on pedagogy workers and on the amendment of certain laws
Parliament has decided on this law of the Czech Republic:

ČÁST PRVNÍ

PEDAGOGIC WORKERS SCHOOL AND SCHOOL EQUIPMENT

HLAVA I

GENERAL PROVISIONS
§ 1
Subject matter and scope of the adjustment
(1) This law regulates the conditions for the exercise of the activities of teaching staff, the continuing training of teaching staff and their career system, derogations from the arrangements for the layout of working time and special rules for the negotiation of duration of employment.
(2) This law applies to pedagogical staff of schools and school establishments registered in the register of schools and school establishments (1) (hereinafter referred to as "school") and to pedagogical staff of social services establishments.
§ 2
Pedagogical worker
(1) A pedagogical worker is the person who is engaged in direct teaching, direct education, direct specialpedagogical, direct social pedagogical or direct pedagogical or psychological activity by direct activity in the educational and educational sector under the special legislation (1) (hereinafter referred to as "direct pedagogical activity") and is:
(a) an employee of a legal person engaged in the activities of a school;
(b) an employee of a community of municipalities or an employee of a legal person established or established by a community of municipalities, provided that through such an organisation an organisation carrying out the activities of a school or a legal person is responsible for the performance of its tasks;
(c) an employee of the State; or
(d) the principal of the school.
A pedagogical worker shall also be an employee who carries out direct teaching activities in social services establishments; point (b) shall apply mutatis mutandis to that staff member.
(2) Direct pedagogical activities
(a) a teacher,
(b) a teacher in an establishment for the further education of teaching staff;
(c) the breeder;
(d) a special educator,
(e) a social educator;
(f) school logoted,
(g) psychologist,
(h) a leisure teacher;
(i) assistant educator,
(j) coach,
(k) prevention methodologies in pedagogy-psychological counselling (20);
(l) a leading pedagogical worker.

HLAVA II

PREPARATIONS FOR THE ACTIVITIES OF PEDAGOGIC WORKERS

Díl 1

Preconditions for carrying out the activity of a teaching staff member and conditions for carrying out the activities of the school director
§ 3
Preconditions for carrying out the activity of a pedagogical worker
(1) A pedagogical worker may be the one who fulfils the following conditions:
(a) is fully competent;
(b) has a professional qualification for the direct pedagogical activity he carries out;
(c) is righteous;
(d) is medically fit; and
e) has demonstrated knowledge of the Czech language, unless otherwise specified.
(2) The assessment of the presumption referred to in paragraph 1 (d) shall be governed by specific legislation.3)
(3) The recognition of professional qualifications and the fulfilment of the presumption of integrity and medical fitness of nationals of the Member States of the European Union and, where appropriate, of their family members, and of nationals of other States who are entitled to direct pedagogical activity in a Member State or elsewhere, are governed by specific legislation4).
§ 4
Knowledge of the Czech language
(1) A natural person who has obtained the professional qualifications provided for by this Act in a language other than the Czech language is required to prove his knowledge of the Czech language through examination, unless otherwise specified. Testing according to the first sentence shows the knowledge of the Czech language corresponding at least to level B2 according to the Common European Framework of Reference for Languages. A natural person to perform the activities of a kindergarten teacher or a primary school teacher shall demonstrate the knowledge of the Czech language corresponding to at least level C1 according to the Common European Framework of Reference for Languages.
(2) The examination of the Czech language can be carried out at a university in the framework of the Lifelong Learning Programme (5) or at an establishment for the further education of pedagogic works1) or at a language school with the right of state language examinations. 1)
(3) The examination does not replace the professional qualifications to teach the Czech language in primary, secondary and higher vocational schools.
(4) Demonstration of Czech language knowledge is not required for a natural person,
(a) which will operate in a school with a language other than the Czech language;
b) who successfully passed the Czech language and literature graduation exam or individual examination, which corresponds in its content and form to the common part of the Czech language and literature graduation exam, according to the Education Act 24),
(c) teaching a foreign language or conversation in a foreign language; or
(d) teaching the subject in a foreign language under the conditions laid down in the Education Act (25).
(5) In addition to the pedagogical staff mentioned in Sections 6 and 7, pedagogical staff can demonstrate knowledge of the Czech language by submitting a proof of the passing of the language examination abroad.
§ 5
Preconditions for the performance of the activities of the School Director
(1) The Director of the School may be a natural person who fulfils the conditions laid down in Section 3 and has obtained a practice consisting of the pursuit of a direct pedagogical activity or an activity for which knowledge of the same or similar focus is required, or in a management or research and development activity of a duration of
(a) 3 years for the head of the parent school;
(b) 4 years for the directors of primary school, primary school of art and school establishments, with the exception of school establishments for the performance of constitutional education, protective education and training centres;
(c) 5 years for directors of secondary school, language school, conservatory, higher vocational schools and educational institutions for the performance of constitutional education, protective education and education centres.
(2) The school director set up by the Ministry of Education, Youth and Sports (hereinafter referred to as "the Ministry"), the Region, the Municipality or a voluntary association of municipalities whose activities are the tasks in the field of education (hereinafter referred to as "the association of municipalities") may only be the one who, in addition to the assumptions referred to in paragraph 1, has acquired within 3 years of the date on which he began to carry out the activities of the School Director's Management by studying for the School Director in the framework of the further education of teaching staff referred to in Article 24 (2).
(3) The obligation to study for the school director established by the Ministry, Region, Municipality and Municipality shall not apply to the Director who has obtained knowledge in the field of education management through higher education in an accredited study programme5) aimed at the organisation and management of education or education in a Lifelong Learning Programme carried out by a higher education, the organisation and management of education and accredited for further training of teaching staff.

