DECLARATION
of 16 December 2002
laying down the values of the specific emission limits for pollutants, the central regulatory order and the manner in which it is to be operated, including a list of stationary sources subject to regulation, the principles for drawing up and operating regional and local regulatory regulations and the manner and extent of making available information on the level of air pollution to the public
According to Section 55 (3) of Act No. 86 / 2002 Coll., on Air Protection and on the amendment of certain other laws (Air Protection Act), ("the Act '), the Ministry of the Environment provides for the implementation of Sections 8 (12) and 36 (5) of the Act:
§ 1
Subject matter
This decree sets out the values of the specific limit of imitation pollutants, the central regulatory order and the manner in which it is to be operated, including a list of stationary sources subject to regulation, the principles for the development and operation of regional and local regulatory regulations and the manner and extent of making available information on the level of air pollution to the public in accordance with European Community law. 1)
§ 2
Basic concepts
For the purposes of this decree:
(a) the regulatory rules - a set of measures referred to in Annexes 2 and 3, including warnings or warnings to the public and measures for the time-limited regulation of air pollution sources by their operators, which are involved in air pollution in a decisive way;
(b) the management centre - the legal person set up by the Ministry of the Environment (hereinafter referred to as "Ministry") and the authorities of the regions (hereinafter referred to as "regional authorities") and the authorities of the municipalities (hereinafter referred to as "municipalities"), which declare a warning signal in the event of a smog situation (hereinafter referred to as "warning signal"), a signal in the event of a smog situation (hereinafter referred to as "warning signal"),
(c) suspended PM10 particles - particles that pass through a size-selective input filter showing a 50% aerodynamic mean of 10 µm separation efficiency.
§ 3
Special imitation limits
(1) The specific imitation limits are declared for sulphur dioxide, nitrogen dioxide, suspended particles PM10 and tropospheric ozone. The summary and the values of the special imitation limits are set out in Annex 1.
(2) In the event of the specific imitation limits being exceeded, the air protection authorities shall act in accordance with the central regulatory rules, regional and local regulatory rules set out in Annexes 2 and 3.
§ 4
Central, Regional and Local Regulatory Regulations
(1) The Central, Regional and Local Regulatory Regulations are based on:
(a) a set of information on the location and parameters of sources of air pollution, on air pollution derived from automated measuring network data and on the state of dispersion conditions; and
(b) forecasts of dispersion conditions.
Such regulatory arrangements shall be operated on the basis of two-stage signals for the preparation or initiation of regulatory measures and warnings. A lower-level signal is a warning signal. A higher level signal is a control signal and a warning signal.
(2) The binding texts of the announcement and withdrawal of warning, warning and regulation signals are set out in Annex 4. The information to be communicated to the public when the warning signal, the warning signal and the control signal are announced shall be as set out in Annex 5.
(3) The central regulatory order and the principles of the development and operation of regional and local regulatory rules under Article 8 (5) and (6) of the Act are set out in Annexes 2 and 3.
(4) The legal person set up by the Ministry shall ensure the central collection and processing of data and forecasts on air pollution by means of data from an automated measuring network and the state and forecast of dispersion conditions.
§ 5
Information to the public
(1) Current information on the level of air pollution (Section 36 (5) of the Act) in order to protect human health is made available by a legal person established by the Ministry at least once a day in an appropriate way, such as radio, television, press, publications, computer networks and other mass media.
(2) The information referred to in paragraph 1 shall mean information on the level of pollution by sulphur dioxide, nitrogen dioxide and nitrogen oxides, suspended by PM10 particles, tropospheric ozone and carbon monoxide.
(3) Information on air pollution by sulphur dioxide, nitrogen dioxide, suspended PM10 particles and tropospheric ozone is made available to the public once an hour.
(4) Information on the level of pollution by benzene and ammonia as referred to in paragraph 1 shall be made available at least once a month and information on the level of pollution by lead and cadmium every 3 months.
(5) Information on air pollution by substances other than those referred to in paragraphs 2 to 4 is made available to the public once a month in the event of the annual limits being exceeded, in other cases once a year.
