Law on artisanal and folk art production

about artistic craft and folk art production.
The National Assembly of the Czechoslovak Republic decided on the following Act:

ČÁST PRVNÍ

§ 1
Preliminary provisions
(1) Artistic craft work and folk art production are an important part of our socialist culture and contribute to increasing the material and cultural level of our working people. It is therefore necessary to create the conditions for their preservation and further development and to ensure their ideological and professional management in the spirit of the same socialist principles that determine activities in other fields of creative work, especially in the field of fine arts.
(2) In order to achieve this objective, the selection of workers who appear to be particularly fit and competent to work in these sectors is primarily the professional and ideological management of those workers and their economic security so that they can fully pursue this activity. The fulfilment of this task is ensured by uniform ideological management and by the construction of specific professional organisations for these sectors.

§ 2
Ideal supervision
(1) The Ministry of Education and Culture exercises the ideal supervision in the arts and folk arts sector.
(2) In order to address fundamental ideas issues, an Advisory Council is set up in the Ministry of Education and Culture, the Minister for Education and Culture, whose members are appointed and dismissed. Membership of the Advisory Board is an honorary function. The Organisational and Rules of Procedure of the Advisory Board shall be issued by the Ministry of Education and Culture.
Professional organisation
§ 3
(1) As a professional organization of artistic craftsmanship, the Institute of Artistic Crafts is established in Prague, as a professional organization of folk art production.
(2) The headquarters of artistic crafts and the headquarters of folk art production are legal persons directly subordinate to the Ministry of Education and Culture; they are registered in the company register.
§ 4
(1) The headquarters of artistic crafts and the headquarters of folk art production are used by professional skilled workers of artistic craft and professional workers of folk art production.
(2) The Ministry of Education and Culture, in agreement with the Central Committee of the Trade Union, lays down the conditions for the professional competence of workers of artistic craft and folk art production, as well as the method of certification thereof.

Artistic craft work
§ 5
Artistic craftsmanship is the handiwork of artistic works of art, decorative and building arts by professional workers who create these works on the basis of classical methods by master techniques directly or according to design.
§ 6
The headquarters of artistic crafts creates conditions for the preservation and further development of artistic craft work, especially by:
a) takes care of the right idea focus and high level of artistic craftsmanship;
(b) carry out research and documentation in the arts and crafts sector, process the results of this activity and carry out the experimental work necessary for the further development of artistic craft;
(c) seek out the eligible youth and create conditions for increasing its practical skills;
(d) performing works of artistic craft and ensuring that they are disposed of;
(e) promote artistic craftsmanship through exhibitions, the establishment of promotional, exhibition and custom centres and publishing activities.
People's artistic production
§ 7
People's artistic production is the production of commercial artistic objects, mainly made of natural material, by workers who continue their creative work in the folk artistic tradition and apply the experience of the handiwork of the past.
§ 8
The headquarters of folk art production takes care of folk art production in order to fulfil its cultural and social function, in particular by:
a) takes care of the right idea and high level of folk art production;
(b) carry out research and documentation in the field of folk art production and process the results of this activity professionally;
c) Seek out folk artists, continuously monitor the level of their work, help them to increase the level of work and take care of the upbringing of youth;
(d) provide material security for folk artists, especially by employing them in their own workshops or as domestic workers, after the purchase of their products;
(e) ensure the disposal of products of folk artistic and complementary production;
(f) promote folk art production, in particular exhibitions and professional publishing activities.
Common provisions
§ 9
(1) Head of the Institute of Artistic Crafts and Head of the Institute of Artistic Folk Production is the Director, appointed by the Minister of Education and Culture. The Director shall be responsible for the operation of the organisation, both artistic and economic.
(2) For professional and artistic questions, an Advisory Board shall be set up for each of the two sectors at the Institute of Artistic Crafts and at the Institute of Folk Art Production. Membership of the Advisory Board is an honorary function. The rules of organisation and the rules of procedure to be drawn up shall be laid down in detail with the agreement of the Ministry of Education and Culture.
§ 10
(1) Organisation, operation and management principles of the Institute of Artistic Crafts and the Institute of People's Art Production will adapt the statutes issued by the Ministry of Education and Culture in agreement with the State Office of Planning, the Ministry of Finance and the Central Committee of the Trade Union.
(2) Save as otherwise provided in this Act or in the Statutes of these Organisations, the provisions on national undertakings shall apply mutatis mutandis to the Institute of Artistic Crafts and to the Institute of People's Artistic Production.
§ 11
(1) The headquarters of artistic crafts and the headquarters of folk art production cooperate with the organisations of artistic artists, other cultural organisations, folk cooperatives and other production organisations active in the field of artistic craft and in the field of folk art production, and with excellent experts.
(2) Mutual relations between the Institute of Artistic Crafts and the Institute of People's Art Production to undertakings of the State Socialist sector which are engaged in the production of the character of artistic craft shall be regulated by the Minister of Education and Culture in agreement with the ministers in whose field these undertakings fall.
§ 12
The Ministry of Education and Culture shall provide for sales of works of artistic craft and folk art products in agreement with the Ministry of Internal Trade.

ČÁST ČTVRTÁ

Final provisions
§ 13
Measures taken in accordance with this Act before the beginning of its effectiveness shall be deemed to have been taken in accordance with it.
§ 14
The provisions of this law - with the exception of provisions on ideal supervision - do not apply to folk cooperatives in the field of artistic craft and folk art production.
§ 15
(1) All provisions on matters governed by this Act, in particular Decree No. 110 / 1945 Coll., on the organisation of folk and artistic production, are hereby repealed.
(2) The provisions of Act No. 53 / 1954 Coll., on People's Cooperatives and on Cooperative Organisations remain without prejudice.
§ 16
The headquarters of folk and artistic production, established by Decree No. 110 / 1945 Coll., is deleted. His assets are being transferred to the state. The commitments of the cancelled organisation will be settled up to the value of the assets taken over under the directives issued by the Ministry of Education and Culture in agreement with the Ministry of Finance.
§ 17
This law applies only in Czech regions and takes effect from the date of publication; It shall be implemented by the Minister for Education and Culture in agreement with the participating members of the Government.
