DECLARATION
of 17 December 2002
amending Decree No. 104 / 1997 Coll., implementing the Road Law, as amended
The Ministry of Transport and Communications provides, pursuant to § 46 (2) of Act No. 13 / 1997 Coll., on Road, as amended by Act No. 102 / 2000 Coll., Act No. 256 / 2002 Coll. and Act No. 259 / 2002 Coll., ("the Act ') for the implementation of § 25 (13) of the Act:
Decree No. 104 / 1997 Coll., implementing the Road Law, as amended by Decree No. 300 / 1999 Coll., Decree No. 355 / 2000 Coll. and Decree No. 367 / 2001 Coll., is amended as follows:
1. In Paragraph 40, the following paragraph 6 is inserted after paragraph 5:
"(6) The application for the authorisation of special use pursuant to § 25 (6) (g) of the Act contains:
(a) the purpose, scope and date of specific use;
(b) the name and surname of the person who is to be responsible for the specific use, his address and birth number (for legal persons, name, registered office and identification number),
(c) design of the vehicle movement route;
(d) basic technical data of the vehicle
1. type of vehicle;
2. factory brand, type (if identifiable),
3. production number (if stated on the vehicle),
4. dimensions (length, width and height),
5. operating mass and, where applicable, maximum technically permissible mass,
6. number of axles and load of individual axles,
7. vehicle lighting (type, number and position),
8. maximum design speed,
(e) a drawing of the outline of the vehicle in which the dimensions of the vehicle and the position of the lighting devices are indicated, or a photograph of the vehicle from the front, from the sides and from the rear. ';
Paragraphs 6 to 10 shall become paragraphs 7 to 11.
2.Paragraph 40 (11), including footnote 12a, reads as follows:
"(11) The authorisation of special use under Paragraph 25 (6) (g) of the Act contains:
(a) establishing the route of movement of the vehicle and the period during which specific use is permitted;
(b) the name and surname of the person who is to be responsible for the specific use, his address and birth number (for legal persons, name, registered office and identification number),
(c) technical requirements for the vehicle
1. ensuring proper technical condition of the braking system;
2. a ban on leakage of operating fluids;
3. the fitting of the vehicle with a functional lighting device (headlamps with passing beam, front and rear position lights, front and rear direction-indicator lamps and at design speed above 6 km / h also brake lights), which shall comply with a specific regulation by their position and colour. 12a)
12a) Decree No 341 / 2002 Coll., on the approval of technical competence and on technical conditions for the operation of vehicles on the road. '.
3. In Paragraph 40, paragraph 12 is added:
"(12) The permit referred to in paragraph 11 may also include the condition of the accompanying vehicle or other conditions to ensure the safety, continuity and protection of other traffic participants or the requirements given by the specific character of the vehicle (use of a portable set of lights, use of an orange warning device, etc.). The permit shall also provide for the condition that self-propelled machinery or tractor trailers which are not fitted with tyres shall be so fitted when driving on the road as to avoid road damage and that the equipment carried shall be so secured that their towing cannot take place after communication. '
This Decree shall take effect on 1 January 2003.
