Government regulations on pay ratios of professional soldiers

GOVERNMENT REGULATION
of 6 December 2006
on pay ratios of professional soldiers
The Government hereby orders pursuant to § 23 (1) (b) to (e) of Act No. 143 / 1992 Coll., on the salary and remuneration of the on-call time in the budget and in certain other organisations and bodies, as amended by Act No. 40 / 1994 Coll., Act No. 217 / 2000 Coll., Act No. 563 / 2004 Coll. and Act No. 626 / 2004 Coll., (hereinafter "the Act '):
§ 1
Preliminary provisions
This Regulation shall apply to soldiers from a profession (1) (hereinafter referred to as "soldier ') and shall provide for:
(a) the qualification assumptions in accordance with the characteristics of the grades, including the way in which they are classified, the scale of the scales and the way in which they are determined;
(b) management fees;
(c) the conditions for the granting and the amount of the special premium and the conditions for the granting of the personal premium and its maximum amount;
(d) the conditions for granting remuneration.
§ 2
Qualification assumptions
(1) The qualifications required for the performance of the work assigned to each grade are:
1. grade: basic education or basic education
2. grade: basic education or basic education
3rd grade: secondary education
4. grade: middle education with a certificate or middle education
5th grade: middle education with a certificate
6th grade: secondary education with a graduate examination or secondary education with a certificate
7th grade: secondary education with graduation exam
8th grade: secondary education with graduation exam
9th grade: higher vocational education or secondary education with graduation exam
10th grade: university education in the Bachelor's study programme or higher vocational education
11th grade: higher education in Master's degree programme or higher education in Bachelor's degree programme
12th grade: higher education in Master's degree programme or higher education in Bachelor's degree programme
13th grade: higher education in Master's degree programme
14th grade: higher education in Master's degree programme
15th grade: higher education in the Master's study programme
16th grade: higher education in the Master's degree programme.
(2) The qualification conditions established pursuant to paragraph 1 do not replace those laid down in a separate legislative act for the performance of the same work).
§ 3
Classification of a soldier as a grade
(1) The employer shall include a soldier in the grade, pursuant to Article 4 (1) of the Act, in which the most demanding work, the performance of which is required by the employer on the soldier, is included in the regulations of the government setting out the catalogue of the work and qualification assumptions (3) (hereinafter referred to as the "work catalogue"). If this work is not included in the catalogue of works, the employer shall include a soldier in the grade in which work is included in the catalogue of works comparable to it in terms of complexity, psychological and physical complexity.
(2) The employer shall place the soldier in the grade provided that he fulfils the qualification requirements for the performance of the grade.
(3) An employer may, exceptionally, include a soldier in a grade for which he does not meet the qualification requirements if:
(a) carry out predominantly manual work;
(b) the long-term activity in the relevant field has demonstrated its ability to perform the required work and is over 50 years of age;
(c) perform the tasks of the intelligence service;
(d) performing artistic, artistic, technical or artistic teaching work;
(e) is an active athlete or coach;
(f) specific legislation requires less education for the performance of certain work than required training under Paragraph 2 (1), or provides for a different qualification assumption;
Unless otherwise provided for in specific legislation4.
(4) If an employer cannot fill a service post by a soldier who fulfils the qualification requirements and is not subject to the conditions for the exceptional classification of a soldier referred to in paragraph 3, the employer may exceptionally include a soldier in a grade for which he does not meet the qualification requirements for a maximum period of four years.
Classification of a soldier as a grade
§ 4
(1) The employer shall place the soldier in the grade of the relevant grade, depending on the calculation of the period applicable to that classification (hereinafter referred to as "deductible practice") in accordance with paragraphs 2 to 6 and § 5 (1) and (2).
(2) To the full extent, the employer will count the hours of experience in the field of required work to the soldier in the deductible practice. For the purposes of this Regulation, the labour force shall be that for which knowledge of the same or similar focus is required as that of the work required.
(3) Within a maximum of two thirds, the employer shall count the duration of another practice to the soldier in the deductible practice, depending on the extent of its usability to perform the required work.
