of 10 January 2001
on the conditions for the operation of vehicles on the road
Parliament has decided on this law of the Czech Republic:

ČÁST PRVNÍ

BASIC PROVISIONS
§ 1
Subject matter
(1) This Act implements the relevant European Union16), following the directly applicable European Union32), and regulates the following road traffic conditions:
(a) vehicle registration;
(b) technical requirements for the operation of road vehicles and special vehicles and the approval of the technical capability of such vehicles, their systems, components and separate technical units;
(c) the rights and obligations of persons producing, importing and making available on the market vehicles, their systems, components and separate technical units;
(d) the rights and obligations of owners and vehicle operators;
(e) the rights and obligations of the technical control station and of the emission measurement station; and
(f) in-service technical checks.
(2) The Act regulates the performance of state administration and state supervision in the field of road traffic conditions and, following the directly applicable European Union38) the performance of state administration and state supervision in the field of non-road mobile machinery and their engines.
(3) The law does not apply to military vehicles (1) and motor vehicles whose design speed does not exceed 6 km.h-1.
§ 2
Basic concepts
(1) A road vehicle is a motor or non-motor vehicle which is manufactured for the purpose of road traffic for the carriage of persons, animals or goods.
(2) A special vehicle is a vehicle manufactured for purposes other than road traffic, which may be operated on road, subject to the conditions laid down by this Act.
(3) The trailer is a non-motorised road vehicle intended to be towed by another vehicle with which it is connected to the assembly.
(4) The historical vehicle is a vehicle which is registered in the register of historical and sports vehicles and which has been issued a certificate of the historical vehicle.
(5) The vehicle system is any vehicle design system which is subject to the technical requirements laid down in the implementing legislation. The vehicle system is, for example, the brakes or emission reduction devices.
(6) The structure of the vehicle is a part of a vehicle the type of which must be approved independently of the vehicle, if the implementing act so provides, and subject to the technical requirements laid down in the implementing act. The structure of the vehicle is, for example, a lamp.
(7) The separate technical unit of the vehicle is a component the type of which may be approved independently of the vehicle but only in relation to one or more vehicle types, provided that the implementing legislation so provides and to which the technical requirements laid down in the implementing legislation apply. For example, the rear bumper, fixed or interchangeable superstructure of the vehicle is a separate technical unit of the vehicle.
(8) The vehicle category is a group of vehicles which have the same technical conditions as laid down in the implementing legislation.
(9) The manufacturer is the person who:
(a) manufacture, design or manufacture of the vehicle, its system, component or separate technical unit; and
(b) it places them on the market under its name or trade mark or uses them for its own use.
(10) The type of road vehicle shall mean road vehicles of a category which conform to at least the essential characteristics. The vehicle type may include variants and versions. The essential characteristics for the identification of vehicle types, variants and versions shall be laid down in the implementing legislation for each category.
(11) The type of system, component or separate technical unit of the vehicle shall mean systems, components or separate technical units which conform at least to the essential characteristics. The essential features for determining the types of systems, components and separate technical units shall be laid down in the implementing legislation.
(12) A new vehicle is a vehicle which has not yet been registered or operated in the Czech Republic or any other state, except for testing or handling operations.
(13) The point of sale is the point where newly produced passenger cars are displayed or offered for sale or for hire to customers; this place also means a trade fair where newly produced passenger cars are offered to the public.
(14) The test station is a technical inspection station authorised by the Ministry of Transport (hereinafter referred to as "the Ministry ') to carry out the technical inspection of vehicles before their technical competence to operate on the road has been approved.
(15) The road vehicle operator shall be the person registered in the road vehicle register as the owner of the vehicle unless another person is registered in the road vehicle register as its operator.
(16) A sports vehicle is a vehicle which is registered in the register of historical and sports vehicles and which has been issued a sport vehicle licence.
(17) A Member State shall mean a Member State of the European Union, another Contracting State of the Agreement on the European Economic Area and the Swiss Confederation.
§ 3
Vehicle types
(1) Road vehicles and special vehicles are divided into species and categories.
