DECLARATION
of 2 December 2025
amending Decree No 240 / 2021 Coll., on the protection of agricultural land against erosion
The Ministry of the Environment provides pursuant to § 22 (1) (a) and (d) of Act No. 334 / 1992 Coll., on the Protection of the Agricultural Soil Fund, as amended by Act No. 41 / 2015 Coll. and Act No. 183 / 2024 Coll.:
Decree No 240 / 2021 Coll., on the protection of agricultural land against erosion, is amended as follows:
1. In the introductory sentence, the words "and Act No. 183 / 2024 Coll. 'shall be added at the end of the text.
2. In Article 1 (1), the words "erosion threat to the soil of aquatic erosion, the permissible rate of erosion threat to water erosion and the measures to reduce it 'are replaced by the words" erosion threat to the soil of water and wind erosion, the permissible rate of erosion threat to water and wind erosion and the procedure for its calculation, the measures to reduce it and the content of the plan of measures to reduce erosion pollution and the way in which it is prepared'.
3. In Article 2 (c), the words "enclosed by a distribution line on which surface effluent arises and the border where surface effluent is interrupted 'are deleted.
4. in Article 2 (c), the following points 1 and 2 are added:
"1. in the case of water erosion bounded by the distribution line on which the surface outflow occurs and the limit where the surface outflow is interrupted; or
2. in the case of wind erosion bounded by wind barriers, ';
5. in Article 2 (e), the words "or mechanical wind activity" shall be inserted after the word "events."
6. In Article 2 (f), the words "of the same species' shall be inserted after the word" event '.
7. in Article 2 (g):
"(g) wind barrier objects which slow the flow of air, in particular housing, forest, small forest units and vegetation barriers,."
8. In Paragraph 2 (i), the end of the dot is replaced by a comma.
9. in Article 2, the following points (j) and (k) are added:
"(j) the growing barrier of windmills, tree lines, shore vegetation and forest protection belt;
(k) a path of concentrated effluent instead of natural valleys with a contributing basin area of more than 5 ha, in which the concentration of surface effluent occurs and the possible formation of a higher form of water erosion, '.
10. in Article 2, the following point (l) is added:
"(l) by the windpipe, permanent woody vegetation of a linseed nature on both forest and non-forest land, planted to reduce wind effects and to protect agricultural land from erosion,"
11. in Article 2, the following point (m) is added:
"(m) by the offshore vegetation barrier consisting of trees growing on the banks of watercourses,"
12. in Article 2, the following point (n) is added:
"(n) forest protection zone of timber vegetation, planted on land intended to fulfil forest functions and to protect against wind erosion.";
13. in § 3 (d), the end of the dot is replaced by a comma.
14. in Article 3, the following point (e) is added:
"(e) soils situated in a 7,5 m wide band on each side of the centred outflow path."
15. in Article 4, the words "water erosion" shall be inserted after the word "threat."
16. In Article 4, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) The permissible rate of erosion threat to wind erosion is determined by the synthesis of soil characteristics, climatic characteristics, wind conditions and parameters of vegetation barriers, resulting in a code expression of the degree of threat, and is set out in Annex 1a to this Decree. ';
17. in Article 5 (1), the words "water erosion" shall be inserted after the word "soil."
18. In Paragraph 5 (1), the sentence "The assessment of the erosion threat to the agricultural land by wind erosion shall consist in the performance of an evaluation in an anti-erosion calculator in order to determine the level of erosion threat to the area under consideration in accordance with the procedure set out in Annex 3 to this Regulation. ';
19. in Article 5, the following paragraph 4 is inserted after paragraph 3:
"(4) If it is found that there have been changes in the parameters of the area under assessment which affect the assessment of the erosion threat, the definition of the area under assessment shall be revised. ';
Paragraph 4 shall become paragraph 5.
20. In Article 5, the following paragraph 5 is inserted after paragraph 4:
"(5) Where a change in the parameters of the area under assessment demonstrates that the threat to the agricultural land included in the plan of measures to reduce the erosion threat to the agricultural land of aquatic erosion (hereinafter referred to as" the plan of measures') has continuously fallen below the acceptable level of erosion threat to water erosion, or that the degree of risk to wind erosion is consistent with an unthreatened area, this shall be considered as a basis for the closure of the management under the plan of the measure or for the cessation of the obligation to apply measures to reduce erosion pollution pursuant to Article 7 (2). '
Paragraph 5 shall become paragraph 6.