(4) To the full extent, but not more than, to the extent provided for in the special legislation for the exercise of a military essential (replacement) service (5) or a civil service (6) in force at the time of its execution, the employer shall account for the soldier for the period of the military essential (replacement) service (s) or for the period of the civil service to be counted.
(5) To the full extent, but not more than 6 years in total, the employer should count the time of the soldier's allowance.
(a) the actual taking of maternity leave, other maternity leave or parental leave or permanent childcare, up to a maximum corresponding to the length of maternity leave and other maternity leave or parental leave valid at the time of such care under the special legislature7);
(b) personal care of a person dependent on the care of another person, if he or she is a minor of a minor).
(6) The periods referred to in paragraphs 4 and 5 shall be taken into account by the employer in the deductible practice, unless the soldier was simultaneously preparing for the occupation in day9) or in the presentation study10).
§ 5
(1) From the time of deductible practice which the employer has credited to the soldier pursuant to § 4 (2) to (6), the employer shall deduct from the soldier assigned to
(a) sixth to eighth grade, which has only reached
1. secondary education with a certificate, period of 1 year,
2. secondary education, 2 years, or
3. basic education or basic education, 4 years,
(b) ninth grade which has only reached
1. secondary education with graduation, 2 years,
2. secondary education with a certificate, period of 3 years,
3. secondary education, 4 years, or
4. basic education or basic education, 6 years,
(c) 10th grade, which has only reached
1. higher vocational education, period of 1 year,
2nd secondary education with graduation, period of 3 years,
3rd secondary education with a certificate, period of 4 years,
4. secondary education, 5 years, or
5. basic education or basic education, 7 years,
(d) the eleventh to sixteenth grade, which was achieved only by:
1. university education in the Bachelor's study programme, 2 years,
2. higher vocational education, period of 3 years,
3rd Middle Education with Graduate Exam, 5 Years,
4. secondary education with a certificate, 6 years,
5. secondary education, 7 years, or
6th primary education or basic education, period of 9 years.
(2) A soldier who has not obtained deductible experience or has obtained deductible experience less than the period to be deducted by the employer pursuant to paragraph 1 shall be extended by the period which could not be deducted from him by the period set out in Annexes 1 to 6 to this Regulation for a step to a higher grade.
(3) A soldier who has achieved a higher education during the course of his service than he has been given last time to qualify for a grade, shall be credited by his employer to the period of such specified period of deductible experience, corresponding to the training achieved, which has been deducted from him pursuant to paragraph 1.
(4) The higher grade wage fare belongs to the soldier from the first day of the calendar month in which he reached the period of deductible practice laid down for that grade in Annexes 1 to 6 to this Regulation.
Salary fare
§ 6
(1) The soldier shall be entitled to the fee rate for the grade and grade to which he is included, as set out in Annex 1 to this Regulation, in which the scale of the rates by grade and grade is determined, unless otherwise specified.
(2) A soldier who is not referred to in paragraphs 4 and 6, who is assigned to a health service provider not referred to in paragraph 3, shall be entitled to a salary fare determined in accordance with the scale of the rates set out in Annex 2 to this Regulation.
(3) A soldier who is a health worker 10a) providing health services to a health service provider who is not a contributory organisation or at the centre of an air rescue service shall be entitled to a salary fare for the grade and grade to which he is classified, according to the scale of the rates set out in Annex 3 to this Regulation, unless otherwise specified in paragraph 5.
(4) A soldier who is a health worker 10a) providing health services to a health service provider which is a contributory organisation shall be entitled to the salary tariff for the grade and grade to which he is assigned, according to the scale of the salary tariffs set out in Annex 4 to this Regulation, unless otherwise specified in paragraph 6.
(5) A soldier who is a doctor or a dental practitioner (22) providing medical services to a health care provider who is not a contributory organisation or at the centre of an air rescue service shall be entitled to a salary fare determined on the basis of the scale of the rates set out in Annex 5 to this Regulation.
(6) A soldier who is a doctor or a dental practitioner (22) providing medical services to a health care provider who is a contributory organisation shall be entitled to a salary fare determined on the basis of the scale of the rates set out in Annex 6 to this Regulation.
