on the conditions, model and guidelines for drawing up the hunting plan
The Ministry of Agriculture provides pursuant to Article 36 (6) of Act No. 449 / 2001 Coll., on hunting, as amended by Act No. 59 / 2003 Coll., hereinafter referred to as "the Act":
Conditions for drawing up a plan
§ 1
Hunger hunting plan
(1) The hunting plan (hereinafter referred to as the plan) is a written plan by the hunting user, as will be the hunting activity from 1 April to 31 March of the following year (hereinafter referred to as the marketing year). The plan shall include the objectives of the hunting user ensuring the protection of game, targeted breeding and hunting, including the development stages of game.
(2) The plan may consist of the following parts depending on the nature of the chase:
(a) a breeding and hunting plan for cloven-hoofed game (model form is set out in Annex 1);
(b) small game farming and hunting plan (model form is given in Annex 2);
(c) plan for hunting other species of game (model form is given in Annex 3);
(d) animal care plan (model form is given in Annex 4),
(e) a plan for common game hunting (model form is set out in Annex 5); and
(f) a plan for the number of hunting dogs (model form is given in Annex 6).
(3) The Annex to the plan, depending on the nature of the chase, shall include in particular:
(a) the results of the animal census (the model form is given in Annex 7);
(b) a monthly report on the implementation of the plan (Section 36 (4) of the Act) (model form is given in Annex 8);
(c) records of the amount of damage caused by animals in the previous period on forest and agricultural crops;
(d) the results of the comparison of control and comparison areas;
(e) a comparison of the plan drawn up with the intentions set out in the proposal for recognition of the handjob; and
(f) the conclusions and recommendations for the management of game in the field of breeding drawn up by the State Hunting Authority, which defined the relevant area of game farming (Section 36 (2) of the Act),
supported by appropriate documents.
(4) The user of the hunt shall note in the plan if, within a period of at least 15 days before the date for processing the relevant part of the plan, he does not communicate the results of the comparison of the control and comparison areas, he does not report the damage caused by game on forest and agricultural crops for the previous year and he does not report the intention in the application for recognition of the hunting. The user would also note in the plan if the authority of the State Hunting Administration, which has defined the area of farming in question, does not communicate the conclusions and recommendations to him in the case of hunting that has been included in that area.
(5) For the purposes of this decree:
(a) cloven-hoofed game - European deer, spotted deer, muflon, deer, mountain deer, white-tailed deer, Sik of Dybowski, Sika of Japan, wild pig,
(b) small game - field hare, pheasant, royal pheasant, wild duck of choice, wild turkey,
(c) rare and endangered species of game - partridges of the field, cranes of the forest, grouse of the deaf, tetras of the species;
d) other species of game - wild rabbit, wild pigeon, white goose, wild goose, wild goose, wild duck, if it does not come from an elective breed, black lynx, white pollack, large pollack.
§ 2
Animal species and dates for drawing up a plan
(1) The plan shall be drawn up annually by a wanton user in accordance with specific legislation1), 2)
(a) for all species of game for which the game or part of game has been included in the quality classes and for which minimum and standardised game states have been established and quality classes of game or parts thereof have been determined;
(b) for the following species which it intends to hunt: wild rabbit, royal pheasant, wild pigeon, white-headed goose, wild goose, wild duck, wild duck, wild duck, black lynx, black pollack, wild pollack, wild duck,
(c) for all species of game which it intends to release into the chase (Section 5 (2) of the Act),
(d) for rare and endangered species of game.
(2) The common game hunting plan is only drawn up for field hares, pheasant, royal pheasant, big goose, field goose, white goose, wild duck and wild turkey.
(3) The plan is drawn up for the marketing year, except for piglets and wild boar and wild turkey, for which the plan is drawn up from 25 April to 24 April of the following year.
