of 9 July 1963
on a single system of scientific research and development centres (scientific research and development base)
The National Assembly of the Czechoslovak Socialist Republic decided on this law:
Preliminary provisions
The targeted development of science and technology and the need to achieve full consistency with the fundamental needs of socialist society require the maximum concentration of the forces and resources spent. It is therefore necessary that the science and technology development workplaces form a unified system - a scientific research and development base.
Scope of the scientific research and development base
The scientific research and development base shall be composed of organisations and organisational bodies whose main tasks are tasks of a creative nature resulting from a science and technology development plan or tasks contributing to the development of science and technology. The scientific research and development base therefore includes:
a) Czechoslovak Academy of Sciences and Slovak Academy of Sciences,
(b) universities or their faculties to the extent specified by the Minister for Education and Culture (§ 4);
(c) research and development institutes and organisations managed by ministries, other central government bodies and national committees;
(d) research and development institutes and organisations forming part of production units;
(e) research and development services of organisations which are production units or parts thereof, as well as other services which primarily perform the tasks of the scientific and technological development plan;
(f) verification operations where they are included in the base by the State Commission for the Development and Coordination of Science and Technology;
(g) testing and control institutes managed by ministries and other central government bodies;
(h) institutes of scientific, technical and economic information managed by ministries and other central government bodies;
(i) other organisations or organisational bodies which carry out scientific and technological development tasks and which are included in the base by the State Commission for the Development and Coordination of Science and Technology.
Establishment of scientific research and development base components
The Czechoslovak Academy of Sciences and the Slovak Academy of Sciences sets up the Czechoslovak Academy of Sciences in an agreement with the State Commission for the Development and Coordination of Science and Technology.
(1) The extent to which universities or their faculties operate as components of a scientific research and development base is determined by the Minister for Education and Culture in agreement with the State Commission for the Development and Coordination of Science and Technology and the Czechoslovak Academy of Sciences.
(2) The scientific research institutes of universities are set up and their organisational forms are established by the Minister for Education and Culture. If these workplaces are specifically included in the scientific research and development base, they are established by the Minister of Education and Culture in an agreement with the State Commission for the Development and Coordination of Science and Technology and the Czechoslovak Academy of Sciences.
Research and development institutes and organisations [§ 2 (c) and (d)], test and control institutes [§ 2 (g)] and institutes of scientific, technological and economic information [§ 2 (h)] shall be established by the relevant ministers, other heads of central government bodies and regional national committees with the approval of the State Commission for the Development and Coordination of Science and Technology; the establishment of a research or development institute or organisation of a regional national committee shall also require the consent of the relevant minister or other head of the central administration.
Research, development and other services of organisations forming or forming part of production units [§ 2 (e)] shall be set up by the Director of the Production Unit within the framework of the Science and Technology Development Plan, with the agreement of the relevant Minister or other Head of Central Administration. If such a service is set up by the Director of the Production Economic Unit managed by the National Committee, the agreement of the Regional National Committee and the relevant Minister or other Head of the Central Administration shall be required.
The components of the scientific research and development base, managed by the ministries of national defence and interior, shall be established by the relevant ministers after consultation with the State Commission for the Development and Coordination of Science and Technology.
Verification operations [Paragraph 2 (f)] shall be set up by the directors of production units, with the agreement of the relevant Minister or other head of the Central Authority, after consulting the State Commission for the Development and Coordination of Science and Technology.
The procedure laid down for the establishment of components of the scientific research and development base shall apply mutatis mutandis to their abolition, merger, division or transfer into the field of competence of another authority.
Definition of the activities and organisation of the components of the scientific research and development base
(1) The State Commission for the Development and Coordination of Science and Technology sets out the principles of the Statutes of institutes and other separate organisations of the Scientific Research and Development Base.
(2) On the basis of the principles issued by the State Commission for the Development and Coordination of Science and Technology, the relevant Ministers and other Heads of Central Government Authorities and, where appropriate, the Regional National Committees shall issue standard statutes for organisations in their field of competence, which shall specify their legal status, organisation and scope of activity.
(3) The organisation of scientific research institutes of the Czechoslovak Academy of Sciences is governed by specific regulations.
Management of components of the scientific research and development base
(1) The State Commission for the Development and Coordination of Science and Technology is responsible for the excellent care of the proportional development and coordination of the scientific research and development base.
(2) The managers of the individual components of the scientific research and development base and their superior bodies are responsible for the comprehensive solution of research and development tasks at the highest achievable level.
Transitional and final provisions
The provisions of this Law shall apply to scientific research and development organisations established under international agreements, unless their status under the Agreement provides otherwise.
The State Commission on the Development and Coordination of Science and Technology sets out at the date of the entry into force of this Act, namely, which existing organisations and organisational bodies referred to in § 2 form part of the scientific research and development base.
Act No. 14 / 1955 Coll., on the establishment and abolition of research institutes, technical development services and research and experimental centres is hereby repealed.
This Act shall take effect on the day of its publication.