Special method of determining the salary tariff for certain soldiers
§ 7
(1) The employer may determine the salary tariff within the range of the salary tariffs set for the lowest to highest grade of the relevant grade of the soldier in the
(a) first to fifth grades; or
(b) the sixth and higher levels of pay which perform artistic, artistic, artistic, teaching and teaching activities, the work of an executive flyer, the activity of an athlete and coach, or carry out intelligence tasks, or are seconded to a unit of multinational forces outside the Czech Republic;
where the range of soldiers concerned by this method of determining the salary tariff and the rules for determining the salary tariff within the range of the lowest to the highest grade of the relevant grade are laid down in an internal regulation.
(2) An employer who is a medical institution and provides health care covered by public health insurance (11) may, with the prior consent of the founder, establish in the internal regulation the method of determining the wage rate for fifth and higher grade soldiers within the range of the wage rates set for the lowest to highest grade in the relevant grade.
Personal surcharge
§ 8
(1) A soldier who has achieved very good service results in the long term or fulfils a greater range of duties than other soldiers may be granted a personal surcharge of up to 50% of the highest level of pay in the grade to which the soldier is classified.
(2) A soldier who is an excellent, generally recognised expert and carries out activities classified in the 10th to 16th grade, and a soldier who performs intelligence tasks and is an excellent expert, may provide a personal surcharge up to 100% of the highest grade wage rate in the grade to which a soldier is assigned.
(3) The employer may increase, reduce or, where appropriate, withdraw a personal supplement depending on compliance with the conditions laid down in paragraphs 1 and 2.
Management supplement
§ 9
A leading soldier who is not subject to a management fee pursuant to Article 5 (1) of the Act shall be entitled, according to the degree of management, the degree of complexity of the management and the competence of the employer, to the management fee laid down in Annex 7 to this Regulation.
Extra charge for work in a difficult working environment
§ 10
(1) A soldier who operates in a difficult working environment is subject to an extra charge of between CZK 400 and CZK 1,400 per month. A difficult working environment for the purpose of providing a supplement shall be an environment in which the work is linked to difficulties arising from exposure to the effects of the aggravating influence and the measures to reduce or eliminate them referred to in paragraph 2.
(2) For the purpose of providing a supplement for work in a difficult working environment:
(a) dust whose average exchange concentrations in working air exceed three times the permissible exposure limit laid down by the special legislation12);
(b) chemicals whose average exchange concentrations in the working air exceed the maximum permissible concentration in the working air laid down by special legislation12) or, if the maximum concentration in the working air is not established for the substance, exceed three times its permissible exposure limit set by the special legislature12);
(c) mixtures of chemicals with an expected additive effect if the sum of the proportions of the exchange average concentrations of each chemical in air from their permissible exposure limit values is greater than 2;
(d) working processes with a risk of chemical carcinogenicity provided for by specific legislation13);
(e) fixed and variable noise or impulse noise whose equivalent sound pressure level A LAeq, 8h exceeds the hygiene limit laid down by special legislation14) or the permissible exposure limit laid down by special legislation15) by at least 20 dB or impulse noise whose average peak sound pressure level C specified by special legislation16) exceeds 145 dB;
(f) hand-transmitted vibration or total horizontal or vertical vibrations transmitted to workers whose average aggregate weighted acceleration level Lahv, 8h or average weighted acceleration level Law, 8h exceeds the permissible exposure limit for an eight-hour working time laid down by special legislation16) by at least 17 dB;
(g) a working environment where the values of permitted microclimatic conditions laid down by special legislation17 are exceeded, and even in the use of available available personal protective equipment and modification of the labour regime, health damage cannot be excluded;
(h) the conscious treatment of biological agents or their sources or transmitters, which are Guanarito virus, the Lasa virus, the June virus (Argentine disease), the Machupo virus, Amapari virus, Sabia virus, the Crimskocong haemorrhagic fever virus, the Ebola virus, the Marbura virus, all types of variola virus, Equine morbili virus, Brucella abortus, Brucella melitensis, Brucella suis, Mycobacterium leprae, Burkolderia pseudomallei (Pseudomonas pseudomallei), Burkolderia mallei (Pseudomonas mallei), Rickettsia rickettsia, Rickettsutsugamushi, Rickettsuma typhi (Ricketsia moosseri virus (Psekettoria pestii), Bricketomonas mallei virus, Brickonas mallei virus, Bricketenia pestii virus, Brickettii virus, or viri virus
(i) an increased pressure above 400 kPa, corresponding to a depth of at least 40 metres in the case of underwater work;
(j) radiation activities carried out in the controlled zone by category A workers as laid down in special legislation18),
(k) work related to the investigation and treatment of persons hospitalized in clinical centres specialised in the treatment of infectious diseases.
