DECLARATION
of 13 December 2002
amending Decree No. 177 / 2000 Coll., implementing the Act on the Registration of Citizens, the Act on Civil Documents and the Act on Travel Documents, as amended
The Ministry of Interior provides pursuant to Section 25 of Act No. 133 / 2000 Coll., on the registration of residents and birth numbers and on the amendment of certain laws (the Act on the registration of residents) (hereinafter referred to as "the Act"):
Decree No. 177 / 2000 Coll., implementing the Act on the Registration of Citizens, the Act on Civil Documents and the Act on Travel Documents, as amended by Decree No. 192 / 2001 Coll. and Decree No. 248 / 2001 Coll., is amended as follows:
1. In Article 1, the following paragraph 4 is added:
"(4) The model form" Document of birth number "is set out in Annex No 3a. ';
2. the following Sections 13a and 13b are inserted after Section 13, including the headings and footnotes 1) to 6):
"Technical method for transferring birth numbers to dispensing points and allocation of birth numbers to dispensing places
Transmission of birth numbers
(1) The Ministry of the Interior (hereinafter referred to as "the Ministry") transfers from the register of birth numbers (hereinafter referred to as "the register") to the delivery points of birth numbers (hereinafter referred to as "the place of issue") 1) a set of birth numbers (hereinafter referred to as "the assembly") for the individual assignment of the birth number to natural persons meeting the conditions (2) (hereinafter referred to as "the natural person"). The assembly shall be made up for each calendar day and shall be transmitted in a file for a period of three calendar months at the latest, so that each issue point receives them for verification and subsequent use no later than three working days before the beginning of the first calendar month from the period for which the set is formed.
(2) The assembly also includes groups of designated and not yet assigned birth numbers, which are kept in the registry by the Ministry, requested by the delivery point in the relevant calendar month for which the assembly is processed, for the purposes of their individual assignment to a natural person pursuant to Sections 16 (b), 16 (c) and (d) and 17 (2) of the Act.
(3) The Ministry shall transmit the specified and not yet allocated birth numbers referred to in paragraph 2 to both the assembly files and the requested bodies.
(a) remote access through a telecommunications network providing feedback to the delivery point;
(b) on a technical data medium; or
(c) in the form of printed documentation.
The registry administrator shall decide on the specific form of transmission to the respective place of issue of the reports as well as the requested specified and not yet allocated birth numbers according to the state of its technical and organisational conditions.
(4) The place of issue shall be forwarded to the Ministry, no later than 10 days after the end of the calendar month, of the completed reports prepared for each relevant calendar day, in the form in which they were provided to it. A protocol containing:
(a) the identification of the point of departure and the address of its registered office;
(b) the designation of the calendar month and year for which they are processed;
(c) the number of processed assemblies, according to the number of calendar days in the relevant calendar month;
(d) the assigned birth numbers in each assembly, broken down by reason of their allocation to the groups which are:
1st birth,
2. irrevocable adoption,
3. the assignment of the birth number to a national of the Czech Republic who has not yet had it,
4. the assignment of a home number to a stranger applying for a residence permit in the Czech Republic,
5. the assignment of the birth number to the person granted asylum in the Czech Republic;
6. assignment of the birth number to the natural person who requires the birth number to fulfil the conditions under the special legislation, 3)
7. change of birth number,
(e) the number of birth numbers not allocated at the date of processing of the report from the set of assemblies transmitted for the calendar month for which the report is processed;
(f) the assigned birth numbers in each of the sets allocated when the birth number is changed, broken down by reason of the change made into groups which are:
1. the assignment of the same birth number to two or more natural persons;
2. assignment of an incorrect birth number;
3. the implementation of an irrevocable adoption;
4. gender change,
(g) a description of the exceptional events that occurred in the allocation of the birth numbers from the reports transmitted during the calendar month for which the Protocol is being processed, in particular any technical, time, legal and other exceptional events which, during the relevant period, were dealt with by the place of issue in the allocation of the birth numbers or in the direct connection with that activity;
(h) the date of processing of the report, the name and, where applicable, the names, surnames, functional classification and signature of the responsible staff member of the point of departure; where the protocol is processed and transmitted on a technical medium or through a telecommunications network, the signature shall not be provided.
