amending and supplementing the Order of the Czech Labour Safety Authority and of the Czech Mining Office No. 21 / 1979 Coll., determining reserved gas installations and laying down certain conditions to ensure their safety
The Czech Labour Safety Authority pursuant to § 5 (1) (d) and (f) of Act No. 174 / 1968 Coll., on State Professional Safety Supervision, in agreement with the relevant Central Authorities and the Czech Mining Authority pursuant to § 6 (6) (a) of the Czech National Council Act No. 61 / 1988 Coll., on Mining Activities, Explosives and State Mining Administration, provides:
The Order of the Czech Labour Safety Authority and the Czech Mining Authority No. 21 / 1979 Coll., which determines reserved gas installations and lays down certain conditions for their safety, is amended and supplemented as follows:
Article 1 (1) reads as follows:
"(1) The decree shall be binding on organisations which are subject to the competence of the national professional safety oversight bodies (1) for organisations which carry out activities subject to the top supervision of the authorities of the State Mining Administration (2) and for legal and natural persons who carry out business activities under the Specific Regulations (5) (hereinafter referred to as" organisations'). '.
2. In Paragraph 3 (1), the word "and tests' shall be inserted after the word" revision '.
3. In Article 3 (2), the words "permanent residence 'shall be inserted after the words" registered office' and the words "evidenced by the opinion of its superior authority 'shall be deleted.
4. the following paragraphs 8, 9 and 10 are added:
"(8) The production or assembly organisation shall notify in writing to the supervisory authority responsible for the location of the installation at least 15 days in advance of the location and the duration of the tests6)
(a) for the extraction and underground storage of gas in natural rock structures, including in-depth extraction probes;
(b) gas filling pressure vessels;
(c) compression and control stations with high and very high pressure;
(d) for the distribution of gases with high and very high pressure;
(e) for the consumption of gases by combustion with individual output above 3,5 MW;
(f) the production of flammable gases with an individual output exceeding 5 m3 / h;
(g) for the production of oxygen with a unit power exceeding 1500 m3 / h.
(9) The equipment referred to in paragraph 8 may be submitted by the production or assembly organisation to the customer only after a successful test of the equipment confirmed by the supervisory authority.
(10) In the case of imported equipment, the customer organisation shall ensure compliance with the obligations referred to in paragraphs 8 and 9. ';

The revision technician shall have a certificate of competence issued by the supervisory authority in order to carry out the revisions and tests of the equipment. ';
6. In Article 5 (2), the words "a comic test once every three years' are replaced by the words" a revision technician having a valid certificate of competence of the relevant type and scope once every three years'.
7. In Article 5 (5), the words "Comprehensive testing and checking 'are replaced by" Testing and checking by a revision technician'.
8. In Paragraph 5, paragraphs 3 and 4 are deleted and paragraph 5 becomes paragraph 3.
9. in Paragraph 6 (1), the word "workers" shall be deleted.
10. Article 6 (2) reads as follows:
"(2) The installation of other equipment may be entrusted only to persons who have been informed within the scope of their activities of the installation rules and training. They must be familiar with the relevant regulations and have at least one year of professional experience, meaning practical activity on equipment of the species concerned and must pass examinations with the supervisory authority. ';
This decree shall take effect on the day of its publication.
