DECLARATION
of 12 February 2010
amending Decree No. 64 / 2005 Coll., on the registration of accidents at children, pupils and students
The Ministry of Education, Youth and Sports provides, pursuant to § 29 (3) of Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (Education Act):
Decree No. 64 / 2005 Coll., on the registration of accidents at children, pupils and students, is amended as follows:
1. In Paragraph 1 (1), the word "school 'shall be inserted after the word" 2'.
2. in Article 2 (1) (a), the words "affecting at least two consecutive teaching days" shall be inserted after the words "school establishments."
3. In Paragraph 2 (4), the words "does not cause a pupil to be absent from a school or school establishment 'are replaced by the words" is not referred to in paragraph 1'.
4. In Article 2, the following paragraph 6 is added:
"(6) School or school establishment updates the accident record without undue delay
(a) where compensation has been granted for pain or compensation for the inconvenience of social application caused by the accident; or
(b) in the case of a fatal accident, where the death occurred after an accident alert has been made. ";
5. In Article 3 (4), the words "Labour Safety Inspectorate 'are replaced by" Regional Labour Inspectorate'.
6. in Article 4 (1), point (a) shall be deleted;
Points (b) and (c) shall become points (a) and (b).
7. in Articles 4 (1) (b) and 4 (2) (c), the words "the competent inspector of the Czech School Inspection Office" shall be replaced by "the Czech School Inspection Office."
8. In Section 4 (2) of the Introductory Part of the provision, the words "or updating the entry referred to in Section 2 (6) (b) 'shall be inserted after the words" Section 3'.
9. In Article 4, paragraphs 3 to 5 are added:
"(3) School and school establishments shall also send records of the accident and its updating to the founder on the basis of his written request.
(4) Paragraphs 1 and 2 shall not apply where the alert on an accident is updated pursuant to Article 2 (6) (a). On 30 September, the school or school establishment shall inform the Czech school inspection on updates of the accident records referred to in § 2 (6) (a) in the previous school year. The second sentence shall contain the serial number and the school year of each accident alert updated during the previous school year and an indication of the reason for the update.
(5) A record of the accident and of the updates of the accident records referred to in paragraph 4 shall be sent to the Czech School Inspection Office in an electronic form. '
10. the Annex shall read as follows:
"Attachment to Decree No. 64 / 2005 Coll.
"
According to Article 4 (5) of Decree No. 64 / 2005 Coll., as effective from the date of the entry into force of the Order, the procedure shall be followed from 1 May 2010.
This Decree shall take effect on 1 April 2010, with the exception of Article I (7), which shall take effect on 1 May 2010.
