DECLARATION
of 20 October 2004
on the transfer of personal and other data to the National Health Information System for the purpose of maintaining national health registers
The Ministry of Health provides pursuant to § 67e (2) (a) to (c) of Act No. 20 / 1966 Coll., on the Care of People, as amended by Act No. 156 / 2004 Coll.:
(1) The medical establishment shall transmit the required personal and other data to the National Health Information System for registry management purposes (hereinafter referred to as "data") in electronic form according to the mandatory standard for the registry (1).
(a) data messages with a secure data transfer protocol through remote access to a designated electronic address on a public data network; or
(b) the data file on the data medium, in person or through the holder of the postal licence, which shall provide the consignor with a certificate proving the delivery of the postal consignment (2).
(2) In exceptional cases, in agreement with the administrator of the National Health Information System, health care institutions may transmit data in paper form in accordance with the procedure referred to in paragraph 1 (b).
(3) The heading of the health establishments transmitting data, periodicity and transmission deadlines are set out in the Annex to this Decree.
Decree No. 470 / 2003 Coll., determining the scope and manner of the provision of information by medical institutions to the National Health Information System, is hereby repealed.
This decree shall take effect on the day of its publication.

Annex to Decree No 552 / 2004 Coll.
Regiment of medical devices transferring the required personal and other data to the National Health Information System for the needs of national health registers, periodicity and transmission deadlines
1. National Cancer Registry
1.1. The heading of the medical devices transmitting the data:
Any medical institution that has established a diagnosis and any medical institution responsible for the treatment and dispensarisation of the disease group's diagnosis of malignant neoplasms (codes C00 - C97 according to the International Statistical Classification of Diseases and Associated Health Problems as amended by 10 Revision (hereinafter referred to as "MKN-10 ')), 3), a disease assessed as neoplasms in situ (MKN-10: codeD00 - D09) and neoplasms of uncertain or unknown behaviour (MKN- 10: codes D37 - D48).
1.2. Periodicity and transmission deadlines:
Data relating to the newly diagnosed disease shall be transmitted within 30 days of diagnosis; treatment and dispenzarisation data are transmitted over 1, 2, 3, 4, 5, 7, 10 years of dispenserisation and further at intervals of 5 years and in the event of death.
2. National Hospital Register
2.1. The heading of the medical devices transmitting the data:
Every health care facility with the exception of spa treatments and recovery facilities in which the provision of constitutional care to the patient was terminated.
2.2. Periodicity and transmission deadlines:
Data shall be transmitted on completion of hospitalisation for each calendar month by the end of the following calendar month.
3. National Register of Parents
3.1. Heading of the health care establishments submitting the data:
Any health care facility in which birth has occurred or which has performed postpartum care on the mother.
3.2. Periodicity and transmission deadlines:
Data shall be transmitted after release from the medical establishment for each calendar month by the end of the following calendar month.
4. National Register of Newborns
4.1. The heading of the medical devices transmitting the data:
Any health care facility that carried out childbirth or in which the newborn was provided with constitutional care.
4.2. Periodicity and transmission deadlines:
Data shall be transmitted after release from the medical establishment for each calendar month by the end of the following calendar month.
5. National register of congenital defects
5.1. Heading of health care establishments transmitting data:
Any medical facility in which a birth defect in the fetus or child has been diagnosed.
5.2. Periodicity and transmission deadlines:
For each calendar month, by the end of the following calendar month.
6. Register of doctors, dentists and pharmacists
6.1. The heading of the medical devices transmitting the data:
Any medical institution to which a doctor, dental practitioner or pharmacist has an occupational or similar relationship, as well as any doctor, dental practitioner or pharmacist who provides medical care on his own behalf on the basis of a registration under a specific legislation. 5)
6.2. Periodicity and transmission deadlines:
Once per calendar year, the status of the data at 31 December by 10 March of the following calendar year.
7. National Abort Register
7.1. The heading of the medical devices transmitting the data:
Any medical institution in which the abortion was carried out or in which the woman was given medical care in connection with the abortion.
7.2. Periodicity and transmission deadlines:
For each calendar month, by the 10th day of the following calendar month.
8. National Registry of Vascular Surgery
8.1. The heading of the medical devices transmitting the data:
Every medical facility in which the patient has had a vascular reconstruction operation.
8.2. Periodicity and transmission deadlines:
Data shall be transmitted within 30 days of the end of the constitutional care provided to the patient who has had a vascular reconstruction operation.
9. National Cardiothoracic Register
9.1. Heading of health care establishments transmitting data:
Every medical facility where the patient had a cardiac surgery.
9.2. Periodicity and transmission deadlines:
Data shall be transmitted within 30 days of the end of constitutional care provided to the patient undergoing cardiac surgery.
10. National register of joint compensation
10.1. The heading of the medical devices transmitting the data:
Any medical facility where the patient was implanted with an artificial joint replacement.
10.2. Periodicity and transmission deadlines:
The data shall be transmitted within 30 days of the end of the constitutional care provided to the patient who has been implanted with an artificial joint replacement.
11. National Register of Occupational Diseases
11.1. The heading of the medical devices transmitting the data:
Any medical establishment competent under a specific legislation for the recognition of an occupational disease. 6)
11.2. Periodicity and transmission deadlines:
The data for each recognised occupational disease and occupational disease threat shall be transmitted by the 10th day of the following calendar month in which the opinion on the recognition of an occupational disease or the threat of an occupational disease in force or the decision on it became final.
12. National registry of cardiovascular interventions
12.1. The heading of the medical devices transmitting the data:
Any medical facility in which the patient has had cardiovascular intervention.
12.2. Periodicity and transmission deadlines:
Data shall be transmitted to the patient within 30 days of cardiovascular intervention.
13. National register of users of medically indicated substitution substances
13.1. The heading of the medical devices transmitting the data:
Any medical facility providing substitution treatment, with the consent of the patient.
13.2. Periodicity and transmission deadlines:
Data shall be transmitted within 24 hours of the first dose of the substitution agent and within 24 hours of the end of or change in the substitution treatment.
