DECLARATION
of 11 December 2006
on the participation of the State Budget in the financing of property reproduction programmes
In agreement with the Ministry of Regional Development, the Ministry of Finance provides, pursuant to § 13 (4) of Act No. 218 / 2000 Coll., on budgetary rules and amending certain related laws (budgetary rules):
Subject matter
This decree regulates the rules of procedure of the Ministry of Finance (hereinafter referred to as the Ministry), programme managers and programme participants for the preparation, approval and implementation of programmes (hereinafter referred to as the Programme) or actions in their records in the Information System of Programme Financing (hereinafter referred to as the Information System) and for their final evaluation.
Definition of terms
For the purposes of this decree:
(a) the administrator of the programme of the Chapter Administrator pursuant to Article 3 (g) of the budget rules, which is responsible for managing the State budget funds for financing the programmes;
(b) a participant in the programme, an organisational body of the State or a contribution organisation financing the preparation and implementation of an action from State budget resources, including State budget funds, which are or are to be covered by the budget of the European Union, the financial mechanism or NATO funds, or a legal or natural person financing the preparation and implementation of an action from resources provided by the State budget, including funds provided from the State budget which are or are to be covered by the budget of the European Union, the financial mechanism or NATO funds;
(c) a qualitative indicator or parameter as defined in the action (project) documentation specifying its specific objective or effectiveness;
(d) by the termination of the action, the binding date on which the programme participant reaches the specified purpose;
(e) the information system of the public administration, which is used to record the supporting documents for the preparation and implementation of the state budget and the implementation of the expenditure of the state budget in terms of detailed breakdown for the programme area (1), including the records of management procedures carried out under the Financial Controlle2 Act,
(f) the expenditure heading of the programme designation or part of the programme for the purposes of disembarking from the information system, the State-owned management part;
(g) the subsidy title of the programme designation or part of the programme for the purposes of output from the information system, part of the Registration subsidy system,
(h) a sub-heading identifying part of the expenditure or subsidy title for the purposes of the output from the information system;
(i) documentation of the action (s) of the document file requested by the administrator of the programme for the registration of the action (s) in the information system;
(j) the objective of the action (s) of the value to be achieved for the objectives of the Programme.
Program documentation
(1) For programme documentation, the Ministry assesss1)
(a) compliance with the content of the programme documentation; where the programme is also a programme co-financed by or part of the budget of the European Union, it shall also be assessed whether the programme documentation complies with the decision of the Commission of the European Communities;
(b) the participation of the State budget in the financing of the programme, including the State budget resources, which are or are to be covered by the budget of the European Union.
(2) The programme manager shall submit the documentation to the Ministry in paper and electronic form.
(3) Ministry within 30 days of submission of the programme documentation
(a) determine the amount of the State Budget funds for financing the programme, including the appropriations which are or are to be covered by the budget of the European Union, the amount of the State Budget funds being equal to the amounts contained in the relevant programme co-financed by the budget of the European Union;
(b) set out the objectives of the programme to be the subject of the final evaluation of the programme, which must be based on the objectives of the programme contained in the relevant programme co-financed by the European Union budget, the financial mechanism or NATO funds;
(c) The Ministry may, after examination, require the documentation to be completed if this is not sufficient.
(4) Where the programme manager requests the Ministry to amend the programme documentation, the amount of State budget participation or the objectives of the programme set out in paragraph 3, paragraphs 1 to 3 shall be treated mutatis mutandis. An amendment may be requested during the period of validity of this data set out in the approved programme documentation.
(5) The model forms for the preparation of the programme documentation are set out in Annex 1 to this Decree.
Final evaluation of the programme
(1) The final evaluation of the programme submitted by the programme manager to the Ministry shall include:
(a) an overview of the use of State budget appropriations for financing the programme, including the appropriations to be covered or to be covered by the budget of the European Union, on forms P 09 370, D 09 370, V 09 370, the models of which are set out in Annex 1 to this Order;
(b) a report on the achievement of the programme objectives set out in the programme documentation;
(c) achieved values of indicators and parameters determined by the Ministry pursuant to § 3 (3) (b).
(2) The Ministry shall approve the final evaluation within 30 days of submission or return to the programme administrator for completion. If the government has determined the amount of State budget participation, the programme administrator shall submit a final evaluation to the government within 30 days of the Ministry's approval.
(3) A final evaluation shall not be carried out by the programme administrator if the final evaluation of all the actions contained in the programme has not been completed.
