THE LAW

of 5 December 1990

amending and supplementing Act No. 100 / 1970 Coll., on the Service Ratio of Members of the National Security Corps, as amended, and Act No. 169 / 1990 Coll., on Civil Commissions of the Ministries of the Interior and amending and supplementing Act No. 100 / 1970 Coll., on the Service Ratio of Members of the National Security Corps, as amended by Acts No. 63 / 1983 Coll. and No. 74 / 1990 Coll.

The Federal Assembly of the Czech and Slovak Federal Republic decided on this law:

Čl. I

Act No. 100 / 1970 Coll., on the service relationship of members of the National Security Corps, as amended by Acts No. 63 / 1983 Coll., No. 74 / 1990 Coll. and No. 169 / 1990 Coll., is amended as follows:

1. Paragraph 36, including the title, reads:

„§ 36

Service over the basic service period of the week

(1) If this requires an important interest in the service, the member shall be obliged to perform the service above the fixed basic service period of the week.

(2) Where a member of a service of a direct security nature exceeds a specified basic period of service in a week, he shall be entitled, for each hour of service, to a replacement leave; the replacement leave must be granted within one month and, where this is not possible for the important interests of the service, the member shall be entitled, for each hour of service, to cash compensation equivalent to his average hourly service income. For continuous rest days of the week or holidays, the cash refund shall be increased by 33%.

(3) The heading of the persons referred to in paragraph 2 shall be determined by the Minister of Interior of the Czech Republic and the Minister of Interior of the Slovak Republic after consultation with the relevant trade union body. "

"(d) Paragraph 99 (3), fourth and fifth sentences, § 100 (1) (g), § 101 (2) and (6), § 102 (2), second sentences, § 114a and § 117 (3) shall not apply to the service of members of the corps."

3. In Paragraph 126, the present text becomes paragraph 1. the following paragraph 2 is inserted after paragraph 1:

"(2) Members of the corrigendum corps whose service ended between 1 July 1990 and 31 December 1991 shall not be entitled to the severance allowance provided for in Paragraph 108, the salary compensation provided for in paragraphs 109 or the service allowance provided for in paragraphs 110 to 114, unless the service authority decides otherwise at their request. '

Čl. II

Act No. 169 / 1990 Coll., on the Civil Commissions of the Ministries of Interior and on the amendment and amendment of Act No. 100 / 1970 Coll., on the Service Ratio of Members of the National Security Corps, as amended by Acts No. 63 / 1983 Coll. and No. 74 / 1990 Coll., is added as follows:

In Article III, the words "and corrigendum corps' shall be inserted after the words" National Security Corps members'.

This Act shall take effect on the day of its publication.