(2) Road vehicles are divided into the following basic types:
(a) motorcycles;
(b) passenger cars;
(c) buses,
(d) lorries;
(e) special purpose vehicles;
(f) trailers,
(g) motor-powered invalid carriages, if their width or length exceeds 1,4 m, their design speed exceeds 15 km.h-1 or their maximum permissible mass exceeds 450 kg; and
(h) other road vehicles.
(3) Special vehicles shall be divided into the following basic types:
(a) agricultural or forestry tractors and their trailers;
(b) self-propelled working machinery;
(c) working machinery carried,
(d) fixed working machinery;
(e) interchangeable towed equipment,
(f) vehicles intended primarily for travelling on snow;
(g) vehicles intended primarily for off-road driving;
(h) pedestrian tractors and their trailers;
(i) special tractors and their trailers;
(j) transporters of work adapters; and
(k) other special vehicles.
(4) Road vehicles and special vehicles are divided into categories L, M, N, O, T, C, R, S and Z. The division of road vehicles and special vehicles into categories, the further breakdown of the different categories and their technical description and the way in which vehicles are categorised shall be laid down by implementing legislation.

ČÁST DRUHÁ

REGISTER AND REGISTRATION OF THE STRONG VEHICLE
§ 4
Register of road vehicles
(1) The register of road vehicles is an information system for public administration under the special legislation17), the administrator of which is the Ministry. The register of road vehicles shall contain a record of:
(a) road vehicles, owners and operators of such vehicles;
(b) diplomatic vehicles, which means the registration of road vehicles by diplomatic missions or consular offices of foreign States, offices of international organisations or institutions in the Czech Republic, the representation of public institutions established under the law of a foreign State, the representation of entities which, in terms of international law, are not a State (hereinafter referred to as "diplomatic mission") and their members;
(c) lost, stolen, damaged and destroyed registration certificates for a road vehicle and tables with assigned registration mark (registration mark);
(d) assigned special registration marks and lost, stolen, damaged and destroyed tables with assigned special registration mark;
(e) forms of road registration certificates drawn up bearing identification marks and produced and unpublished vehicle registration plate tables; and
(f) technical data of approved types of road vehicles.
(2) The register of road vehicles shall include:
(a) details of the owner and operator, unless it is identical to the owner, which are:
1. the name and / or surname, address of the place of permanent residence, long-term residence, temporary residence of at least 6 months or other authorised stay and birth number, if any;
2. a commercial firm or a name or, where applicable, its names and surname, or any distinguishing supplement, the address of the permanent residence, the long-term residence, the temporary residence of at least 6 months or any other authorised residence, the address of the registered office and the identity number of the person, if any, if any, in the case of the natural person involved; and
3. the trading firm or the name, address or location of the fissile plant and the identification number of the person, if any, in the case of a legal person or its fissile plant;
(b) the registration mark, the date on which the registration plate was assigned,
(c) the registration number of the road vehicle,
(d) the date of first registration of the road vehicle;
(e) the State of the last registration, the number of the certificate of registration of a road vehicle or similar document issued in the State of the last registration and the registration number of the road vehicle, unless the State of the last registration is the Czech Republic,
(f) details of the withdrawal of the registration certificate issued by another Member State;
(g) data on the decommissioning and demise of a road vehicle;
(h) details of the export of a road vehicle to another State;
(i) an indication of whether the alert in the register was made following a request made on behalf of a proxy,
(j) an indication that the road vehicle is historically original;
(k) the date of transfer of the road vehicle from the register of road vehicles to the register of historical and sports vehicles.
(3) The register of road vehicles shall also include:
(a) the purpose for which the road vehicle is intended;
(b) the type and category of road vehicle;
(c) the factory mark of the road vehicle, its trade mark and road vehicle type marking;
(d) road vehicle identification number (VIN), if not, then the vehicle chassis serial number;
(e) particulars of the manufacturer of the road vehicle, chassis, engine and bodywork of the road vehicle;
(f) the type, power and capacity of the engine and fuel;
(g) the type, production number and colour of the bodywork, the number of seating and standing positions and, where applicable, beds, dimensions of loading area, volume of cabinet or tank,
(h) an indication of the overall dimensions of the road vehicle;
(i) the maximum technically permissible mass, the maximum authorised mass and the operating mass of the road motor vehicle and the maximum technically permissible axle mass and the maximum authorised axle mass;
(j) the number of axles and driven axles, the type of coupling device, the maximum technically permissible mass of the trailer, the maximum authorised mass of the trailer, the maximum technically permissible mass of the combination and the maximum authorised mass of the combination;
(k) the degree of compliance with the emission level, CO2 emissions and fuel consumption data;
(l) an indication that it is an automated vehicle according to a directly applicable European Union Regulation on the approval of vehicles with regard to general safety 42),
(m) data on roadworthiness and roadworthiness;
(n) data on the approval of the technical competence of a road vehicle;
(o) particulars of the approval of the rebuilding of a road vehicle and the mass rebuilding of a road vehicle type.