Acquisition of professional qualifications of teaching staff
§ 6
School teacher
(1) Teachers of a parent school receive professional qualifications
(a) higher education obtained by studying in an accredited study programme in the field of pedagogical sciences aimed at the preparation of teachers of the parent school;
(b) higher education obtained by study in the accredited study programme of the pedagogical field of study, or in the accredited study programme in the field of pedagogical sciences aimed at the preparation of first-degree teachers of primary school, education or free-time pedagogy, and study to extend the professional qualification aimed at the preparation of teachers of the parent school;
(c) higher vocational education obtained by the termination of the accredited higher vocational education programme (1) in the field of education aimed at the preparation of school teachers;
(d) higher vocational training obtained by the completion of an accredited higher education programme in the field of education aimed at the preparation of educators and studies to extend the professional qualification aimed at the preparation of school teachers;
(e) secondary education with a graduate examination completed by the end of the secondary education programme (1) in the field of education aimed at the preparation of school teachers;
(f) secondary education with a graduate examination obtained by the completion of a secondary education programme in the field of education aimed at the preparation of educationsand the carrying out of individual examinations (8), which corresponds in its content and form to the test of the profile part of the secondary examination from the subject of the pedagogy of the pre-school age; or
(g) the training referred to in paragraph 2 (a) or (b).
(2) A parent school teacher who carries out direct pedagogical activities in a class or school set up for children with special educational needs shall receive professional qualifications.
(a) higher education obtained by studying in an accredited study programme in the field of pedagogical sciences aimed at special pedagogy;
(b) higher vocational education obtained by the termination of an accredited higher education programme in the field of education aimed at special pedagogy; or
(c) the training provided for in paragraph 1 for teachers of a parent school; and
1. a university degree obtained by study in an accredited Bachelor's study programme in the field of pedagogical sciences aimed at special pedagogy; or
2. study to extend vocational qualifications focusing on special pedagogical, educational and educational activities in schools and classes set up for children, pupils and students with special educational needs, or to obtain the professional qualifications of a special educator.
§ 7
Primary school teacher
(1) First-degree primary school teacher is awarded vocational qualifications in higher education obtained by study
(a) in an accredited Master's study programme in the field of pedagogical sciences aimed at preparing first-degree teachers of primary school;
(b) in the accredited Master's study programme of the pedagogical field of study, or in the accredited Master's study programme in the field of pedagogical sciences aimed at the preparation of teachers of the parent school, education or free-time pedagogy, and in the study to extend the professional qualification aimed at the preparation of teachers of the first degree of primary school;
(c) in an accredited Master's study programme in the field of pedagogical sciences aimed at the preparation of secondary school teachers or general secondary school subjects and at the extension of vocational qualifications aimed at the preparation of primary school teachers;
(d) in an accredited Master's study programme in the field of pedagogical sciences aimed at preparing teachers of primary art school, which corresponds to the nature of the subject being taught;
(e) in an accredited master's study programme in the field of art with an artistic and pedagogical focus corresponding to the character of the subject of art taught;
(f) in an accredited Master's study programme in the field of pedagogical sciences aimed at the preparation of teachers of subject subjects of the second degree of primary school or secondary school only for the teaching of the corresponding subject of physical or artistic focus;
(g) in an accredited university study programme in the field of pedagogical sciences aimed at education only for the teaching of subjects of physical or artistic interest;
(h) according to § 12 only for the teaching of a foreign language; or
(i) in accordance with paragraph 2 (a) or (b).
(2) First-degree primary school teacher who performs direct pedagogical activities in a class or school set up for pupils with special educational needs shall receive professional qualifications.
(a) higher education obtained by studying in an accredited Master's degree programme in the field of pedagogical sciences aimed at special teaching for teachers;
(b) a university degree obtained by studying in an accredited Master's degree programme in the field of pedagogical sciences aimed at special pedagogy and a study to extend the professional qualification aimed at preparing first-degree teachers of primary school; or
(c) the training provided for in paragraph 1 for primary school teachers; and
1. higher education obtained by study in an accredited study programme in the field of pedagogical sciences aimed at special pedagogy; or
2. study to extend vocational qualifications focusing on special pedagogical, educational and educational activities in schools and classes set up for children, pupils and students with special educational needs, or to obtain the professional qualifications of a special educator.
