the use and change of name and surname.
The National Assembly of the Czechoslovak Republic decided on the following Act:
Taking names and surnames.
(1) A citizen has the right and the obligation to use the names and surnames which he is registered in the matrix.
(2) If more than one name is entered in the matrix, the name given in the first place shall, in principle, be valid in official contact unless something else is derived from the matrix.
Change of name and surname.
A change of name or surname may be permitted at the request of the district national committee, provided that this is not hindered by the interest of the company and that there are reasons of particular concern.
If the spouses have a common surname, the request to change the surname of one spouse shall require the consent of the other. The authorised change of surname shall apply to both spouses and minors.
If parents have different surnames, the change in the surname of the parent whose surname they have or are intended to have minor children shall apply only if the other parent has given his consent; If they disagree, the court shall decide.
Transitional provisions.
Women who have entered into marriages before 1 January 1950 may use, in addition to the surname they acquired at the time of their marriage, or the place of that surname which they had before their marriage, if they are known by such surname in the public. However, this exception applies only to women who are notified within six months of the publication of this law to the district national committee of their residence, to whom or to which surnames and in what order they wish to use in future official contact.
Applications for the amendment of names or surnames which have not been legally decided before the date of application of this Act shall be assessed under this Act.
Criminal and final provisions.
Those who use the name or surname illegally in official contact will be punished, unless the offence is more strictly criminal, by the District National Committee, by a fine of up to 5 000 CZK or by a prison (lockdown) within seven days. In the event of non-availability of the fine, the replacement prison sentence (lockdown) shall also be determined according to the rate of guilt within seven days.
Requests to change the name or surname shall be exempt from the fee.
The Ministry of the Interior may issue by decree in the relevant official document more detailed provisions on the use of the name and surname, in particular in cases where more than one name is registered in the Registry, on the use of the surname in women married before 1 January 1950, as well as on the authorisation to change the name or surname.
(1) From the date of the entry into force of this Act, all the provisions governing the matter covered by this Act, in particular the Decree of the Court Office No. 36 / 1826 Coll., on the limitation of the change of birth name, and Act No. 31 / 1942 Coll. on Names and Surnames.
(2) The provisions of the Rules on Family Law, the Regulations on Matrices and the provisions of Act No. 21 / 1948 Coll.
This Act shall take effect on the 30th day following its publication; It shall be implemented by the Minister for the Interior in agreement with participating members of the Government.