21. in Article 5, paragraph 6 shall be deleted;
22. In Section 6, the words "water erosion 'are added at the end.
23. in Article 6 (1), the words "to reduce the erosion threat to agricultural land (hereinafter referred to as the" Action Plan ")" shall be deleted;
24. in Article 6 (2), the words "if they do not exceed five times the area of one crop on which the erosion event recorded in the monitoring of the erosion of agricultural land" shall be deleted;
25. Paragraph 6 (3) reads:
"(3) The update of the plan of measures during the period for which the agricultural operator has drawn up the plan of measures shall be carried out by means of an anti-erosion calculator and only to the extent of sowing, measures to reduce the erosion threat referred to in Article 7, the extension of the period for which the agricultural operator has drawn up the plan of measures or the area of agricultural land covered by the plan of measures. Paragraph 2 shall be without prejudice to this. ';
26. In Article 6, the following paragraph 4 is added:
"(4) The agricultural operator shall draw up a new plan of measures before the end of the period for which it has drawn up the existing plan of measures. The new action plan will immediately follow up on the existing action plan. Paragraph 6a (2) shall be without prejudice to this. ';
27. in Article 7 (1) of the introductory part of the provision, the words "water erosion" shall be inserted after the word "threat."
28. in Article 7 (1) (b) and (c):
'(b) agri-technical measures, in particular:
1. the setting-up of the crop, intercrop or vegetable residues;
2. the introduction of crops into shallow treated soil;
3. strip treatment of soil,
4. the establishment of crops with a support crop,
5. the creation of a subsewn crop,
6th peer cultivation,
7. peeling, peeling at potatoes,
8. Auxiliary crops in the interhornary area of potato cultivation,
9. Greenening of prepared horrors for potato planting,
10. undermining, paving,
(c) technical measures:
1. anti-erosion ducts,
2. anti-erosion ditches,
3. anti-erosion limits,
4. anti-erosion barriers,
5. terasing,
6. field paths with anti-erosion function,
7. grassy valleys with stabilised path of concentrated effluent,
8. anti-erosion grass belts. ';
29. in Paragraph 7 (2):
"(2) The measures referred to in paragraph 1 (a), paragraph 1 (b) (1), (3), (4), (5), (8) and (9), windmills or tree lines shall be laid down as measures to reduce erosion hazards. ';
30. In the title of Annex No 1, the words "water erosion 'are added at the end.

Evaluation of the erosion threat to water erosion on the area under assessment
The calculation of the threat to agricultural soils of water erosion and the evaluation of the effectiveness of the proposed anti-erosion measures is based on the Universal Soil Loss Equation, which is shaped

The excess of the erosion threat rate is expressed in the erosion threat to agricultural land at which the permissible loss of soil by erosion is exceeded. For the purposes of the Decree, this is a condition where the maximum permissible product of the values of the plant protection factor and the anti-erosion factor is exceeded in the counter-erosion calculator on the assessed area. For the purposes of the decree, it shall be expressed in the form of:
C. P > Cp.
The non-compliance with the erosion risk is expressed in a relationship that expresses an erosion threat to agricultural land at which the permissible loss of soil by erosion is not exceeded. For the purpose of the decree, this is a condition where, in the counter-erosion calculator, the maximum permissible value of the plant protection factor and the anti-erosion factor is not exceeded on the assessed area.
C. P ≤ Cp. Pp,
the value of the product Cp. Pp represents the product of the values of the plant protection factor and the anti-erosion factor exceeding which the permissible erosion loss is exceeded. The anti-erosion calculator defines it based on the relationship
Cp. Pp = Gp / (R. K. L. S),
where the quantities used in the samples are
G = average long-term land loss of erosion (t.ha-1.rok-1)
Gp = permissible soil loss of erosion (t.ha-1.rok-1) relative to soil depth, defined as the maximum soil erosion size which allows long-term and economically available maintenance of sufficient soil fertility,
R = rain erosion efficiency factor, expressed in relation to kinetic energy and the intensity of erosion of hazardous rains (MJ.ha-1.cm.h-1.rok-1),
K = soil erodibility factor, expressed according to texture and structure of the ornice, organic matter content and permeability of soil profile (t.h.MJ-1.cm-1),
L = slope length factor, expressing the effect of uninterrupted slope length on the size of soil loss by erosion (unsightly - skid-to-skid ratio on unit plot length 22,13 m),
S = slope slope factor expressing the slope slope effect on the soil loss of erosion (dimensionless - skid-to-skid ratio on the unit slope 9%),
C * = vegetation conservation factor expressed in relation to the development of vegetation and agrotechnics used,
P = efficiency factor for anti-erosion measures,
Cp. Pp = permissible product of the plant protection factor and the effectiveness of anti-erosion measures due to the permissible erosion risk.
The values of the quantities used in the samples shall be determined for the area under consideration by means of an anti-erosion calculator. The factors (variables) Gp, K, L, S, C and P and the layer of erosion closed units are determined newly in the calculation of erosion each year, always on 1 July, the factor (quantity) R is determined every fourth year, always on 1 July, with the starting year being 2021.
