GOVERNMENT REGULATION
of 4 February 2019
amending Government Regulation No 76 / 2015 Coll., on the conditions for implementing organic farming measures, as amended, and Government Regulation No 44 / 2018 Coll., on the conditions for granting payments to temporarily supported areas with natural constraints
The Government orders pursuant to § 2c (5) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 85 / 2004 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll., and pursuant to § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act No. 179 / 2014 Coll. as amended by Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll.:
Amendment of the Government Regulation on the conditions for implementing organic farming measures
Government Regulation No. 76 / 2015 Coll., on the conditions for the implementation of organic farming measures, as amended by Government Regulation No. 113 / 2015 Coll., Government Regulation No. 64 / 2016 Coll., Government Regulation No. 236 / 2016 Coll., Government Regulation No. 18 / 2017 Coll., Government Regulation No. 49 / 2017 Coll., Government Regulation No. 29 / 2018 Coll. and Government Regulation No. 43 / 2018 Coll., are amended as follows:
1. In Article 4, the following paragraph 7 is added:
"(7) An increase in the area included in the fifth year of the commitment shall not be considered to be an increase in the area covered by the measure under Paragraph 2 (6). '
2. In Article 6 (2) (b), at the end of point 3, the word "or 'is deleted.
3. In Article 6 (2), at the end of point (b), the dot is replaced by "or 'and the following point 5 is added:
"5. Where the part of the soil block is kept in the organic land use register for 31 December of the relevant calendar year from the date of receipt of the application for the subsidy and where the part of the soil block held in the land use register was at least 50% of its area under the organic production scheme for at least one calendar day in the period of the last 3 years before 15 May of the relevant calendar year in which the application for the subsidy is submitted."
4. In Article 11, the following paragraph 6 is added:
"(6) The end of the pasture referred to in paragraph 1 (b) shall not take place if the pasture is interrupted for a maximum of 29 days. ';
5. In Paragraph 13, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) The end of the pasture referred to in paragraph 1 (b) shall not take place if the pasture is interrupted for a maximum of 29 days. ';
6. in Article 15 (2), point (a) shall be deleted;
Points (b) to (l) shall be renumbered (a) to (k).
7. in Article 15 (2) (k), the words "(k)" shall be replaced by the words "(j)" and the words "(l)" shall be replaced by the words "that point."
8. In Article 15, the following paragraph 6 is added:
"(6) For the purposes of paragraph 2, point (b) shall apply. (j) point (2) may be used by the applicant to use a weather station equipped with a technology to determine an effective sum of temperatures and thresholds for monitoring the occurrence of harmful organisms; in the event that the harmful organism threshold is reached, the applicant shall proceed in accordance with paragraph 2 (j) (2). ';
9. In Paragraph 21 (3), the text "(h) 'is replaced by" (g)'.
10. in Article 22 (5) and Article 25 (9), the text "Article 13 (a)" is replaced by "Article 13 (1) (a)."
11. in Paragraph 22 (7), "(g)" is replaced by "(f)";
12. in Article 23 (6), the text "Article 13 (b)" is replaced by "Article 13 (1) (b)."
13. in Paragraph 23 (9), "(d), (f), (k) or (l)" shall be replaced by "(c), (e), (j) or (k)" and "(k) or (l)" shall be replaced by "(j) or (k)";
14. in Article 24 (7), "(e) or (i)" shall be replaced by "(d) or (h)";
15. in Article 25 (11), "(j)" is replaced by "(i)";
16. in Paragraph 25 (15) (a), "(b) or (c)" shall be replaced by "(a) or (b)";
Transitional provision
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
Amendment of the Government Regulation on the conditions for granting payments to temporarily supported areas with natural constraints
In Section 4 of the Government Regulation No 44 / 2018 Coll., on the conditions for granting payments to temporarily supported areas with natural constraints, the words "or to which payment has been granted under this Regulation 'shall be added at the end of the text of paragraph 4.
EFFECTIVE
This Regulation shall enter into force on 1 March 2019.
