DECLARATION
of 17 December 2020
amending Decree No. 238 / 2011 Coll., laying down the hygiene requirements for swimming pools, saunas and sanitation limits of sand in outdoor playing areas, as amended
The Ministry of Health provides pursuant to § 108 (1) of Act No. 258 / 2000 Coll., on the Protection of Public Health and on the Amendment of Certain Related Acts, as amended by Act No. 151 / 2011 Coll., Act No. 223 / 2013 Coll. and Act No. 205 / 2020 Coll., for the implementation of § 6a (6) and § 82a (5):
Decree No. 238 / 2011 Coll., laying down hygiene requirements for swimming pools, saunas and sanitation limits of sand in sandboxes of outdoor playing areas, as amended by Decree No. 97 / 2014 Coll. and Decree No. 1 / 2016 Coll., is amended as follows:
1. the following Section 7a is inserted after Section 7, including the title:
Rules for monitoring multi-cell organisms
Bathing waters for which a high risk of multi-cellular organisms can be expected to occur during the bathing season pursuant to Section 10a (1) shall be monitored in accordance with Part B of Annex 5a to this Regulation. ';
2. In Article 8, at the end of paragraph 1, the dot is replaced by a comma and the following point (e) is added:
"(e) in the case of bathing waters for which monitoring is carried out in accordance with Section 7a, a check shall be carried out at least once before the bathing season and subsequently once more at intervals of 3 to 5 weeks if they are assessed in degrees 2 or 3 in accordance with Part A of Annex 5a thereto."
3. The following Section 10a is inserted after Section 10:
Assessment of multi-cell organisms
(1) Each year prior to the establishment of a monitoring calendar, the public health authority will assess, in accordance with Part A of Annex 5a, the bathing water decree, whether there is a high risk of multi-cell organisms causing grade 2 or 3 cervical dermatitis agents.
(2) If cyclic dermatitis occurs in bathing persons during the current bathing season, the monitoring referred to in Part B of Annex 5a to this Decree shall be carried out. In the case where stage 1, 2 or 3 cervical dermatitis agents have been found in accordance with Part C of Annex 5a to this Decree, further sampling shall be carried out at intervals of 3 to 5 weeks. ';
4. the following Annex 5a is inserted after Annex 5:

| 2 | vysoké (potenciální) | Do stupňů 1 nebo 2 je zařazena stojatá nebo pomalu tekoucí voda, u níž je splněna alespoň jedna ze 3 následujících podmínek: - předchozí zkušenost s cerkáriovou dermatitidou • ve vodě nebo v mezihostitelských plžích byli nalezeni původci cerkáriové dermatitidy, avšak nejednalo se o nález z loňské koupací sezóny, nebo • u koupajících se osob byla prokázána cerkáriová dermatitida, jejíž původ lze jednoznačně spojit s posuzovanou vodou ke koupání, avšak nejednalo se o nález z probíhající nebo loňské koupací sezóny, - v bezprostřední blízkosti vody byla prokázána přítomnost konečných hostitelů – vodních ptáků, zejména hnízdících, vyvádějících mláďata nebo zastavujících se k odpočinku během sezónního tahu, - ve vodě se nachází velké množství mezihostitelských plžů, u kterých bylo prokázáno uvolňování původců cerkáriové dermatitidy, nebo má lokalita vhodné podmínky pro jejich výskyt; za vhodné podmínky lze považovat alespoň některé z těchto faktorů • voda s vysokou průhledností trvale nebo alespoň po velkou část sezóny, • mělká nádrž nebo nádrž s mělkými příbřežními oblastmi, • hojný výskyt vyšších vodních rostlin či makroskopických vláknitých řas či nárostů mikroskopických řas a sinic, • hojný výskyt míst tvořených množstvím nezapojených kamenů, nebo spadaných tlejících větví ponořených v příbřežních mělčinách, • první dvě sezóny následující po vypuštění nádrže. O zařazení do stupně 2 rozhodne příslušný orgán ochrany veřejného zdraví na základě odborného zvážení uvedených kritérií. Měly by být splněny alespoň 2 ze 3 uvedených podmínek. Mohou se však vyskytnout případy, kdy k zařazení do stupně 2 postačí jen jedna z uvedených podmínek, pokud je překročení v té jedné podmínce tak rozsáhlé, masivní nebo pro danou oblast neobvyklé, že je z hygienického hlediska rizikové. |

For the purposes of this decree, inter-host gastropods shall mean gastropods which may be the source of the germination into the aquatic environment of the gastropods of the families Lymnaeidae (in particular the Radix and Lymnaea families), Planorbidae (in particular the Gyraulus family) or Physidae.
Monitoring rules for the occurrence of cervical dermatitis agents
The collection of gastropods shall be carried out in the immediate vicinity of the monitoring point and at the places of their expected increased incidence, in particular on unconnected stones, fallen fading branches submerged in offshore shallows, submerged aquatic plants. During the laboratory examination, the gastropods shall be illuminated by visible light in order to release from the positive individuals the gastropods which, after being observed in the light microscope, are assigned to the steel furcocercaries which may cause cercanium dermatitis, or other, morphologically distinct human types of cercanides. The finding of the agents of cercerium dermatitis is confirmed if microscopically found steel furcocercia or molecular biological methods are detected by representatives of Trichobilharzia, Bilharziella and Anserobillozzi families. The result shall be information on the total number and species (s) of gastropods found and separately on the number and species (s) of gastropods which release the steel furcocercaries.

For the purposes of this decree, several individuals (3 or more large), such as Lymnaea, Radix or Planorbarius, or several small gastropods (5 or more), such as Gyraulus, shall be regarded as a large number of gastropods releasing the agent of cercanium dermatitis. '
5. In Annex 6, the following paragraph shall be added at the end of the category "WATER FOR COUPLING ':
"- It is a site with a low or moderate risk of cervical dermatitis as referred to in Part A of Annex 5a to this Decree, or the water has been assessed at a level 0 in accordance with Part C of Annex 5a to this Regulation and it is not known that cases of cercanium dermatitis would occur after bathing in that water."
6. In Annex 6, the following paragraph is added at the end of the category "FULL QUALITY OF WATER ':
"- In the last sampling according to Part B of Annex 5a to this Decree, the median severity of the finding of the agents of cercerium dermatitis according to Part C of Annex 5a to this Decree has been established."
7. In Annex 6, the following paragraph shall be added at the end of the category "WATER UNSUFFICIENT TO COUPLING ':
"- In the last sampling provided for in Annex B (5a) to the present Decree, the high severity of the finding of the agents of the cervical dermatitis referred to in Part C of Annex 5a thereto has been established."
8. In Annex 6, the following paragraph shall be added at the end of the category "WATER UNSAVABLE TO COUPLING:
"- In the last sampling according to Part B of Annex 5a to this Decree, the very high severity of the finding of the agents of cervical dermatitis according to Part C of Annex 5a to this Decree has been established."
9. In Annex 6, in the table in the category "bathing ban ', the words" the presence of agents of cervical dermatitis' shall be inserted after the words "infectious disease '.
Efficacy
This Decision shall enter into force on 1 January 2021.