Allocation of the birth number by the delivery point
(1) Allocation of the birth number means its selection from the assemblies and its assignment to a particular natural person. At the same time as the birth number is assigned, the relevant natural person shall be recorded in the register in the data provided for by this decree.
(2) The place of issue shall assign the birth number to the natural person by selecting from the departments provided by the Ministry.
(3) The following information shall be entered in the assembly in respect of the family number allocated to the natural person at birth and assigned under § 17 (2) (a), (b) and (d) of the Act:
(a) the name and, where applicable, the name, surname, maiden name of the natural person to whom the birth number has been assigned;
(b) the day, month and year of birth;
(c) a birth number initially assigned if new,
(d) the date on which the birth number was assigned,
(e) the place and district of birth and, in the case of a natural person born abroad, the place and state of birth;
(f) the sex of the natural person;
(g) citizenship;
(h) the reason for the assignment of the birth number pursuant to Sections 16 and 17 of the Act.
(4) The following information shall be entered in the assembly in accordance with Sections 16 (b), 16 (c) and (d) and 17 (2) (c) of the Act on the birth number allocated to the natural person:
(a) the name and, where applicable, the name, surname, maiden name of the natural person to whom the birth number has been assigned;
(b) the day, month and year of birth;
(c) a birth number initially assigned if new,
(d) the date on which the birth number was assigned,
(e) the place and district of birth and, in the case of a natural person born abroad, the place and state of birth;
(f) the sex of the natural person;
(g) citizenship of a natural person; in the case of children born in the Czech Republic to foreigners 4), 5) citizenship of the father and mother of the child is registered;
(h) the name (s) of the parents;
(i) in the case of irrevocable adoption, the name or, where applicable, the names, surnames of the adopters, 6)
(j) the reason for the assignment of the birth number under Sections 16 and 17 of the Act.
(5) The following information shall be entered in the assembly in respect of the family number allocated to the natural person who requires the birth number to meet the conditions under the special legislation: (3)
(a) the name and, where applicable, the name, surname, maiden name of the natural person to whom the birth number has been assigned;
(b) the day, month and year of birth;
(c) the date of assignment of the birth number;
(d) the place and district of birth and, in the case of a natural person born abroad, the place and state of birth;
(e) the sex of the natural person;
(f) citizenship of a natural person;
(g) the reason for the assignment of the birth number pursuant to Sections 16 and 17 of the Act.
(6) In the case of the assignment of a birth number pursuant to § 16 (a), (c) and (d) and § 17 (2) (c) of the Act, the natural person shall be assigned the place of issue by authority.
(7) In cases of the assignment of a birth number pursuant to § 16 (b) and § 17 (2) (d) of the Act, the natural person shall be assigned the place of issue on the basis of a written reasoned request containing:
(a) the name and, where appropriate, the names, surnames of the natural person, any changes thereto;
(b) the natural person's maiden name;
(c) the day, month and year of birth;
(d) the birth number initially assigned if new,
(e) the place and district of birth of the natural person; where a natural person was born abroad, the place and state of birth,
(f) the sex of the natural person;
(g) citizenship of a natural person;
(h) the reason for the assignment of the birth number pursuant to Sections 16 and 17 of the Act.
The applicant for the assignment of the birth number shall sign the application in front of the staff member of the delivery point.
(8) The application for the assignment of the birth number referred to in paragraph 7 shall be accompanied by the birth certificate of the applicant, which is a national citizen of the Czech Republic, or by an appropriate document of the date and place of birth and citizenship of the applicant, which fulfils the conditions for the assignment of the birth number but is not a national citizen of the Czech Republic. 2)
3. The following Annex 3a is inserted after Annex 3 to the Order:

Decree No. 55 / 1976 Coll., on the birth number, is hereby repealed.
Efficacy
This Decree shall take effect on 1 January 2003.