(4) The different parts of the plan shall be drawn up:
(a) until 25 April for the breeding and hunting plan for cloven-hoofed game, the animal care plan and the number of hunting dogs;
(b) by 25 July in the plan for the hunting of other species of game and the plan for the breeding and hunting of small game and the plan for the joint hunting of game.
§ 3
(1) The assessment of the overall state of the ecosystem shall be based on a comparison of the actual and target state of the ecosystem. Following this assessment, the game hunting plan shall be adapted so that the actual numbers of the game after the catch is made move between the minimum and standard states (Section 3 (2) of the Act) closer to the threshold which is to correspond to the target state of the ecosystem. If Article 1 (3) is complied with, the results of this comparison shall not be taken into account if such data are not demonstrably known to the user.
(2) According to the result of the comparison (1) of the control and comparison areas, the plan for hunting game shall be adjusted so that the actual numbers of the game after the catch is taken are between the minimum and the standard stocks at a level corresponding to the guaranteed forest growth (4). If Article 1 (3) (d) is complied with, the results of this comparison shall not be taken into account unless such data are demonstrably known to the user.
(3) On the basis of data on the amount of damage caused by the game in the previous period on forest and agricultural crops, the plan for hunting shall be adapted so that the actual numbers of the game after the catch are between minimum and standard levels which will not cause disproportionate damage to forest and agricultural crops. If Article 1 (3) (c) is complied with, the amount of damage in the previous period on forest and agricultural crops shall not be taken into account if the user is not demonstrably aware of the fact that such damage has occurred during the previous period.
(4) In the case of hunting, which is included in the field of game farming, the conclusions and recommendations of the State hunting authority defined by the area of breeding concerned shall be taken into account if the users of the hunt are demonstrably known (3).
§ 4
(1) Unless otherwise specified, the plan shall indicate the number of game, hunting gear and hunting dogs in pieces, the area of hunting in whole hectares.
(2) For the purposes of drawing up plans, the males of the following species of game shall be divided into three ages each time as follows:
(a) European deer (members of the genus Cervus):
deer aged from 1 year to 4 years - 1st age class,
deer aged from 5 to 8 years - 2nd age class; and
deer aged 9 and over - 3rd age class,
(b) spotted tanker:
Taxes aged from 1 year to 3 years - 1st age class
tax from 4 to 6 years old - 2nd age class; and
tax from 7 years of age and above - 3rd age class,
(c) Muflon:
Muflon aged from 1 year to 3 years - 1st age class
Muflon aged 4 to 6 years - 2nd age class; and
Muflon aged from 7 years and above - 3rd age class,
(d) deer:
deer aged from 10 months to 2 years - 1st age class,
deer aged 3 to 4 years - 2nd age class; and
deer aged from 5 years and over - 3rd age class,
(e) mountain camels:
Camel aged from 1 year to 3 years - 1st age class,
camels aged 4 to 7 years - 2nd age class; and
Camel from 8 years old and over - 3rd age class,
(f) white-tailed deer:
deer aged from 1 year to 3 years - 1st age class,
deer aged 4 to 6 years - 2nd age class; and
deer aged from 7 years and over - 3rd age class,
(g) Sik of Dybowski:
deer aged from 1 year to 4 years - 1st age class,
deer aged from 5 to 8 years - 2nd age class; and
deer aged 9 and over - 3rd age class,
(h) Japanese sika:
deer aged from 1 year to 4 years - 1st age class,
deer aged from 5 to 8 years - 2nd age class; and
deer aged 9 and over - 3rd age class,
(i) wild swine:
Yank aged from 1 to 2 years (longhorn) - Class I,
yaw aged from 3 to 4 years - 2nd age class and
yum from 5 years old and over - 3rd age class.
(3) In the framework of an approved hunting plan, the hunting of male and female animals of a given species is planned for the modification of animal numbers, the removal of which from the population will lead to the maintenance of the natural quality of the game gene pool and to a targeted increase in the breeding quality of the game (§ 3 (1) of the Act).
§ 5
Efficacy
This Decree shall take effect on 1 January 2005.