(6) The Ministry or the legal person established by it publishes the level of excess of the limit of imitation, the target limit and the long-term objective for tropospheric ozone (2), both in terms of protection of human health and in terms of protection of vegetation. In addition, it shall be made public that the special imitation limits are exceeded for the purpose of announcing warning signals, warning signals and control signals.
§ 6
Efficacy
This decree shall take effect on the day of its publication.

1. The warning signal follows

Central regulatory order and how it is operated
The release of warning signals, warning signals and control signals to designated sources of air pollution shall be ensured continuously:
(a) during the period from 1.10 to 31.3 of the following year, in the case of exceeding the specific limit of imitation for sulphur dioxide and nitrogen dioxide
(b) year-on-year in the event of exceeding the special imitation limit for suspended PM10 particles
(c) during the period from 1 April to 30 September calendar year, in the event of a special limit of imitation for tropospheric ozone being exceeded.
The territorial scope of the central regulatory order for the issuing of a warning signal and a regulation signal when the specific limits for sulphur dioxide, nitrogen dioxide or suspended particles of PM10 are exceeded applies to the whole territory of the Czech Republic.
1. Conditions for announcing and withdrawing the signals of the Central Regulatory Authority
1.1. The central regulatory system management centre is a legal entity established by the Ministry.
1.2. The regulation under the central regulatory rules shall be subject to stationary resources at the following establishments when the specific limit of imitation is exceeded:

Note: Changes in the name of the establishments listed in the Annex to this Decree that occur after its effective date and where the operation of the source is maintained shall not be taken into account.
1.3. The warning signal when the specific limit of imitation for sulphur dioxide, nitrogen dioxide or suspended particles of PM10 is exceeded shall be issued by the Ministry through the legal person established by it for the designated territory and premises and transmitted to the competent authorities and to the persons referred to in point 4, where the smog situation has been predicted or adverse dispersal conditions have been identified, the continued duration of which has been predicted and occurred.
(a) to exceed the hourly average concentration of sulphur dioxide of 250 μg.m-3 in three consecutive hours;
(b) to exceed the hourly average concentration of nitrogen dioxide of 200 μg.m-3 in three consecutive hours; or
(c) to exceed the 24 hour diameter of the concentration of suspended particles PM10 100 μg.m-3;
where the trend of hourly concentrations of those pollutants for which a special imitation limit has been exceeded is representative of the demarcated area in at least one measuring station during the last 6 hours and it is assumed that this imitation situation will last for at least 8 hours thereafter.
Concentration trends shall be evaluated for sulphur dioxide and nitrogen dioxide from the hourly concentration time series, for suspended PM10 particles from the time series of moving 12-hour averages of hourly concentrations.
The list of measuring stations representative of the specific demarcated area, including the list of establishments referred to in point 1.2, which affect the signal announcement at the relevant measuring station for which the signal will be declared, is set out in the MŽP Bulletin.
1.4. The regulatory signal, when the specific limit of imitation for sulphur dioxide, nitrogen dioxide or suspended particles of PM10 is exceeded, shall be declared by the Ministry through the legal person established by it for the designated territory and premises and transmitted to the competent authorities and to the persons referred to in point 4 where adverse dispersion conditions have been identified, the duration of which has been foreseen and the duration of the measures taken;
(a) to exceed the hourly average concentration of sulphur dioxide of 500 μg.m-3 in three consecutive hours;
(b) to exceed the hourly average concentration of nitrogen dioxide of 400 μg.m-3 in three consecutive hours; or
(c) to exceed the 24 hour average concentration of suspended particles PM10 150 μg.m-3;
where the trend of hourly concentrations of those pollutants for which a special imitation limit has been exceeded is representative of the demarcated area in at least one measuring station during the last 6 hours and it is assumed that this imitation situation will last for at least 8 hours thereafter.
Concentration trends shall be evaluated for sulphur dioxide and nitrogen dioxide from the hourly concentration time series, for suspended PM10 particles from the time series of moving 12-hour averages of hourly concentrations.