(4) In the register of road vehicles, the special registration mark referred to in Sections 38a, 38b and 38d shall include:
(a) details of the person who has been assigned to the extent referred to in paragraph 2 (a);
(b) data relating to a road vehicle within the scope of paragraph 3 (b) to (l) and (n), if it is a special registration mark pursuant to § 38d; and
(c) the date of assignment and withdrawal of the special registration mark.
(5) In the register of road vehicles, the approved type of road vehicle shall include technical information to the extent specified in the certificate of conformity or the scope indicated in the certificate of approval of the individually manufactured road vehicle.
(6) For the purposes of this Act, a road vehicle in a trust fund shall be considered to be the owner of the trust manager.
(7) The scope and content of the data referred to in points (f), (g), (h) and (j) of paragraph 2 and referred to in paragraph 3 of the Road Vehicle Register shall be laid down in implementing legislation.
§ 5
(1) The Ministry shall enter in the register of road vehicles data and their changes in the register referred to in Article 4 (1) (e) and (f). The municipal authority of the municipality with extended scope shall enter in the register of road vehicles the data and their changes in the register referred to in § 4 (1) (a), (c) and (d). The Ministry of Foreign Affairs records data and changes to the register of diplomatic vehicles in the register of road vehicles.
(2) In order to carry out the operations referred to in paragraph 7 and under Sections 6 to 7f, Sections 8 to 11, Sections 12 (1) and 13 to 14a, any municipal authority of the municipality with extended scope is responsible. If the registration of a road vehicle in the register of diplomatic vehicles or other acts relating to a road vehicle entered in that register is concerned, the Ministry of Foreign Affairs shall be responsible for their implementation. The information in the register referred to in Article 4 (1) (d) shall be entered by the municipal authority of the municipality with extended scope, in whose administrative district the holder of the special registration mark has its registered office, or, if it is a special registration mark pursuant to § 38d, by the municipal authority of the municipality with extended scope which issued that special registration mark.
(3) The Ministry will provide Road Transport Inspection, Police of the Czech Republic and Military Police with data from the Road Vehicle Register in a way that allows remote and continuous access.
(4) The Ministry will provide long-distance and continuous access to data from the register of road vehicles
(a) the municipal police, to the extent necessary to establish the identity of the operator and owner of the vehicle to which an offence has been committed in the territory of the municipality, or to verify data from the vehicle registration certificate pursuant to another legislature28);
(b) regional authorities and municipal authorities with extended competence to the extent necessary for the purposes of carrying out the inspection and conduct of infringement proceedings under this Act, the Road Law or the Road Traffic Act; and
c) Fire department of the Czech Republic for the purpose of rescue and disposal work and planning and implementation of emergency measures.
