DECLARATION

of 23 November 2006

on the declaration of the National Natural Monuments of Skalická Morávka and the determination of its closer protection conditions

According to § 79 (3) (b) and § 37 (1) of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended by Act No. 218 / 2004 Coll.:

§ 1

Subject matter

(1) The National Natural Monument of Skalická Morávka ("National Natural Monument") is announced.

(2) The reason for the special protection is to preserve the section of the natural wild flow of the Morávka river in gravel patches with characteristic communities and accompanying natural forest crops to which populations of rare or endangered plant and animal species are bound.

§ 2

Definition of national natural heritage

The national natural monument is situated in the territory of the Moravian-Silesian Region, in the cadastral territories of Skalice near Frýdku-Místek, Rashkovice, Nošovice, Nižní Lhoty and Vyšni Lhoty. The boundaries of the national natural monument shall be determined by a closed geometric pattern with direct sides whose vertices are determined by the coordinates given in the uniform trigonometric network of the cadastral1). The list of coordinates of the closed geometric pattern and its individual vertices arranged as they follow in the pattern is contained in Annex 1 to this decree. The indicative graphical representation of the territory of the national natural monument is contained in Annex 3 to this decree.

§ 3

Closer protection conditions

Only with the consent of the competent nature conservation authority can the national natural monument

(a) make changes to the type of land or the way in which it is used (2);

(b) make changes to completed structures or to changes to structures before their completion (m3);

(c) to adjust the road surface (4) using non-local natural material of the same geological origin;

(d) to establish or mark browns, cycling paths or footpaths (4);

(e) driving vehicles 5) into the territory of the national natural heritage; consent is not required for vehicles of the Police of the Czech Republic and municipal police, fire brigades and non-state fire brigades, armed forces of the Czech Republic in the performance of the tasks of the armed forces and other public and public services in the performance of public administration, rescue services and veterinary services, and for vehicles needed for the care of land or crops and for the management of land or crops,

(f) to establish landfills of any material, including temporary landfills;

(g) to make fire;

(h) use biocides and other chemicals.

§ 4

Protection zone

The protection zone of the national natural heritage is situated in the territory of the Moravian-Silesian Region, in the cadastral territory of Raškovice. The boundaries of the national natural heritage protection zone shall be determined by a separate enclosed geometric pattern with direct sides whose vertices are determined by the coordinates given in the single trigonometric network of the cadastral1). The list of coordinates of the closed geometric pattern and its individual vertices arranged as they follow in the pattern is contained in Annex 2 to this decree. The indicative graphical representation of the territory of the protection zone of the national natural heritage is contained in Annex 3 to this Decree.

§ 5

Efficacy

This Decree shall take effect on 1 January 2007.