The list of measuring stations representative of the specific demarcated area, including the list of establishments referred to in point 1.2, which affect the signal announcement at the relevant measuring station for which the signal will be declared, is set out in the MŽP Bulletin.
1.5. The signal of warning when the special imitation limit for tropospheric ozone has been exceeded shall be announced by the Ministry through the legal person established by it for the territory of the county and transmitted to the competent authorities and persons referred to in point 5, where the smog situation has been predicted or weather conditions have been identified, their continued duration has been predicted and the hourly average of the tropospheric ozone concentration has been exceeded 180 μg.m-3 to 1 station representative of the region in three consecutive hours.
1.6. The warning signal when the special imitation limit for tropospheric ozone is exceeded shall be declared by the Ministry through the legal person established by it for the territory of the county and transmitted to the competent authorities and persons referred to in point 5 in the event that the smog situation has occurred and the hourly average of the tropospheric ozone concentration 240 μg.m-3 has been exceeded at 1 station representative of the region in three consecutive hours.
1.7. The warning signal, warning signal or regulation signal shall be withdrawn by the Ministry through the legal person established by it in the event that the following conditions apply:
1.7.1. no measurement station representative of the demarcated area is exceeded by the relevant specific imision limit, which shall continue continuously for at least 12 hours in the case of sulphur dioxide, nitrogen dioxide and tropospheric ozone, or 24 hours in the case of suspended PM10 particles, and shall not be expected, on the basis of meteorological forecasts, to re-establish weather conditions that underpin the smog situation within 48 hours following a decrease in concentrations below the special imitation limits;
1.7.2. the 12-hour time interval in the case of sulphur dioxide, nitrogen dioxide and tropospheric ozone shall be reduced to 3 hours in the case of weather conditions which cannot be referred to as a conditioning smog situation and, according to the meteorological forecast, it is almost impossible that such conditions will occur again within the next 48 hours.
1.8. In case of exceeding the special imitation limit for suspended PM10 particles, only measures to regulate those stationary sources which are landfills of fuels or ash or coal and which are operated in connection with the operation of particularly large combustion sources shall be applied in the plants referred to in point 1.2. The measures are mainly aimed at reducing the emissions of suspended PM10 particles and their re-swirling.
2. Procedure for announcing and withdrawing signals of the Central Regulatory Order
2.1. If, following an assessment of the meteorological and mimic situation, the control centre declares or withdraws a signal of regulation for sulphur dioxide, nitrogen dioxide or suspended particles PM10 for the defined territory, it shall immediately communicate this to the competent authorities and to the persons referred to in point 4.
2.2. If, following an assessment of the meteorological and imitation situation, the control station declares or withdraws a warning signal or warning signal for tropospheric ozone, it shall immediately communicate this to the competent authorities and persons referred to in point 5.
2.3. Following the announcement of the regulatory signal, operators of stationary sources subject to regulation under the central regulatory rules shall implement measures in accordance with the regulatory rules, drawn up pursuant to Article 11 (1) (h) of the Act and approved under Article 46 (1) (l) of the Act. Upon withdrawal of the regulatory signal, the source operator shall cease to fulfil the obligations laid down in the relevant regulatory rules.
2.4. Information on the announcement and withdrawal of signals is transmitted to the control station by e-mail and telephone.
2.5. The binding texts for the announcement and withdrawal of the warning signal, the regulation signal and the warning signal sent by e-mail are set out in Annex 4 to this decree and must be sent from the address of the legal entity established by the Ministry.
3. Public information
In the event of the announcement of a warning or a regulation signal when the special imitation limit for sulphur dioxide, nitrogen dioxide or suspended PM10 is exceeded, the legal person set up by the Ministry shall issue information to the public. The information to be communicated to the public is set out in Part A of Annex 5 to this Decree.
In the event of a notification of a warning signal or a warning signal when the special imitation limit for tropospheric ozone is exceeded, the legal person set up by the Ministry shall issue information to the public. The information to be communicated to the public is set out in Part B of Annex 5 to this Decree.