(5) The Ministry will ensure in a way that allows remote and continuous access to the data from the register of road vehicles in the
(a) pursuant to Article 4 (2) (a) and (d), Article 4 (3) (b), (f), (g), (h), (i), (j) and (k) and Article 4 (4) (a), the operator of the electronic toll system for the purpose of determining the CO2 emission class of the vehicle in the electronic toll system, registration of the vehicle in the electronic toll system and recovery of the toll due;
(b) pursuant to § 4 (2) (a) and (b) and § 4 (4) (a) of the Czech Environmental Inspection Office for the purpose of carrying out checks and conducting infringement proceedings under a special law;
(c) pursuant to § 4 (2) (a), (b), (d) and (e) and § 4 (3) (b), (f), (k) and (o) the Ministry of the Environment and the municipality which has established a low-emission zone on its territory for the purpose of providing, managing and controlling data in the information system of low-emission zones under a special law,
(d) pursuant to § 4 (2) (a) and (b), § 4 (3) (b), (f), (i) and (k) and § 4 (4) (a)
1. to the State Fund for Transport Infrastructure for the purpose of verifying the data relevant for the determination of the amount of the time fee, for the purpose of identifying the vehicle in the event of a change in its registration mark or for the purpose of verifying the data specified in the Notice of exemption of the vehicle from charging under a special law; and
2. the authorities of the Customs Administration of the Czech Republic for the purpose of carrying out supervision of the performance of the obligations of drivers and vehicle operators in the system of time charging under a special law,
(e) pursuant to § 4 (2) (a) to (h) and (j) to (l) and § 4 (3)
1. The Ministry of the Interior for the purpose of administering vehicles secured in criminal proceedings under a special law; and
(2) the Office for the Representation of the State in matters of property for the purposes of the management of vehicles falling within the jurisdiction of the State of death or of judicial custody under special legislation;
(f) pursuant to § 4 (2) (a), (b) and (g) and § 4 (3) (a) to (e), (g) to (j) and (n) of the Ministry, regional authorities, municipal authorities with extended competence and municipal authorities for the purpose of conducting procedures for the authorisation of the special use of motorways, roads or local roads by excessive vehicles under the Road Act.
(6) For the purpose of ensuring compliance with the obligation under Article 28 (1) (q), the Ministry shall provide, upon request, to the manufacturer or accredited representative, information on the name and address of the operators of the vehicles concerned registered in the register of road vehicles. The manufacturer or accredited representative shall not use the data provided for other purposes. Without undue delay after the use of the data provided to fulfil the obligation under Paragraph 28 (1) (q), the manufacturer or accredited representative shall dispose of the data.
(7) The municipal authority of the municipality with extended scope shall, upon request, provide data from the register of road vehicles
(a) a natural or legal person who demonstrates a legal interest in the provision of data; the legal interest is not demonstrated by the owner or the road vehicle operator in the case of data relating to that vehicle; and
(b) a public authority to the extent necessary to exercise its competence.
(8) The Ministry ensures automated exchange of data on road vehicles, their owners and operators according to the European Union Regulation (18). To this end, the Ministry
(a) ensure, in a manner that allows remote and continuous access to data pursuant to Article 4 (2) (a) to (e), (g) and (h) and Article 4 (3) (b) to (e) and (i) to (k) and data on the theft of a road vehicle to the competent authority of another Member State of the European Union pursuant to the European Union Regulation (18), upon request; data on the theft of a road vehicle for this purpose shall be provided by the Police of the Czech Republic in a manner enabling remote and continuous access from police records,
(b) forward the request to the competent authority of another Member State of the European Union by the Czech Police, Customs Administration or Fire Department of the Czech Republic for the provision of data on road vehicles, their owners and operators in accordance with the European Union Regulation (18) and the data provided; and
(c) transmit to the competent authority of another Member State of the European Union, in accordance with European Union Regulation (18), the requirement of the municipal authority of the municipality with extended competence to provide data on road vehicles, their owners and operators.
(9) The implementing act lays down the manner in which the road vehicle register is maintained, the manner and form in which the data are entered in the road vehicle register, the details of the data entered in the road vehicle register and the model of the application for data from the road vehicle register.
§ 5a
(1) Before applying for registration of a road vehicle in the register of road vehicles, the owner of the road vehicle shall ensure that it is presented for technical inspection for the purpose of registration of a road vehicle in the register of road vehicles, if it is a vehicle which is registered
(a) in a Member State other than a Member State; or
(b) in another Member State and from the date of its first registration in another Member State or from the date of the regular technical examination immediately preceding the date of application, the period for the first or subsequent periodic technical examination under this law or the owner of a road vehicle shall not have proof of the regular technical examination immediately prior to the submission of the application.
(2) The technical examination referred to in paragraph 1 may be replaced by a technical examination of the imported road vehicle carried out for the purpose of the approval of its technical competence under Paragraph 35.
