on the method of calculating the amount of damage or damage caused to forests
In agreement with the Ministry of Finance, the Ministry of Agriculture provides in accordance with § 21 paragraph 4 of Act No. 289 / 1995 Coll., on Forests and on the amendment and addition of certain laws (Forest Act):
INTRODUCTORY PROVISIONS
Subject matter
(1) This Decree sets out the method for calculating the amount of damage or damage ("damage ') arising from:
(a) on forest land due to:
1. permanent withdrawal or permanent limitation of the performance of the wood production function of the forest (hereinafter referred to as the "production function"),
2. temporary withdrawal or temporary restriction on the performance of the production function;
3. permanent damage to the performance of the production function,
4. temporary impairment of the production function,
(b) on forestry as a result
1. destruction of forest land,
2. early forest rotation,
3. reduction of forest growth;
4. reduction of forest production,
5. reduction of forest quality,
6. Wood-to-board theft,
(c) exceptional and cost-intensive forest management measures.
(2) The Decree does not apply to the calculation of the amount of damage to objects and facilities serving forestry.
(3) The decree does not apply to the calculation of the amount of damage to products except wood, in particular to Christmas trees from Christmas trees plantations, to forest reproductive material, to recognised sources of reproductive material1) or to raw wood products produced.
(1) The total damage is calculated as the sum of the individual damage.
(2) For the purposes of this Order, the amount of individual damage shall be determined using the following formulae and the result shall be rounded up to the nearest crown.
(3) For the purposes of this Decree, the table values of forest land at age and (Thlpa) for the purposes of inclusion of 1,0 by group of forest trees, bonito and the age of the crop shall be determined in accordance with Annex 1. The values of forest land at age and (hereinafter "Hlpa ') in each sample shall be calculated by multiplying Thlpa by the value of the current log of forest land, adjusted, where appropriate, by the premium and precipitation referred to in Annex 2 with the justification and multiplied by the area of the wood group in m2 for which the damage occurred.
(4) Individual forest trees shall be grouped into specified groups of timber as set out in Annex 3.
(5) Data on sets of forest types, the degree of damage to forest plantations (5), the representation of forest crops (grassland group), their age, bonites and linkages shall be found from the forestry plan or the forestry economic2) or from the forest development plans (3) and shall be verified, adjusted where appropriate, to the actual situation. The conversion table of the bonite grades of forest trees is set out in Annex 10 to this Decree. In the case of differences between the relative creditworthiness listed in the forestry plan or forest economic curriculum and the result of the transfer referred to in Annex 10 to this Decree, the values of the relative creditworthiness of that annex shall apply.
(6) The washing shall be taken from the forest economic plan or the forestry economy.2) If the actual age of the group of trees in the crop (grassland) or washing is higher than the maximum washing of the group of trees listed in Annex 3, the maximum values of this Annex shall apply.
(7) The amount of damage caused by imimism may be determined under this decree for imitations for which an imitation limit is set for the protection of ecosystems and vegetation under another legislation8). At the same time, the amount of such damage can only be determined for the calendar year in which the limit for a particular pollutant has been exceeded in accordance with another legislation8).
CALCULATION OF SCHOOLS
CALCULATION OF SCHOOL HIGHTS AT FOREIGN POINT
Damage to permanent withdrawal or permanent restriction of performance of the production function
Damage from permanent withdrawal or permanent limitation of performance of the production function shall be calculated on a one-off basis according to the formula
S1 = 1-K0,02,
where
S1 = damage from permanent withdrawal or permanent limitation of performance of production function,
r = the total potential annual forest rent to be determined as a weighted arithmetic average according to the potential annual forest rent of the area-dominant sets of forest types in the lowest spatial distribution unit specified for each set of forest types in Annex 4,
K = Coefficient of the scope of the restriction to be determined as a proportion of the limited performance of the forest production function and the normal performance of the forest production function.
Damage to temporary withdrawal or temporary restriction of production function
The damage to the temporary withdrawal or temporary limitation of the performance of the production function shall be calculated according to the formula:
S2 = r.1-K,
where
S2 = annual damage from temporary withdrawal or temporary restriction on the performance of the production function,
r = the total potential annual forest rent to be determined as a weighted arithmetic average according to the potential annual forest rent of the area-dominant sets of forest types in the lowest spatial distribution unit specified for each set of forest types in Annex 4,
K = Coefficient of the scope of the restriction to be determined as a proportion of the limited performance of the forest production function and the normal performance of the forest production function.
