Federal Ministry of Labour and Social Affairs
of 24 June 1987
on further amendments to Decree No. 128 / 1975 Coll., implementing the Social Security Act
The Federal Ministry of Labour and Social Affairs, in agreement with the participating central authorities and the Central Council of Trade Unions, provides, pursuant to § 172 paragraphs 1 and 4 of Act No. 121 / 1975 Coll., on Social Security, as amended by Act No. 150 / 1979 Coll., the legal measure of the Bureau of the Federal Assembly No. 7 / 1982 Coll., Act No. 116 / 1983 Coll. and Act No. 56 / 1984 Coll.:
Decree No. 128 / 1975 Coll., implementing the Social Security Act, as amended by Regulations No. 108 / 1979 Coll., No. 164 / 1979 Coll., No. 15 / 1982 Coll., No. 78 / 1982 Coll., No. 141 / 1983 Coll., No. 144 / 1983 Coll., No. 73 / 1984 Coll., and No. 131 / 1984 Coll., is amended as follows:
1. the following point (i) shall be added to Article 3 (3):
"(i) after which the male was granted the allowance under the Maternity Allowance Act."
2. the following point (e) shall be added to Article 15 (1):
"(e) the period during which the allowance was granted to a man under the maternity allowance law."
3. in Article 28 (2) (a), "950 Kčs" is replaced by "1000 Kčs" and "1600 Kčs" by "1700 Kčs."
4. the following paragraph 3 shall be added to Article 80:
"(3) The previous paragraphs shall apply mutatis mutandis to the award, amount and provision of financial assistance by the artist. ';
5. the word "or" shall be added at the end of Paragraph 97 (2) (e).
(6) Paragraph 97 (2) shall be added to point (f) as follows:
"(f) If men are involved, it is also because he has taken care of the child for whom he was responsible (Section 97e (3)) or the allowance under the maternity allowance law."
7. In Paragraph 97 (3), "(b) to (e) 'is replaced by" (b) to (f)';
8. In Paragraph 97d (2), "in § 97 (2) (b) to (e) 'is replaced by" in § 97 (2) (b) to (f)';
9. in § 97d (3), "in § 97 (2) (b) to (e)" is replaced by "in § 97 (2) (b) to (f)";
10. in Article 97e (1), "the fourth week" is replaced by "the sixth week."
11. § 97e is added to paragraph 3:
"(3) The previous paragraphs shall apply mutatis mutandis to the grant, amount and provision of financial assistance to the man providing services on the basis of the authorisation of the national committee. ';
12. In Paragraph 97h (2), the following sentence is inserted after the first sentence: "A man who looks after a child for whom he is entitled to cash assistance (Section 97e (3)) or a contribution under the Maternity Act shall also have a similar notification obligation and has therefore suspended the exercise of the authorised activity."
13. In Paragraph 115, "950 Kčs' is replaced by" 1000 Kčs' and "1600 Kčs'.
Transitional provision
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union. I No 13 without a request from the pension repayment due after the effective date of this decree. Pensions that have not yet been adjusted as a single source of income and do not reach the above mentioned amount shall be adjusted on request at the earliest from the payment of the pension due after the effective date of this decree.
Efficacy
This Decree shall take effect on 1 July 1987, with the exception of Article I (3) and (13), which shall take effect on 1 October 1987.