§ 6
(1) A road vehicle whose technical competence is subject to approval, operated on road, must be registered in the register of road vehicles if the person operating it has a vehicle in the Czech Republic
(a) permanent residence, long-term residence or, in the case of a citizen of another Member State, temporary residence of at least 6 months in a calendar year or granted asylum;
(b) the registered office in the case of a legal person; or
(c) the split-off race in the case of a foreign legal person.
(2) Where a road vehicle is operated in international traffic under an international road traffic contract (19) for a period not exceeding 6 months in a calendar year, paragraph 1 shall not apply.
(3) The municipal authority of the municipality with extended scope shall register a road vehicle whose technical competence is subject to approval in the register of road vehicles on the basis of a written request by the owner of the road vehicle or, where applicable, a joint application by the owner and the person who appears in the application as the road vehicle operator if:
(a) the technical capability of a road vehicle to operate on the road has been approved;
(b) The Czech Insurers' Office records information on the fulfilment of an obligation of liability insurance for the operation of such a vehicle, or such insurance has been demonstrated by other means, if it is a vehicle whose operation is subject to an obligation to arrange such insurance;
(c) a value added tax has been paid on the acquisition of a road vehicle from another Member State, provided that specific legislation so provides;
(d) the road vehicle is not kept missing or stolen in the Schengen Information System (20) or in the Information System of the Police of the Czech Republic or this information is not established in accordance with the procedure laid down in Section 5 (8);
e) the road vehicle operator has in the Czech Republic
1. permanent residence, long-term residence or, in the case of a citizen of another Member State, temporary residence of at least 6 months in a calendar year or granted asylum,
2. the registered office in the case of a legal person; or
3. a split race, when dealing with a foreign legal person,
(f) according to the registration carried out in the Czech Republic, the actual state of the road vehicle and its identification data are in accordance with the information provided for in Section 48 (3) (a), if not for a new vehicle; and
(g) it is not an incomplete road vehicle pursuant to the directly applicable European Union Regulation concerning the approval of vehicles of categories M, N and O39) or the directly applicable European Union Regulation concerning the approval of vehicles of category L29).
(4) The application for registration of a road vehicle in the register of road vehicles must contain:
(a) an indication of the type and category of road vehicle, the factory mark of the road vehicle, its trade mark and road vehicle type designation, the approval number of the road vehicle's technical competence and the purpose for which the road vehicle is intended;
(b) particulars of the owner of the road vehicle as referred to in Article 4 (2) (a);
(c) particulars of the road vehicle operator referred to in Article 4 (2) (a), if the owner is not the owner of the vehicle at the same time; and
(d) an officially certified signature if the application is made in paper form; This does not apply if the municipal authority of the municipality with extended scope checks the identity of the applicant or the applicant is represented by a power of attorney.
(5) The applicant shall accompany the application for registration of a road vehicle in the register of road vehicles:
(a) evidence of the technical competence of the vehicle:
1. a declaration of conformity of a road vehicle with a vehicle type approved by the Ministry, approved by the authority of another Member State, valid in all Member States or approved by an authority of another Member State and recognised by the Ministry;
2. a certificate of approval of a individually manufactured road vehicle issued by the municipal authority of the municipality with extended scope or by an authority of another Member State with validity in all Member States;
3. a certificate of registration of a road vehicle issued by another Member State or a similar document issued by a Member State other than that which attests to the approval of a vehicle type pursuant to point 1 or to the approval of a individually manufactured road vehicle pursuant to point 2; or
4. the decision approving the technical competence of the imported road vehicle,
(b) a technical inspection document, if it is a road vehicle operated, with the exception of a road vehicle registered in another Member State, for which, from the date of its first registration, the time limit for the first periodic technical inspection provided for in this Law has not expired on the date of the application; evidence of technical inspection is
1. proof of regular technical inspection in another Member State in which the vehicle is registered, unless the owner is obliged to arrange for the technical inspection in accordance with § 5a;
2. a technical inspection protocol for the registration of a road vehicle in the register of road vehicles, where the owner is obliged to arrange for the technical inspection referred to in § 5a (1); or
3. a technical inspection protocol for the approval of the technical competence of an imported road vehicle, if this vehicle has been approved in accordance with § 35;
(c) a certificate of registration of a road vehicle issued by another Member State, if it is a road vehicle registered in another Member State and it has not been surrendered when the technical competence of the imported vehicle is approved;
(d) confirmation of payment of value added tax in the case of acquisition of a new means of transport from another Member State; and
(e) documentation containing information to the extent provided for in Article 4 (3), unless contained in the document referred to in (a).