§ 7a
Common ways of obtaining vocational qualifications as a secondary school teacher and as a general teacher of secondary school subjects
The second degree teacher of primary school and teacher of general secondary school subjects is awarded professional qualifications in higher education obtained by study in an accredited Master's degree programme.
(a) in the field of pedagogical sciences, aimed at preparing second-degree teachers of primary school or at preparing teachers of general or vocational subjects of secondary school;
(b) in the field of pedagogical sciences, aimed at the preparation of primary school teachers and studies to extend the professional qualification aimed at the preparation of secondary school teachers or secondary school;
(c) whose focus corresponds to the nature of the subject being taught; and
1. a university degree obtained by studying in an accredited Bachelor's programme in the field of pedagogical sciences aimed at preparing teachers of practical teaching or vocational training of a secondary school; or
2. study of pedagogy according to § 22 (1) (a);
(d) in the field of pedagogical sciences aimed at preparing teachers of the primary art school, which corresponds to the nature of the subject being taught, only for teaching the corresponding subject; or
e) according to § 12 only for teaching a foreign language.
§ 8
Second grade teacher of primary school
(1) A second-degree teacher who teaches in a classroom or a school set up for pupils with special educational needs receives professional qualifications
(a) higher education obtained by studying in an accredited Master's degree programme in the field of pedagogical sciences aimed at special teaching for teachers;
(b) a university degree obtained by studying in an accredited Master's degree programme in the field of pedagogical sciences aimed at special pedagogy; and
1. a university degree obtained by studying in an accredited Bachelor's programme in the field of pedagogical sciences aimed at preparing teachers of practical teaching or vocational training of a secondary school; or
2. study of pedagogy according to § 22 (1) (a);
(c) higher education obtained by studying in an accredited Master's study programme in the field of pedagogical sciences aimed at the preparation of first-degree teachers and higher education obtained by studying in an accredited Bachelor's study programme in the field of pedagogical sciences aimed at special pedagogy or study to extend the professional qualification aimed at specialised pedagogical, educational and educational activities in schools and classes set up for children, pupils and students with special educational needs or to obtain the professional qualification of a special educator;
(d) education provided for teachers in the second degree of primary school in accordance with § 7a and the higher education obtained by studying in an accredited Bachelor's study programme in the field of pedagogical sciences aimed at special pedagogy, or by studying to extend the professional qualification aimed at specialised teaching, education and education activities in schools and classes set up for children, pupils and students with special educational needs or to obtain the professional qualification of a special educator; or
(e) higher education obtained by study in an accredited Master's degree programme in the field of pedagogical sciences aimed at special pedagogy and the preparation of second-degree teachers of primary school or the preparation of teachers of general or vocational subjects of secondary school.
(2) A teacher of art subjects is awarded a professional qualification by a university degree obtained by study in an accredited master's programme in the field of art with an artistic and pedagogical focus.
(3) A staff member who is an executive artist (7), an artistic artist or who has a professional qualification as referred to in Article 10 (1) or (21) may be recognised in writing by the principal of a teacher of a second degree of primary school corresponding to the artistic focus or professional qualification of the staff member as having been met if the weekly working hours of that staff member for a legal person carrying out the school's activities do not exceed half of the weekly working time provided for in Article 10 (1) or Article 21. Recognition of the fulfilment of the professional qualification requirement shall be valid for the purposes of this Act for the period during which the staff member fulfils the conditions laid down in the first sentence.
§ 8a
Primary School Preparation Class Teacher
Primary School Preparation Class Teacher 16) receives professional qualifications in education under § 6 or § 7.
§ 8b
Primary School Training Teacher Special
The teacher of the primary school special17) receives vocational training according to § 7 (2).
§ 9
Secondary school teacher
(1) Teacher of secondary school vocational subjects is awarded professional qualifications in the accredited Master's degree programme
(a) in the field of pedagogical sciences aimed at preparing teachers of secondary school vocational subjects;
(b) in the field of pedagogical sciences, in order to prepare teachers of general secondary school subjects and general secondary school subjects, which correspond to the nature of the vocational course taught;
(c) in the field of pedagogical sciences, in order to prepare teachers of general secondary school subjects, which corresponds to the nature of the vocational course taught; or
(d) appropriate to the nature of the professional subject being taught; and