(3) The amount of the allowance for work in a difficult working environment is determined by the employer's employer according to the degree of risk, intensity and duration of the effects of the aggravating effects.
Special allowances
§ 11
(1) A soldier whose employer has arranged the performance of the service by alternating in the morning, afternoon and night shift is subject to a surcharge of CZK 400 to CZK 1,000 per month.
(2) A soldier, an efficient flyer, is charged a surcharge of CZK 2,000 to CZK 8,000 per month.
(3) A soldier who systematically provides health care in operating rooms, anesthesiologiccorussuscitation departments, emergency income units, intensive care units and oncology is subject to an extra charge of CZK 600 to CZK 2,000 per month.
(4) A soldier who is a member of a group of medical rescue services is subject to a surcharge of CZK 1,000 to CZK 4,000 per month.
(5) A soldier who carries out activities related to the protection of the interests of a State in which his life or health may be at risk, or other serious risks, is subject to a surcharge of CZK 1,500 to CZK 6,000 per month in the I. group, CZK 1,000 to CZK 4,000 per month in the II. group or CZK 600 to CZK 600 per month in the II. group. The Minister for Defence shall determine the classification of these activities in the I., II. or III Group according to the risk level.
(6) Only one of the allowances provided for in paragraphs 2 to 5 is payable to the soldier. The amount of the special supplement shall be determined by the employer to the soldier within the range which is most favourable to the soldier if the specified conditions are met.
§ 12
A soldier who is seconded to a unit of multinational forces outside the Czech Republic is entitled to an additional fee
(a) of USD 700 to USD 4,000 per month; or
(b) up to two-and-a-half times the amounts referred to in (a) where the soldier is exposed to a high risk of life or health related to the conduct of combat activity in the area of operation;
if applicable, at an equivalent amount in euro, according to the conversion rate of the Czech National Bank, from the first day to the last day of service abroad. The amount of the premium within this margin shall be determined by the Minister for Defence.
Remuneration
§ 13
Employer can provide a soldier with a reward
(a) for the successful achievement of an exceptional or particularly important task;
(b) to assess his work merit when he reaches 50 years of age and when he first ceases to be in service after he has granted an invalidity pension or has acquired entitlement to an old-age pension;
(c) providing assistance in preventing, disposing of, or disposing of, fires or natural events, or in other emergencies in which property, health or life may be at risk;
(d) for the improved economic outcome of the contributors19).
Common, transitional and final provisions
§ 14
(1) In order to mitigate the consequences of the injustices caused by the labour acts undertaken between 25 February 1948 and 1 January 1990, the employer may, by way of derogation from Paragraph 4 (3), include in full the period of other practice, provided that the soldier was unable to practice in the field of the required work due to an invalid labour law act (20).
(2) In order to mitigate the consequences of decisions by which pupils and students, as a result of political persecution between 25 February 1948 and 1 January 1990, have been excluded from study in secondary or higher education and higher education schools, the employer may, by way of derogation from § 4 (3), include in full the period of other practice, provided that the soldier has duly completed the relevant studies on the basis of the study rehabilitation (21).
§ 15
According to this Regulation, the salary shall also be determined on the date of entry into force of this Regulation for soldiers whose service was established before 1 January 2007.
§ 16
This Regulation shall enter into force on 1 January 2007.
