on the Collection of Laws of the Czech Republic
The Czech National Council decided on this law:
Purpose of the law
The purpose of this Act is to regulate the way in which the Collection of Laws of the Czech Republic ("the Collection of Laws') declares general binding legislation (" the Laws') or measures of central authorities of the Czech Republic ("the Central Authority ') and international treaties, as well as to lay down the rules for the issue of the Collection of Laws and lay down the conditions for the validity and effectiveness of the legislation declared in the Collection of Laws.
Legislation
The Collection of Laws shall be published in full text:
(a) the constitutional and other laws of the Czech National Council and the legal measures of the Bureau of the Czech National Council,
(b) the decision of the Constitutional Court of the Czech Republic in cases where the law so provides;
(c) the Decree of the Government of the Czech Republic;
(d) the legislation of central government bodies; that legislation is entitled "Order ',
(e) communications and notifications, where the law so provides;
(f) State-owned bank measures in cases where the law so provides.
Announcement of international agreements
(1) A Communication from the Ministry of International Relations of the Czech Republic on the negotiation of international treaties, which is bound by the Czech Republic together with its full text, a communication on the termination of international treaties and other matters relevant to their implementation, is hereby published in the Collection of Laws.
(a) international agreements of a political and economic general nature, as well as international agreements for which the law is required;
(b) other international agreements containing arrangements concerning the legal status or interests of persons and organisations.
(2) The full text of the international agreements referred to in paragraph 1 (b) shall not be published if the arrangements contained therein concern a small number of organisations. In this case, the communication of the Ministry of International Relations of the Czech Republic contains an indication of where the full text of the international agreement is available for consultation.
(3) If, under the international agreement, a text other than that in the Czech language is applicable to its interpretation, the communication of the Ministry of International Relations of the Czech Republic shall include an indication of where the text of the international agreement which is relevant for its interpretation can be consulted.
Notification of measures by central authorities
(1) They are published in the Collection of Laws by publication of the full text or by notification of their publication
(a) measures taken by the Czech National Council, the Bureau of the Czech National Council or the Government of the Czech Republic, if the law so provides or if they so decide,
(b) measures taken by other central authorities, if the law so provides.
(2) The name "Order 'shall not be used for the measures referred to in paragraph 1.
Validity and effectiveness of legislation
(1) The legislation is in force on the day of its publication in the Collection of Laws.
(2) If no later date is provided for, the legislation shall become effective on the 15th day following its publication. Where an urgent general interest so requires, an earlier start of effectiveness may exceptionally be established, but first on the date of publication.
Rules on the issue of the Collection of Laws
The Collection of Laws is published in Czech.
(1) A collection of laws is issued in sequentially numbered amounts, each of which contains the title of the date on which it was distributed; that date is the date of publication of the legislation, international agreements and measures contained in the amount.
(2) The amounts of the Collection of Laws are normally divided into the part in which the legislation and communications referred to in Article 3 are declared and the part in which the measures provided for in Article 4 are declared.
(3) The legislation and communications provided for in Article 3 are given by order numbers. This numerical series as well as the numerical series of individual amounts of the Collection of Laws shall be closed at the end of the calendar year.
(4) Press errors are corrected in the Collection of Laws by publishing an editorial communication.
Common provisions
The Department of Interior of the Czech Republic is responsible for ensuring that legislation and communications pursuant to § 3 are published without delay, no later than 30 days after delivery to the editorial office and is responsible for the accuracy of the data on the dates of distribution of the individual amounts of the Collection of Laws.
The municipalities are obliged to obtain at least one copy of the Collection of Laws and ensure that it is accessible to everyone.
Final provisions
The Ministry of the Interior of the Czech Republic can provide details of the Editorial Office of the Collection of Laws, the submission of applications for publication of legislation and communications pursuant to § 3 and the provision of printing and distribution of the Collection of Laws.
They shall be deleted:
1. On 1 January 1993 with effect for the Czech Republic Act No. 131 / 1989 Coll., on Collection of Laws, as amended by Act No. 426 / 1990 Coll.
2. Act of the Czech National Council No. 172 / 1989 Coll., on declaring generally binding laws and other measures of the institutions of the Czech Socialist Republic in the Collection of Laws.
This Act shall take effect on 10 December 1992.