1. a university degree obtained by study in an accredited study programme in the field of pedagogical sciences aimed at the preparation of secondary school teachers or second degree primary school; or
2. study of pedagogy according to § 22 (1) (a) or (b).
(2) The teacher of practical teaching is qualified
(a) higher education obtained by study in an accredited study programme corresponding to the nature of practical teaching; and
1. a university degree obtained by studying in an accredited Bachelor's programme in the field of pedagogical sciences aimed at preparing teachers of practical teaching or vocational training of a secondary school; or
2. study of pedagogy in accordance with § 22 (1) (a) or (b);
(b) higher vocational education obtained by the termination of an accredited training programme of a higher vocational school in the field of education which corresponds to the nature of practical teaching; and
1. a university degree obtained by studying in an accredited Bachelor's programme in the field of pedagogical sciences aimed at preparing teachers of practical teaching or vocational training of a secondary school; or
2. study of pedagogy under § 22 (1) (a) or (b); or
(c) secondary education with a graduate examination completed by the completion of a secondary education programme in the field of education corresponding to the nature of the subject being taught; and
1. a university degree obtained by studying in an accredited Bachelor's programme in the field of pedagogical sciences aimed at preparing teachers of practical teaching or vocational training of a secondary school; or
2. study of pedagogy according to § 22 (1) (a) or (b).
(3) The teacher of practical teaching in the field of medical education must also have competence to pursue the profession of health under the special legislation (6) in the field which he teaches.
(4) Teacher of vocational training is qualified
(a) in accordance with paragraph 2,
(b) secondary education with a graduate examination obtained by the termination of a secondary education programme in the field of education corresponding to the nature of the subject being taught and the acquisition of a professional qualification for the activity of a vocational training instructor under the Law on the Recognition of the Results of Further Education; or
(c) secondary education with a certificate obtained by the termination of a secondary education programme in the field of education which corresponds to the nature of the subject being taught; and
1. higher education obtained through study in an accredited Bachelor's study programme in the field of pedagogical sciences aimed at preparing teachers of practical teaching or vocational training of secondary school;
2. study of pedagogy under § 22 (1) (a) or (b); or
3. the acquisition of a professional qualification for the activity of a training instructor under the Law on the Recognition of the Results of Continuing Education.
(5) The teacher of vocational training in health education shall receive vocational qualifications in education in accordance with paragraphs 2 and 3.
(6) A secondary school teacher who educates in a classroom or a school set up for pupils with special educational needs shall receive professional qualifications.
(a) training provided for secondary school teachers under § 7a or paragraphs 1 to 5; and
1. higher education obtained by study in an accredited study programme in the field of pedagogical sciences aimed at special pedagogy; or
2. study to extend vocational qualifications focusing on special pedagogical, educational and educational activities in schools and classes set up for children, pupils and students with special educational needs, or to obtain the professional qualifications of a special educator;
(b) study in an accredited Master's study programme in the field of pedagogical sciences aimed at special pedagogy for teachers and at pedagogical studies pursuant to § 22 (1) (a);
(c) for teaching in a practical school of one year and a practical school of two years by studying in an accredited Master's degree programme in the field of pedagogical sciences, focusing on special teaching for teachers or education in accordance with § 7 (2) or § 8 (1); or
(d) higher education obtained by study in an accredited Master's degree programme in the field of pedagogical sciences aimed at the special pedagogy and the preparation of second-degree teachers of primary school or the preparation of teachers of general or vocational subjects of secondary school.
(7) A teacher of art subjects is awarded a professional qualification by a university degree obtained by study in an accredited master's programme in the field of art with an artistic and pedagogical focus.
(8) A staff member who is an executive performer (7), an artistic artist, a recognised professional in the field, or who has a professional qualification as referred to in Paragraph 21, may accept in writing the presumption of professional qualifications as a teacher of a secondary school subject corresponding to an artistic or professional focus or professional qualification of the staff member as having been met, if his / her weekly working hours of a legal person engaged in the activity of the school do not exceed half of the prescribed weekly working time and if he / she, outside the employment relationship with the legal person carrying out the activity of the school, creates works of art, carries out an activity in the field in which he / she / she / she is a recognised expert, or an activity for which he / she / she meets the professional qualification under Paragraph 21. Recognition of the fulfilment of the professional qualification requirement shall be valid for the purposes of this Act for the period during which the staff member fulfils the conditions laid down in the first sentence.
