DECLARATION

of 8 December 2006

laying down the manner in which the documents are to be converted into electronic forms, the way in which they are to be handled and the binding electronic form of documents (Ordinance on the digitisation of the Commercial Register)

The Ministry of Justice provides, pursuant to § 33 (4) of Act No. 513 / 1991 Coll., Commercial Code, as amended by Act No. 216 / 2005 Coll.:

§ 1

Means of converting the documents into electronic form and handling the transferred documents

(1) The means of converting documents into electronic forms shall be understood as means of digitisation by means of computing. The digitised documents shall be stored in Portable Document Format (pdf) format and shall be included in the list database.

(2) As from 6 months after their digitisation, the documents shall no longer be retained.

§ 2

Obligatory electronic form of documents

Documents which are incorporated in a collection of documents which do not support the facts set out in the application for registration or amendment or deletion of the registration in the Commercial Register shall only be submitted in electronic form in the Portable Document Format format (pdf). These documents may be sent to the Registry by e-mail or using the Compact Disc Recordable (CD-R) data medium. The register court shall not return the data carriers delivered and shall shred them six months after delivery.

§ 3

Efficacy

This Decree shall take effect on 1 January 2007.
