GOVERNMENT REGULATION
of 11 October 2004
amending Government Regulation No 115 / 2004 Coll., laying down certain procedures for implementing the measures of the common organisation of the market in starch
The Government orders the implementation of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 128 / 2003 Coll., Act No. 85 / 2004 Coll., Act No. 41 / 2004 Coll. and Act No. 237 / 2004 Coll., and Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 62 / 2000 Coll., Act No. 307 / 2000 Coll., Act No. 128 / 2003 Coll., Act No. 85 / 2004 Coll. and Act No. 317 / 2004 Coll.:
Čl. I
Government Regulation No. 115 / 2004 Coll., laying down certain procedures for implementing the measures of the common organisation of the market in starch, is amended as follows:
1. in Article 1, the following point (e) is inserted after point (d):
"(e) grant additional national subsidies for the 2004 / 2005 marketing year to potato growers (hereinafter referred to as" additional subsidies ") through the producer concerned, '.
Point (e) shall be renumbered as point (f).
2. footnote 1 shall read:
"(1) Council Regulation (EC) No 1868 / 94 of 27 July 1994 establishing a quota system for the production of potato starch. Commission Regulation (EC) No 97 / 95 of 17 January 1995 laying down detailed rules for the application of Council Regulation (EEC) No 1766 / 92 as regards the minimum price and the compensatory payment to be paid to potato producers and Council Regulation (EC) No 1868 / 94 establishing a quota system for the production of potato starch. COMMISSION REGULATION (EEC) No 1722 / 93 of 30 June 1993 laying down detailed rules for the application of Council Regulations (EEC) No 1766 / 92 and (EEC) No 1418 / 76 concerning production refunds in the cereals and rice sectors respectively. COMMISSION REGULATION (EC) No 800 / 1999 of 15 April 1999 laying down common detailed rules for the application of the system of export refunds on agricultural products. Commission Regulation (EC) No 1520 / 2000 of 13 July 2000 laying down common detailed rules for the application of the system of granting export refunds on certain agricultural products exported in the form of goods not covered by Annex I to the Treaty and the criteria for fixing the amount of such refunds. Council Regulation (EC) No 1259 / 1999 of 17 May 1999 establishing common rules for direct support schemes under the common agricultural policy. Council Regulation (EC) No 1782 / 2003 of 29 September 2003 establishing common rules for direct support schemes under the common agricultural policy and establishing certain support schemes for farmers and amending Regulations (EEC) No 2019 / 1993, (EC) No 1452 / 2001, (EC) No 1453 / 2001, (EC) No 1454 / 2001, (EC) No 1868 / 1994, (EC) No 1251 / 1999, (EC) No 1254 / 1999, (EC) No 1673 / 2000, (EEC) No 2358 / 1971 and (EEC) No 2529 / 2001. '
3. In Article 12, the current text becomes paragraph 1 and the following paragraphs 2 and 3 are added:
"(2) The information referred to in paragraph 1 (a) and (b) shall be provided by an approved manufacturer who is not also a producer of the basic product.
(3) A production refund may be granted for supplies of the basic product made before the issue of the certificate if, at the time of delivery, a zero amount of the production refund has been fixed for the basic product and if the approved manufacturer proves such supplies to the Fund. '
4. the following Part Six is inserted after Part Five:

ADDITIONAL SUBSIDY
§ 13a
Determination of the amount of the additional subsidy
(1) The amount of the additional subsidy is determined according to the starch content of potatoes and is set out in Annex No 9a.
(2) The supplementary subsidy provided for in euro is converted into a monetary unit of the Czech Republic (CZK) according to the exchange rate set by the immediately binding regulation of the European Community9a).
§ 13b
Application for additional subsidy
(1) The application for a supplementary subsidy is submitted to the Fund by the producer who has a contract with the potato grower for the production of starch9b) and which the manufacturer has given in the summary of the contracts referred to in Article 14 (1) (a). The manufacturer may apply for an additional subsidy only for the quantity of potatoes corresponding to the starch production at the level of the subquota allocated to him for the marketing year concerned.
(2) The manufacturer shall submit an application for a supplementary subsidy by the end of the second month following the month in which the manufacturer took over the supply of potatoes in the relevant marketing year from the potato grower in accordance with the starch-producing potato contract. The shortest period for which an application may be submitted shall be one calendar month.
(3) The Fund will grant and pay a supplementary subsidy to the potato grower through a producer who has assumed the obligations arising from the starch-producing potato contract from another producer on the basis of a change in the ownership or user relationships of the producer (9c).
(4) The request is to be made using the form issued by the Fund.
(5) After examination of the application, the Fund will decide on the grant of the additional subsidy and transfer the payment to the manufacturer's account no later than 15 days after the date of acquisition of the legal power of this Decision.
§ 13c
Payment to potato growers
(1) The manufacturer shall transfer the payment granted to the potato grower's account no later than 15 days after receipt of the payment from the Fund.
(2) The potato grower shall be kept for a period of 10 years from the beginning of the calendar year following the conclusion of the starch potato cultivation contract
(a) a contract for the cultivation of starch potatoes;
(b) documents proving that the manufacturer has taken delivery of the quantity and quality of the potato cultivation contract from the potato grower,
(c) proof of receipt by the potato grower of the payment provided by the manufacturer in accordance with paragraph 1.
9a) Commission Regulation (EC) No 1407 / 2004 of 2 August 2004 fixing the exchange rate for 2004 for the single area payment scheme applicable to the Czech Republic, Estonia, Cyprus, Latvia, Lithuania, Hungary, Poland and Slovakia.
9b) Article 3 of Commission Regulation (EC) No 2236 / 2003 of 23 December 2003 laying down detailed rules for the application of Council Regulation (EC) No 1868 / 94 establishing a quota system for the production of potato starch.
(c) Article 16 of Commission Regulation (EC) No 2236 / 2003. "
Parts sixth to eighth shall be referred to as parts seventh to ninth.

Čl. II
For the supply of potatoes taken over by the manufacturer in the 2004 / 2005 marketing year from potato growers in accordance with the starch-producing potato contract, the application for supplementary subsidy pursuant to Article 13b of Government Regulation No 115 / 2004 Coll., as effective from the date of entry into force of this Regulation, may be submitted no later than 2 months after the date of entry into force of this Regulation if the deadline laid down for submission of the application in Article 13b (2) of Government Regulation No 115 / 2004 Coll., as effective from the date of entry into force of this Regulation, would have elapsed earlier.

This Regulation shall enter into force on the day of its publication.