§ 9a
Recognition of fulfilment of the condition of professional qualification of second-degree teacher of primary school or secondary school teacher
(1) A staff member who is a graduate of an accredited Master's degree programme whose focus corresponds to the nature of the subject being taught may be recognised in writing by the school director as a condition of professional qualification as a secondary school teacher or as a teacher of general secondary school subjects for a period of no more than 3 years from the date on which he began teaching.
(2) A staff member who is a graduate of an accredited Master's Degree Programme whose focus corresponds to the nature of the subject being taught may be recognised in writing as having been completed for a maximum period of 3 years from the date on which he began teaching.
(3) A staff member who is a graduate of at least secondary education with a degree in the field corresponding to the nature of the subject being taught may be recognised in writing as having been completed for a period of no more than 3 years from the date on which he began teaching.
(4) A staff member who is a graduate of at least secondary education with a certificate in the field which corresponds to the nature of the subject being taught may, in writing, recognise the presumption of professional qualifications of a teacher of vocational training as having been completed for a maximum period of three years from the date on which he began teaching.
(5) The total period of recognition of the professional qualification requirement referred to in paragraph 1, 2, 3 or 4 for the same staff member may not exceed 3 years in total for several employers. A staff member shall inform the school director, prior to the establishment of an employment relationship, whether and for what period he has previously received recognition of the presumption of professional qualifications referred to in paragraphs 1, 2, 3 or 4.
(6) Employees who have obtained a university degree in an accredited Bachelor's study programme in the field of pedagogical sciences, while being a student of an accredited Master's degree programme for the preparation of second-degree teachers or secondary school, which builds on the Bachelor's course programme, may in writing recognise the assumption of a second-degree teacher or a secondary school teacher who has completed the course of study of that accredited Master's degree programme for a maximum period of 3 years from the date of the beginning of study of that programme.
§ 10
Teacher of art specialized subjects in primary art school, secondary school and conservatory
(1) The teacher of artistic subjects at primary art school, secondary school and conservatory is awarded professional qualifications
(a) higher education obtained by study in an accredited study programme corresponding to the character of the subject of art taught; and
1. higher education obtained by study in an accredited Bachelor's study programme in the field of pedagogical sciences; or
2. study of pedagogy in accordance with § 22 (1) (a) or (b);
(b) a university degree obtained by studying in an accredited Master's degree programme in the field of pedagogical sciences aimed at preparing teachers of primary art school only for teaching at primary art school;
(c) higher education obtained by studying in an accredited Master's degree programme in the field of pedagogical sciences aimed at the preparation of teachers of general education subjects for playing a musical instrument or for solo singing only for teaching these subjects at primary art school;
(d) higher education obtained by study in an accredited Master's degree programme in the field of pedagogical sciences aimed at the preparation of teachers of general subjects for Fine Education only for the teaching of the art field in primary art school;
(e) higher education obtained by study in an accredited art study programme with an artistic and educational focus;
(f) higher vocational education obtained by the completion of an eight-year or six-year training programme in the field of conservator1), which corresponds to the character of the subject of art taught;
(g) higher vocational education obtained by the termination of an accredited training programme of a higher vocational school in the field of education which corresponds to the nature of the subject of art taught; and
1. higher education obtained by study in an accredited Bachelor's study programme in the field of pedagogical sciences; or
2. study of pedagogy in accordance with § 22 (1) (a) or (b);
(h) secondary education with a graduate examination obtained by the completion of the corresponding part of the conservatory training programme; and
1. higher education obtained by study in an accredited Bachelor's study programme in the field of pedagogical sciences; or
2. study of pedagogy under § 22 (1) (a) or (b); or
(i) secondary education with a graduate examination obtained by the termination of a secondary education programme in the field of education corresponding to the character of the subject of art taught; and
1. higher education obtained by study in an accredited Bachelor's study programme in the field of pedagogical sciences; or
2. study of pedagogy according to § 22 (1) (a) or (b).
(2) In the case of those who are or have been an performer) or an artist, the principal of the primary art school, secondary school or conservatory may, where justified, recognise in writing the presumption of professional qualifications as a teacher of the subject corresponding to the artistic orientation of the staff member for the purposes of this Act at the school in question.