(6) Where an application for registration of a road vehicle is submitted in electronic form to the register of road vehicles, the applicant shall accompany the application with copies of the documents referred to in paragraph 5 in electronic form. The document referred to in paragraph 5 (a), with the exception of the document referred to in paragraph 5 (a) (4), and the document referred to in paragraph 5 (c), shall be submitted by the applicant to the municipal authority of the municipality with extended scope when issuing the certificate of registration of a road vehicle; If the applicant does not submit these documents, the municipal authority of the municipality shall not carry out registration of the road vehicle in the register of road vehicles with extended scope.
(7) Where the authorisation to be represented when a road vehicle is entered in a register of road vehicles is demonstrated by a written power of attorney, the power of attorney shall be entered in the information system of the authorisation to represent 9c), signed by an officially certified signature of the principal or signed by the principal in a manner with which the specific legislation links the legal act to the State in connection with the exercise of its competence with the effects of the handwritten signature 27). Where an application for registration of a road vehicle is submitted to the register of road vehicles in electronic form and the full authority has been signed by an officially certified signature of the principal, the application shall be accompanied by an application for a full power representing the exit from the authorised conversion of documents or a copy of the mandate. If the application is accompanied by a copy of the mandate, the authorisation shall be submitted in paper form to the municipal authority of the municipality with extended scope when issuing the certificate of registration of a road vehicle; If the authorisation is not submitted in paper form, the municipal authority of the municipality shall not carry out the registration of the road vehicle in the register of road vehicles.
(8) The model application for registration of a road vehicle in the register of road vehicles is laid down in the implementing legislation.
§ 7
(1) The municipal authority of the municipality with extended competence when entering a road vehicle into the register of road vehicles to the applicant
(a) issue a certificate of registration for a road vehicle; and
(b) withdraw the certificate of registration of a road vehicle in the case of a vehicle registered in another Member State and forward it to the Ministry on request.
(2) If they do not assign a registration mark in accordance with the procedure laid down in Section 7b, the municipal authority of the municipality with extended competence when entering a road vehicle in the road vehicle register shall also assign a registration mark to the road vehicle and issue to the applicant a plate with an assigned registration number corresponding to the vehicle category.
(3) The registration mark consists of a combination of large letters of the Latin alphabet and Arabic numerals.
(4) When issuing tables with registration mark, the municipal authority of the municipality with extended scope shall affix one of the published tables to the label indicating the date of the periodic technical inspection. If a serious defect has been detected in the road vehicle, the municipal authority of the municipality with extended application to the sticker shall indicate the date of the repeated technical inspection, the last day of the month following the entry of the road vehicle into the register of road vehicles. If a dangerous defect has been detected on the road vehicle, the municipal authority of the municipality, with extended scope, shall not affix a plate with a registration mark.
(5) The Ministry shall notify the competent authority of another Member State, within two months of the entry of a road vehicle into the register of road vehicles, of the withdrawal of the certificate of registration of a road vehicle which was registered in the register of another Member State at the date of the registration. At the request of the competent authority of another Member State, the Ministry shall return the withdrawn registration certificate to that authority within 6 months of its withdrawal.
(6) The implementing legislation sets out the model of the certificate of registration of a road vehicle and the types, form, content and structure of the registration mark and the implementation of the registration plate.
§ 7a
Reservation of registration marks
(1) In addition to the general requirements of the submission of the road vehicle identification number (VIN) or the chassis serial number of the road vehicle, the registration number of the vehicle shall be assigned to that vehicle if the application for registration of the road vehicle in the road vehicle register is submitted to the same municipal office of the municipality with extended scope within 3 months of the date of the application for the reservation and the vehicle registration mark is reserved.
(2) Where an application is made for registration of a road vehicle in the register of road vehicles referred to in paragraph 1, the municipal authority of the municipality with extended application to the road vehicle shall, in accordance with the procedure laid down in Section 7, assign a reserved registration mark; otherwise the registration mark reservation will cease.
