6a:
Selected mine equipment
The mining equipment is selected by the mining equipment 6a).
6a) § 8 (4) of Act No. 61 / 1988 Coll. '
4. Paragraph 4 (2), including footnotes 9 and 9a, reads as follows:
"(2) The mining plant and the pit shall be assessed by a panel of experts representing the mining, machinery and electrical professions before being put into test and continuous operation. The Commission shall be designated at the bottom of the water mine, in other cases by the head of the organisation (hereinafter referred to as the" racing mine '). If a concrete mining tower is part of the mining plant, the mining mine will also be designated by the committee member 8) from the construction industry. The Commission's work shall also be attended by the staff referred to in § 6 (2) to (5), or other staff designated by the race mine. For the purposes of this decree, only a graduate of a master's study programme in the relevant field who has been entrusted with supervision under § 6 (3), (4) or (5) for a period of at least 5 years and has passed a proficiency test before the authorities of the State Mining Administration under the special legislature9) shall be regarded as an expert in the mining, engineering or electrical profession. An expert in the field of mining, engineering or electrical engineering is also considered to be an expert.
9) Sections 5 and 8 of Decree No. 298 / 2005 Coll., on requirements for professional qualifications and competence in mining or mining activities and amending certain legislation, as amended by Decree No. 240 / 2006 Coll.

5. Paragraph 4 (4) reads as follows:
"(4) Following the introduction of the pit or its relevant part and the extractive equipment into permanent operation, the racing mine may allow proper ride on the heavy equipment. ';
6. Paragraph 4 (6) reads as follows:
"(6) Modifications of the non-substantial change of production equipment may be carried out with the agreement of the technician responsible for supervision (§ 6 (3), (4) and (5)). '
7. The following Section 4a is inserted after Section 4, including the title and footnote 10a:
Continuous operation of the extractive equipment
(1) The introduction of a new type of production facility or a material change on which has been made into use, i.e. permanent operation, is authorised by the Czech Mining Authority (10a). By making a substantial change to the heavy equipment, the original type of heavy equipment is transformed into a new type.
(2) Prior to the authorisation of permanent operation of the extractive equipment, the information on the extractive equipment referred to in Article 4 (7) shall be assessed, the evaluation of the test operation of the extractive equipment and the expert opinion.

8. In Article 6, at the end of paragraph 2, the words "of which at least one year in office as referred to in paragraph 3, 4 or 5 'shall be added.
9. In Article 6 (6), the words "2 to 5 'are replaced by the words" 3 to 5' and the words "before the commission of the District Mining Office 'are replaced by the words" professional competence before the authorities of the State Mining Administration under the special legislation9'.
10. in Paragraph 6 (7), the words "2 to 5" are replaced by the words "3 to 5" and the words "before the commission of the District Mining Office." shall be replaced by the words "professional competence before the authorities of the State Mining Administration under the special legislature9."
11. in Article 7 (3) (b), the words "mechanical or electrical" shall be inserted after the words "field."
12. in Article 7 (3) (d), including footnote 14a:
"(d) verification of professional competence before the authorities of the State Mining Administration in accordance with special legislation14a).

13. in the sentence of Article 7 (5), the first words "The professional competence of the driver shall be re-verified" shall be replaced by the words "The professional knowledge of the driver shall be verified" and in the sentence of the second words "The verification of competence shall be replaced by the words" The verification of expertise shall be carried out. "
14. in Article 7 (5) (d):
"(d) within 3 years of the last examination,"
15. in Article 8 (3) (a), the word "field" is replaced by "mining transport."
16. In Section 10, the sentence "The organisation shall keep the mining equipment and pit in good and safe condition and make adjustments to achieve the most effective and advanced degree of safety of operations' is inserted at the beginning of paragraph 1.
17. In Paragraph 10 (10), the second sentence is replaced by "At the same time, it shall ensure that the handling space between the stop and the pit is empty."
18. In Paragraph 22, at the end of paragraph 6, the sentences "The most adverse position is determined by the project. If the project is not defined, it shall be determined by expert (9a). ';
19. Paragraph 22 (7) reads:
"(7) The driving and safety brakes of the drum-load machine when fully engaged in driving with a load corresponding to the load on proper driving shall cause the average delay recorded in the time period from the start of the speed reduction to the stop of at least 1,8 m.s-2, and shall not exceed 5 m.s.2 in the time period from 1,0 s to the start of braking until the speed falls to the level of the crossing speed. '
20. in Article 23 (2) (n), the words "or, where appropriate, at the initiative of a rope slide control device for a friction disc heavy machinery" shall be deleted;
21. in Paragraph 29, the following paragraph 10 is added:
"(10) If the heavy equipment operated in automatic mode reaches the slip of the rope, a new run in automatic mode shall not start until the cause of the slip has been removed. '
22. in Paragraph 33 (2) (c):
"(c) the documentation referred to in Article 5 (2) (k),"
23. in Paragraph 58 (6):
"(6) The corrosion loss of the wall thickness of metal elements of the pit equipment shall be checked in dry pits or dry sections of pits once every four years, in other cases once every two years. Corrosive loss is obtained by measuring on characteristic elements, such as guide, disconnect, cross, ladder, arm, grill and console. At the same time, the attachment status of the individual elements and their attachments is also checked. The controlled metal element shall be replaced if its thickness is less than the strength calculation specified in the project or expert report. ';
24. in Paragraph 63 (1) (a), the words "characteristics of brake delays when the brake is applied" shall be replaced by "characteristics of brakes, even when the brake is applied," and in the part of the sentence behind the semicolon the word "delay" shall be deleted.
25. In Paragraph 63, the following paragraph 5 is added:
"(5) Where it is technically demonstrated that the verification of the correct operation of the production equipment or part thereof or the verification of the required test results results from another test on the same production plant, the relevant test may be omitted. ';
26. in Paragraph 64 (7):
"(7) The non-destructive control of ropes and its evaluation shall be carried out according to technical standards EN 473, EN ISO 17 025 and EN 12927-8. '
27. in Paragraph 70 (4), "Paragraph 66 (1) (e)" is replaced by "Paragraph 66 (4)";
28. In Paragraph 70, the sentence "The conclusions of the review report of a mining plant older than 30 years must be confirmed by expert experts 9a) by the engineering and electrical professions."
29. in Annex 5 (A) (ad 6), the words "so that their upper edge is approximately 20 cm below the lower edge of the transport vessel" shall be deleted;
30. in Annex 5 (A) (ad 7), the words "so that their upper edge is approximately 20 cm below the lower edge of the transport vessel" shall be deleted;
31. in Annex 5 (C) (ad 2), the symbol "log" is replaced by "ln."
This Decree shall take effect on 1 January 2007.