Damage to permanent damage to the performance of the production function
The damage to the permanent deterioration of the performance of the production function is calculated on a one-off basis according to the formula
S3 = rSLT1-rSLT20,02,
where
S3 = damage from permanent damage to the performance of the production function,
rSLT1 = the total potential annual forest rent for the original set of forest types to be determined as a weighted arithmetic average according to the potential annual forest rent of the original area-dominant forest-type sets in the lowest spatial distribution unit specified for each forest-type set in Annex 4,
rSLT2 = total potential annual forest rent for a modified set of forest types, which is determined as a weighted arithmetic average according to the potential annual forest rent of changed area-dominated forest types in the lowest spatial distribution unit of the forest, as specified for each set of forest types in Annex 4.
Damage to temporary damage to performance of production function
The damage caused by temporary deterioration in the performance of the production function is calculated using the formula
S4 = rSLT1-rSLT2,
where
S4 = annual damage from temporary damage to the production function,
rSLT1 = the total potential annual forest rent for the original set of forest types to be determined as a weighted arithmetic average according to the potential annual forest rent of the original area-dominant forest-type sets in the lowest spatial distribution unit specified for each forest-type set in Annex 4,
rSLT2 = total potential annual forest rent for a temporarily modified set of forest types, which shall be determined as a weighted arithmetic average according to the potential annual forest rent of the temporary area-dominant forest-type sets in the lowest spatial distribution unit used, as specified for each forest-type set in Annex 4.
CALCULATION OF HIGH SCHOOL FOR FOREIGN GROUND
Damage to early forest washing
The damage from early forest washing is calculated on a one-off basis according to the formula
S5 = Hlpa. Mn / 100,
where
S5 = damage from premature forest washing,
Hlpa = value of forest crop in the year of early forest crop washing,
Mn = percentage of toll maturity to be determined in accordance with Annex 5.
Damage to the destruction of forest land
(1) Damage from forest destruction is calculated on a one-off basis according to the formula
S6 = Hlpa-Aa,
where
S6 = damage to forest land,
Hlpa = value of forest crop before destruction,
A = the value of the toll yield equal to the difference between the yield from the sale of timber and the full own costs of extraction and concentration of timber from destroyed forest land calculated according to the formula
Aa = Hm.Cs-Tn,
where
Hm = wood volume by wood and assortment in m3,
Cs = price of raw wood at the point of departure in CZK / m3, determined according to special regulation, 4)
Tn = cost-effective total own costs of mining and concentrating timber after the departure point in CZK / m3.
(2) In calculating the damage referred to in paragraph 1, the damage caused by early forest washing under Section 7 shall not be calculated separately.
Damage to reduce forest growth
(1) The damage from the reduction in the growth rate for forests up to and including 5 years of age is calculated using the formula
S7.1.1 = Z.1-K1,
where
S7.1.1 = annual damage from the reduction of the growth rate for forests up to and including 5 years of age,
Z = the value of the annual increase by group of timber as set out in Annex 6,
K1 = coefficient expressing the ratio of damaged and healthy forest growth.
(2) The damage from the reduction in forest growth over 5 years of age is calculated using the formula
S7.1.2 = Hlpa + 1-Hlpa.1-K1,
where
S7.1.2 = annual damage from the reduction in forest growth over 5 years of age,
Hlpa + 1 = the value of the undamaged forest area in the following year after the damage (without application of precipitation according to the levels of damage) determined in accordance with Annex 1,
Hlpa = value of undamaged forest land in the year of damage (without application of precipitation according to the levels of damage) determined in accordance with Annex 1,
K1 = coefficient expressing the ratio of damaged and healthy forest growth.
(3) For damage caused by imimimi, the coefficient K1 is given according to the degree of damage to the forests (5) in Annex 7. In the case of calculation of the amount of damage to more than one forest area, it is possible to proceed by creating sets of forest areas by groups of forest trees and levels of damage to forest areas. For such sets of forest crops, the arithmetic mean of the weighted area shall be calculated by means of average bonity, linkage, age, etc.
