on the exceptional provision of an old-age pension to certain miners
The Government of the Czech and Slovak Federal Republic orders according to § 176 (a) and (b) of Act No. 100 / 1988 Coll., on Social Security (hereinafter referred to as "the Act"):
(1) This Regulation regulates the conditions for the exceptional provision of an old-age pension to citizens who have worked in mining for at least 25 years and have reached the age of 50 years before 31 December 2000.
(2) The selected mining jobs for the purposes of this Regulation are those of the first working category in mining with a permanent place of work under the ground in the deep-sea mines 1) listed under Nos 1 to 7 and 11 in Annex No 2 to the Government of the Czechoslovak Socialist Republic Regulation 117 / 1988 Coll., on the classification of employment into the 1st and 2nd working categories for pension purposes.
(3) For the purposes of this Regulation, as a period of employment of the first working category in mining with a permanent place of work under the ground in deep mines,
(a) the period of employment referred to in paragraph 2; and
(b) the periods referred to in § 18 (3) of the Act and in § 5 (1) (a) to (f) of the Decree of the Government of the Czechoslovak Socialist Republic No 117 / 1988 Coll., if they are surrounded by the period of employment referred to in paragraph 2.
(1) A citizen referred to in Article 1 (1) shall be entitled to an old-age pension if:
(a) have been employed for at least 15 years in selected mining jobs;
(b) has reached the maximum allowedexposure (2); and
(c) the work of the selected miners has ceased until 31 March 1991.
(2) A citizen referred to in Article 1 (1) shall also be entitled to an old-age pension if:
(a) has been employed for at least 10 years in selected mining jobs in uranium mines;
(b) exceed the maximum allowable exposure (2); and
(c) the performance of the selected job in mining in uranium mines until 31 December 1990 in connection with the reduction of the maximum allowedexport.2)
A citizen referred to in § 1 (1) who has not fulfilled the condition laid down in § 2 (1) (a) or (b) until 31 March 1991 shall be entitled to an old-age pension if he has fulfilled the missing condition and has ceased to pursue a selected occupation in mining by 31 December 1992.
If a citizen referred to in § 1 (1) becomes entitled to an old-age pension under this Regulation after the conditions set out in § 2 or § 3 have been fulfilled, he shall not be entitled to an old-age pension under this Regulation or, if necessary, he shall cease to exist from the first day of such employment.
For the amount of the old-age pension provided for in this Regulation, the period from the date of the pension to the age of 55 shall be added to the period of employment of the 3rd working category.
If the citizen fulfilled the conditions laid down for entitlement to an old-age pension under this Regulation before 1 January 1991, he shall be entitled to that pension on 1 January 1991.
Organisations that employ or employ workers in selected mining jobs shall be required to ensure that they keep and submit records of the facts relevant to the entitlement to an old-age pension under this Regulation on the prescribed form; If the old-age pension for which entitlement under this Regulation has been acquired on 1 January 1991, the organisation shall be obliged to do so by 31 January 1991 at the latest.
This Regulation shall enter into force on 1 January 1991.