Registration and financing of the action
(1) The programme participant shall submit to the programme manager the investment project of the action (s) established in accordance with the objectives set out in the programme documentation. Programme Manager
(a) assess the content of the investment project submitted by the programme participant, including the supporting documents, the models of which are set out in Annex 2 to this Decree, or, if deficiencies are found, may be returned to the programme to be completed. It lays down the terms and conditions for the participation of the State budget for further preparation, award and implementation of the action (s) or indicates that the State budget will not participate in the action (s),
(b) register the action (project) in the information system, lay down the conditions for the participation of the State Budget for further preparation, award and implementation of the action (project), and, if the action (project) involving the State Budget in the form of individually assessed expenditure and individual subsidies, issue a document from the information system on the registration of the action (project), the model of which is set out in Annex 3 to this Decree, and submit it to the Ministry for approval;
(c) assess the content of the award of the action (project) for individually assessed expenditure of the State's organisational component or individual subsidy according to the criteria set out in the programme documentation. If the programme administrator finds deficiencies in the assessment of the content of the award, it shall return the award to be completed. If the programme manager does not identify deficiencies, he shall submit the award to the Ministry for approval,
(d) determine the expenditure to finance the action (s) of the State's organisational body or issue a decision to grant a subsidy (hereinafter referred to as "the decision") and determine the conditions for the participation of the State budget in the implementation of the action (s).
(2) An action (project) co-financed by the budget of the European Union corresponding to an action (project) subject to European Commission legislation shall be submitted by the administrator of the programme to the Ministry before it is submitted to the European Commission.
(3) The action (project) co-financed by the financial mechanism or NATO funds corresponding to the action (project) subject to approval by the Financial Mechanism3 shall be submitted by the programme administrator to the Ministry before it is submitted to the Financial Mechanism Office.
(4) The models of the forms for the registration of the action (s) in the information system and data registration system or for the determination of expenditure on the financing of the action (s) by the State body or decision are set out in Annex 2 to this Decree.
(5) When the actions (projects) are entered into the information system, the individual actions (projects) shall be entered in:
(a) the title of expenditure, for the purposes of outputs from the information system, if the organisation of the State is a participant in the programme, or a contribution organisation established by it;
(b) the grant title, for the purposes of outputs from the information system, where a person other than the State's organisational body is a participant in the programme, or a contribution organisation established by it.
Final evaluation of the event
(1) For the final evaluation of the action, the programme administrator shall submit a report containing:
(a) the accounting and financial settlement of State budget funds, including State budget funds, which are or are to be covered by the budget of the European Union, the financial mechanism or NATO funds;
(b) the objectives of the programme achieved and the details of the fulfilment of the conditions laid down in the financing expenditure of the action (s) of the State's organisational body or decision;
(c) information on the financing of the action (s) and documents showing the amount of expenditure incurred to finance the action (s), with the exception of expenditure to be charged and settled financially under point (a);
(d) in the case of construction operations, documents authorising the programme participant to use the construction according to special legislation (2);
(e) the documents referred to in the determination of expenditure on the financing of the action (s) for the State's organisational units or in the Decision.
(2) If the programme administrator finds a defect in the final evaluation report, it shall draw the attention of the programme participant and set a deadline for their removal. If the programme manager does not identify deficiencies, he shall carry out a final evaluation of the action (s) on a form the model of which is set out in Annex 3 to this Decree.
(3) For an event which has been registered with the approval of the Ministry under Article 12 (6) of the budget rules, the programme administrator shall submit a report for the final evaluation of the action to the Ministry.
Transitional provisions
(1) The content of the programme and the material, time or financial indicators of the action, established in accordance with Decree No. 40 / 2001 Coll., remain valid.
(2) The change in the content of the programme and the material, time or financial indicators of the action, established pursuant to Decree No. 40 / 2001 Coll., shall be carried out in accordance with that Order.
Repeal
The following shall be deleted:
1. Decree No. 40 / 2001 Coll., on the participation of the State Budget in the financing of property reproduction programmes.
2. Decree No 231 / 2005 Coll., on the participation of the State Budget in the financing of the acquisition and reproduction programmes.
3. Decree No. 269 / 2005 Coll., amending Decree No. 231 / 2005 Coll., on the participation of the State budget in the financing of the acquisition and reproduction programmes.
4. Decree No. 466 / 2005 Coll., amending Decree No. 231 / 2005 Coll., on the participation of the State budget in the financing of property acquisition and reproduction programmes, as amended by Decree No. 269 / 2005 Coll.
Efficacy
This Decree shall take effect on 1 January 2007.