(4) The damage caused by the reduction in forest growth due to an animal or livestock sample is calculated using the formula:
S7.2 = Z.K2.Np / N,
where
S7.2 = annual damage from the reduction in forest growth due to a bit of animals or livestock,
Z = the value of the annual increase by group of timber referred to in Annex 6,
K2 = the coefficient expressing the damage to the degree of damage to be determined in accordance with Annex 8,
Np = number of damaged seedlings, up to a maximum of 1.3 times the minimum number, 6)
N = actual number of individuals up to a maximum of 1.3 times the minimum number. 6)
Damage to reduced forest production
(1) The damage from the reduction in forest production due to the replacement of trees is calculated using the formula
Sa = Hlpu1 / u2-Hlpu2 / u2,
where
S8 = annual damage from the reduction in forest production due to the substitution of timber,
Hlpu1 / u1 = value of average forest growth with target woodland composition (no precipitation),
Hlpu2 / u2 = value of the average toll growth of the forest with the current (confused or replacement) composition of timber (without application of precipitation).
(2) The reduction can only be applied in the case of low forest.
(3) Paragraphs 1 and 2 shall not apply where the reduction in forest production is due to the substitution of the trees resulting from the action of imitations.
Damage to the reduction of forest quality
(1) Damage caused by mechanical damage caused by peeling and gnawing of animals or clogging of wood, etc., is applied only once in each single tree and is calculated according to the formula

S9.1 = damage from the reduction of forest quality caused by mechanical damage caused by the peeling and the gnawing of animals or the approximation of wood, etc.,
Hlpu = the age of forest area determined according to Annex 1, reduced by the expected linkage at age of u,
K3 = coefficient set out in Annex 9,
n = washing at minus the age of the crop and at the time of damage,
Np = number of damaged trees,
N = total number of trees.
(2) Damage from the reduction of the quality of forest land caused by mechanical damage caused by peeling and animal or clotting, etc., is calculated provided that the continuous area of mechanical damage is greater than 25 cm2 or the damage exceeds 10% of the strain circumference. In the case of damage caused by mechanical damage to trees other than animal damage, the damage shall be reduced by up to 30% in the case of proven effective treatment with the appropriate product.
(3) The damage caused by damage to trees by fire, fire, imism, etc., is calculated using the formula

Hlpa = value of forest crop in year of damage,
Ks = coefficient to be determined as a proportion of the realised and usual cash in time and place of damage.
Damage to the forests of the economic method of selection
In the crops of the economic method of selection or in the areas close to the economic method of selection, the damage shall be determined on the basis of the classification of the forest into age groups according to this decree.
Damage caused by the theft of wood on a pin
The damage caused by the theft of wood on the board is calculated on a one-off basis according to the formula
S10 = Aa,

S10 = damage caused by theft of wood to the top,
A = the value of the stolen timber toll, calculated in accordance with § 8 (1).
CALCULATION OF THE HIGH SCHOOL SCHOOL OF INDIVIDUAL AND COST-COST OF NUCLEAR MEASURES
Damage to exceptional or more costly measures
(1) Damage from exceptional measures is calculated on a one-off basis according to the formula
S11.1 = Km,
where
S11.1 = damage from emergency measures,
Km = economically justified complete own costs of emergency measures.
(2) Damage from more cost-intensive measures is calculated on a one-off basis in accordance with the formula
S11.2 = Kz-Ko,
where
S11.2 = damage from more costly measures,
Kz = economically justified complete own costs of more costly measures,
Ko = economically justified complete own costs of the normal management method.
(3) In particular, forced meliorations (drainage, irrigation, fertilisation), revitalisation measures (spraying), anti-erosion measures, reconstruction of replacement crops, disclosure of damaged crops, construction of replacement roads, guarding and cleaning of fire sites, activities during an extended period to ensure a culture caused by, for example, animal consumption and imitation. This also includes the costs necessary to determine the level of damage, such as monitoring, biomonitoring or expert opinions.
(4) Cost-intensive measures are mainly the extraction of grassland along electrified railways.
FINAL PROVISIONS
Repeal
Decree No. 81 / 1996 Coll., on the method of calculating the amount of damage or damage caused to the production functions of the forest, is hereby repealed.
Efficacy
This decree shall take effect on the day of its publication.