The product of the quantities Cp and Pp is equal to 0 to 1, with
1. if a continuous area of more than 2 ha with Cp values is located on the area under consideration. Pp equal to or less than 0,045, the median value * * of the measured area shall be assigned to a continuous area (or more continuous areas) greater than 2 ha with Cp values. Pp equal to or less than 0,045 if less than the median value of * *) of the area under assessment, or
2. if a continuous area of more than 2 ha with Cp values is situated on the area under consideration. Pp equal to or less than 0,15, the median value * * of the area under consideration shall be assigned to a continuous area (or more continuous areas) greater than 2 ha with Cp values. Pp equal to or less than 0,15 if less than the median value of * *) of the area under assessment; or
3. if a continuous area of more than 2 ha with Cp values is located on the area under consideration. Pp equal to or less than 0,4, the median value * * of the measured area shall be assigned to a continuous area (or more continuous areas) greater than 2 ha with Cp values. Pp equal to or less than 0,4 if less than the median value of * *) of the area considered.
If there is no continuous area on the area under assessment in accordance with points 1, 2 or 3, the median value of the area under assessment shall be assigned to the area under assessment.
Explanatory note:
*) For factor C, the rotational procedure is based on the 5-year period in which the erosion hazard is assessed; the minimum assessment period of one crop shall be the period from the date of the presiding of the crop to the date of the last basic crop processing operation to the subsequent crop, leaving out this last working operation until the date of sowing of the subsequent crop, - in the case of the use of combined agri-technical land processing systems with the least favourable value of all combined crops.
* *) The median value is detectable for the area under consideration in the calculation of erosion. "

Evaluation of the erosion threat to wind erosion on the area under assessment
The assessment of the erosion threat to wind erosion in the anti-erosion calculator is carried out by synthesis, which is created by a combination of the map "A map of areas of potential wind erosion risk based on soil-based climate factors' (MPK), to which a layer of identified vegetation barriers is applied and their protective functions are evaluated within the prevailing wind direction and the exceedance of the permissible length of the unprotected land is evaluated. The result is a data layer with a hazard level code which is subsequently distinguished into areas at risk or at risk according to Annex 1a.
Description of individual factors entering synthesis:
1. Map of areas potentially threatened by wind erosion based on soil-climate factors (MPK) - The potential threat to light soils, the potential threat to heavy soils, the adverse conditions for heavy soils in the winter period, the risk of suckage in the spring and autumn periods and wind conditions in the spring and autumn periods are taken into account. The resulting data layer is categorised into six categories according to the degree of hazard: 1 - no threat, 2 - soil vulnerable, 3 - soil slightly endangered, 4 - soil vulnerable, 5 - soil severely endangered and 6 - soil most vulnerable.
2. Identified vegetation barriers - The effectiveness of vegetation barriers is represented by protection zones in the direction of the predominant erosion of dangerous winds in which the surrounding vegetation barrier is protected against the negative effects of wind erosion. The protective effect is reflected on the leeward and windward side of the vegetation barriers and the length depends on the type of vegetation barrier. In the case of vegetation barriers of the type forest protection belt and windpipe, the length of the protection zone on the windward side shall be 100 m and 300 m respectively. The length of the protection zone on the wind side shall be 50 m and 150 m respectively for tree and shore type vegetation barriers. The prevailing wind direction shall enter into the assessment of the protection zones of the vegetation barriers and the determination of the permissible length of the unprotected parcels referred to in point 3. Data on the predominant direction and wind speed (in particular above 10 m.s-1 measured at a height of 10 m above the surface) in the spring and autumn periods are key, including data on maximum wind impact.
3. Allowed length of unprotected plot - Depending on the potential threat referred to in point 1, the tolerated length of the land in the prevailing wind direction has been determined as follows: 350 m for areas with a potential threat of 6 - soil most vulnerable, 600 m for areas with a potential threat of 5 - soil strongly threatened and 850 m for areas with potential threat 1 - no threat, 2 - soil susceptible, 3 - soil slightly endangered, 4 - soil vulnerable.
Fusion procedure:
Step 1: A map of areas potentially threatened by wind erosion based on soil climate factors (MPK) is used.
Step 2: The influence of vegetation barriers is reflected in the map of the MPK. Protection zones on wind and leeway sides are generated around the vegetation barriers. Protection zones reduce the risk of protected soil to Category 1 - without danger.
Step 3: 0 is added to the original hazard category designation (values 1-6). This creates a code name in which information from both layers is preserved. Zero at the last place of the hazard code label is added also for analysis taking into account the maximum tolerated length of the plot into consideration. The hazard code is classified into six categories (10 - no threat, 20 - vulnerable land, 30 - slightly vulnerable land, 40 - vulnerable land, 50 - severely vulnerable land and 60 - most vulnerable land).
Step 4: The degree of susceptibility of land based on their length is determined. The maximum length is calculated in the direction of the predominant erosion of dangerous winds. According to the prevailing potential risk code, the maximum tolerated length is determined. By comparing the actual length of the land and the maximum tolerated length, the parcels for which the length limit has been exceeded shall be identified. The effect of the length of the plot is reflected in the resulting map by a change in the code description, whereby in the case of parcels with a exceeded limit length, value 1 is added to the last place of the code. It is possible to identify from the code name how the territory is threatened and why it is. According to the code name it is then possible to evaluate whether it is an endangered area or an unthreatened area. '
Efficacy
This Decree shall take effect on 1 July 2027.
