DECLARATION

on the Public Security Auxiliary Guard
The Minister of Interior provides, pursuant to § 15 (3) of Act No. 286 / 1948 Coll., on National Security, and under § 4 of Government Decree No. 54 / 1953 Coll., on road traffic:
The Public Security Auxiliary Guard is one of the forms of direct participation of citizens in the protection of public order.
(1) Reporting citizens, over 18 years of age, who enjoy general seriousness and trust and who are others' examples in work, public activity and personal life are admitted to the ranks of the Public Security Auxiliary Guard. Members of the Public Security Auxiliary Guard shall carry out their duties outside their duties; their function is an honest function.
(2) The members of the Public Security Auxiliary Guard shall be designated by the National, Economic and Social Authorities or by the Public Security Department, which shall issue a public security Auxiliary Guard card to the designated members.
In the performance of their duties, members of the Public Security Auxiliary Guard shall be marked externally with a yellow tape of 105 mm wide on which the inscription "PS- VB 'is printed in blue; letters are 35 mm high and 20 mm wide. The tape is worn on the left backup.
(1) Members of the Public Security Auxiliary Guard shall assist in ensuring the protection of public order; In particular, it has an incentive to avoid violations of public policy and to eliminate the causes which lead to it in good time.
(2) In the performance of their duties, members of the Public Security Auxiliary Guard are required to maintain strictly the laws and other legislation. He must speak with discretion and politeness during the hearing. They are primarily educational to those who violate public order.
Members of the Public Security Auxiliary Guard, if identified externally, shall be entitled to:
(a) to warn a citizen who has violated public policy and if the agreement is not sufficient to establish his identity and to notify the public security authorities thereof;
(b) stop vehicles and require the relevant documents prescribed for the driving and operation of the vehicle and the documents relating to the cargo, including a certificate of insurance for statutory liability for damage caused by the operation of the motor vehicle; in the case of an established traffic offence, to warn the driver and, if the agreement is not sufficient, to notify the public security authorities thereof;
(c) prohibit a driver whose ability to drive is reduced by the influence of alcohol;
(d) detain a person who has been found in a criminal offence, if necessary to establish his / her identity, to prevent escape or to provide evidence. However, they shall be obliged to surrender the detainee immediately to the prosecutor or to the investigating or security authority; the detained member of the armed forces may also be surrendered to the nearest force unit or crew manager. If the detainee cannot be surrendered in such a way, the detention of the detainee must be notified at least immediately (§ 76 (2)).
Each person shall be obliged to follow the instructions and challenges of the members of the Public Security Auxiliary Guard, which they issue in the performance of their duties. At the request of citizens, members of the Public Security Auxiliary Guard shall demonstrate their identity card in the performance of their duties.
Members of the Public Security Auxiliary Guard shall be relieved of their duties if they do not fulfil their duties or commit acts incompatible with their duties.
(1) They are repealed.
(a) Decree of the Minister for National Security No 31 / 1952 Coll., on the external designation of members of the Public Security Auxiliary Guard,
(b) measures taken by the Ministry of the Interior of 1 March 1955 on the Auxiliary Service of Public Security Transport Inspectors, published in 17 Official Journal of 1955.
(2) At the same time, the authorisations of civil transport inspectors to ensure the safety and continuity of road transport pursuant to the measure of the Ministry of the Interior of 5 June 1959 published in the amount of 50 Official Journal of 1959. *)
This Decree shall take effect on 1 July 1962.
