Law on the abolition of the Federal Security Information Service

THE LAW
of 13 November 1992
repealing the Federal Security Information Service
The Federal Assembly of the Czech and Slovak Federal Republic decided on this law:
§ 1
Preliminary provisions
The Federal Security Information Service shall be repealed on 31 December 1992.
§ 2
Distribution of immovable property
The real estate of the Czech and Slovak Federal Republic, to which the right of management of the Federal Security Information Service belongs, is transferred to the Czech Republic, if located in the Czech Republic, and to the Slovak Republic, if located in the Slovak Republic.
§ 3
Distribution of movable property
(1) The movable property of the Czech and Slovak Federal Republic, to which the right of management of the Federal Security Information Service belongs and which, due to its purpose, use and / or nature of the real estate accessories, is transferred to the Czech Republic or to the Slovak Republic together with such real estate.
(2) The movable property of the Czech and Slovak Federal Republic, to which the right of management of the Federal Security Information Service and which does not transfer to the Republic pursuant to paragraph 1, is transferred to the Czech Republic and to the Slovak Republic in a ratio of two to one.
§ 4
Allocation of property rights and obligations
(1) The property rights of the Czech and Slovak Federal Republic, to which the right of management of the Federal Security Information Service belongs, and the obligations of the Czech and Slovak Federal Republic, to which the Federal Security Information Service is required, are transferred to the Czech Republic and to the Slovak Republic together with the property to which they relate.
(2) The property rights of the Czech and Slovak Federal Republic, to which the right of management of the Federal Security Information Service belongs, and the obligations of the Czech and Slovak Federal Republic, to which the Federal Security Information Service, which does not transfer to the Republic pursuant to paragraph 1, is required, are transferred to the Czech Republic and to the Slovak Republic in a ratio of two to one.
§ 5
The relevant status for the distribution of assets, property rights and liabilities under § 2 to 4 is the status at the date of revocation of the Federal Security Information Service.
§ 6
Property, property rights and obligations which are transferred to the Czech Republic pursuant to Articles 2 to 4 and 9 (4) shall be taken over by the State body designated by the Czech National Council Act (1) (hereinafter referred to as the competent authority of the Czech Republic) and which are transferred to the Slovak Republic under Articles 2 to 4 and 9 (4), shall be taken over by the State body designated by the Slovak National Council2 (hereinafter referred to as the competent authority of the Slovak Republic).
§ 7
Distribution of information in the records
Information included in the records Federal security information services are divided between the competent authority of the Czech Republic and the competent authority of the Slovak Republic under an agreement concluded between these authorities with respect for the national security interests of both Republics.
§ 8
File Agenda
(1) The file agenda of the Federal Security Information Services of an administrative and technical nature (hereinafter referred to as the "file agenda") is to be transmitted to the competent authority of the Czech Republic and to the competent authority of the Slovak Republic, depending on the country to which the property, law or liability is transferred. If the file agenda relates to assets, rights and obligations which go both to the Czech Republic and to the Slovak Republic, a copy of the file agenda shall be drawn up and the file agenda shall be forwarded to the competent authority of the Czech Republic and to the competent authority of the Slovak Republic.
(2) The staffing agenda is to be forwarded to the competent authority of the Czech Republic if it concerns persons who are nationals of the Czech Republic on the effective date of this Act and the competent authority of the Slovak Republic, if it concerns persons who are citizens of the Slovak Republic on the effective date of this Act. However, if the person concerned by the file agenda is to become a national or a worker of a competent authority of the Czech Republic or of a competent authority of the Slovak Republic on 1 January 1993, the file agenda shall be forwarded to that authority at the request of that authority.
§ 9
Staff and employment relations
(1) The service conditions of members of the Federal Security Information Service, the employment conditions of the staff of the Federal Security Information Service and the employment relationship under the agreement on work outside the employment relationship shall expire on 31 December 1992 on the grounds of the revocation of the Federal Security Information Service.
(2) Members and staff whose employment or employment is terminated pursuant to paragraph 1 are entitled to financial compensation equal to three times the last gross monthly salary. Departure or severance pursuant to the Specific Regulations (3) does not apply in such cases.
(3) The financial compensation referred to in paragraph 2 shall be paid by the Federal Security Information Service on a one-off basis, not later than 31 December 1992.
(4) The rights and obligations from the end of the service and employment relationship to and from the relations with the Federal Security Information Service, which will not be settled by the Federal Security Information Service on the effective date of this Act, are transferred to the Czech Republic, if they concern the citizens of the Czech Republic and the Slovak Republic, if they concern the citizens of the Slovak Republic.
§ 10
When speaking about the Federal Security Information Service in other generally binding legislation, this means for the territory of the Czech Republic the competent authority of the Czech Republic and for the territory of the Slovak Republic the competent authority of the Slovak Republic.
§ 11
Repeal
Act No. 244 / 1991 Coll., on the Federal Security Information Service and on the use of intelligence is hereby repealed.
§ 12
Efficacy
This Law shall take effect on 31 December 1992.
